2. There were a few significant changes between the pre-solicitation identified requirements and those in the final RFP. Prior to final release we were under the impression that we could bid only one of the four primary regions.
However, this requirement was removed in the final RFP, making it possible to bid as many regions as we believe we can qualify to bid. This is a significant change since many contractors are now considering bidding regions that we previously thought we could not bid. In order to identify team partners to support the effort, and in particular, Page 4 of 61ProjNet: Logged In User identify small and minority businesses in these additional regions, as well as develop competitive pricing, we feel that it is in the government's best interest to provide a 2-week extension to the due date so that we can develop the most competitive pricing and establish firm commitments to maximize the use of small and minority businesses. We respectfully request that the government please consider providing a 2-week extension to the proposal due day to allow contractors time to respond to this significant change.

5. Section L, Proposal Submission, 1. Introduction and b Staffing Approach. The instructions contained in the opening paragraph indicate that offeror's shall convey how multiple missions in separate regions will be executed simultaneously if offeror is awarded multiple regions. However, under B. the Staffing Approach we are to convey how we plan to prepare and execute concurrent missions in different areas of a specific Region. Section M also evaluates us on concurrent missions in different areas of a specific Region. We assume we are to address the different areas of a specific Region. Is this the correction assumption?

6. Section L, B. Staffing Approach and B. Management/Operations Plan. Section b. 12. Amendment 0002 request Past Performance from prime and subcontractors, including all relevant Government and/or commercial contracts for the Prime Offeror and each major subcontractor during the past 10 years as well as performance recognition documents received in the last 3 years for the Offeror and major subcontractors. (a) It is not clear to us if USACE will consider it a strength or weakness if the prime is able to provide all the required Past Performance contracts/projects without relying on "major subcontractors" or if we will be scored down for taking this approach – would USACE please clarify. (b) If the prime is providing all 5 Past Performance contracts/projects are we still required to provide "all relevant Government and/or commercial contracts for each major subcontractor during the past 10 years." (c) If yes, please define what is meant by "major subcontractor." Would a subcontractor be considered a major subcontractor only if we are relying on their Past Performance information as one of the 5 Past Performance contracts/projects?

13. Amendment 0002, Past Performance Requirements, May 6th, Additional Clarifications. The original Past performance requirement requested up to five contracts/projects and PPQs along with organizational change history.
The Amendment 0002 released on May 6th provides additional definition for what is to be contained in the section.
However we are unclear as to the project write-ups. We are assuming you want up to 5 contracts/project write-ups with PPQs first, please confirm this is required. Second, USACE requires all relevant Government and/or commercial contracts for the Prime Offeror and each major subcontractor during the past ten years, performance recognition documents received in the last three years for the Offeror and Major subcontractors, and small business subcontracting goals for contracts, copies of six subcontracting reports or a summary subcontracting report. This is a significant addition to the original requirement as it was up to Offerors if they submitted prime only contracts/subcontracts. This requirement asks information of our subcontractors which is a new requirement and we would ask for a two week extension to accommodate these new requirements.

According to 3.6.1, "HHW is excluded from the definition of Hazardous Waste and therefore does not require the same collection or handling procedures as Hazardous Waste. Examples of HHW include, but are not limited to:
batteries, waste oil, waste fuels, paint, chemicals, antifreeze, pesticides, spray cans, unidentified liquids, and household cleaners." The terms "chemicals" and "unidentified liquids" is very broad. Therefore, due to potential exposures, ignitability, corrosivity, reactivity, and toxicity of "chemicals" and "unidentified liquids" that residential property owners may possess, the contractor cannot EXCLUDE "chemicals" and "unidentified liquids" from the definition of Hazardous Waste unless properly tested and categorized. Is there a more comprehensive list of what is determined Non-Hazardous Waste to be labeled HHW?

IF a small business contractor has four teams but wants to bid all regions, and the contractor provides prices for all regions, will the USACE consider the contractor in the order stated that the awards will be given out? And the contractor will have the opportunity to compete in all regions as long as it has not been awarded the maximum amount of teams it has proposed. In simple English if we have 4 teams that can mobilize to any part of the country can we submit prices for all regions and be considered up to our maximum of four teams until all regions are awarded? We don't want to have four teams ready to go and only price out 4 regions and if we don't get those regions not be able to compete for any other region if we are not awarded the four we chose, this is why we would like to price out all regions.
