AMENDMENT 0005

Advanced Contract Initiative (ACI) – Regional Contracts for Debris Management Services

(RCDMS)

The purpose of this amendment is to correct Instruction to Offerors, PWS, Section L and M.

All changes in Amendment 0005 supersede previous amendments.

ALL OTHER TERMS AND CONDITIONS REMAIN THE SAME

SUMMARY OF CHANGES

SECTION A - SOLICITATION/CONTRACT FORM

The following have been modified:

SUMMARY - INSTRUCTIONS TO OFFERORS

The services to be provided under the ACI RCDMS contract shall be accomplished at the locations identified in the task order and may include locations in the Continental United States (CONUS) and its territories.

The minimum guarantee is $10,000 and extends throughout the period of performance of the contract. The minimum guarantee task order for $10,000 will be awarded immediately after the base contract is awarded. This payment will satisfy the minimum guarantee for the period of performance of the contract.

PRE-PROPOSAL CONFERENCE

The Government will hold a pre-proposal conference for potential offerors to ensure an understanding of the Government’s objectives under this solicitation. Participants will hear presentations regarding ACI Debris Removal, the scope of work and contractual considerations.

Any questions posted to ProjNet may be addressed during the pre-proposal conference for the exchange of information between Government presenters and Contractor representatives in attendance. All interested firms are encouraged to attend, but participation will not be a prerequisite for submitting a proposal.

AMENDMENT 0005

The pre-proposal conference will be held virtually on 4 June 2019. Notification has been posted to www.fbo.gov to include registration instructions. Registration will be on a first-come, first served basis. Individuals not registered for the event will not have access to the facilities on the date of the conference. Registration must be completed via email by contacting the contract specialist at sally.a.duncan@usace.army.mil no later than 30 May 2019 or until the maximum capacity is reached. To register, provide your company name and list of attendees and contact information where you may be reached.

SOLICITATION GUIDELINES

One solicitation is being issued to include both the Suite -1 – Unrestricted Regions and Suite – 2 Restricted Regions. Offerors SHALL provide the Suite and Region that their proposal represents. Suite 2 – Restricted Regions is limited to businesses that are registered in the System for Award Management (SAM) as “Small” using NAICS Code 562119, which has a size standard of $38.5M. Details are provided in Section L and Section M of this solicitation.

http://www.fbo.gov/

There is no limit on the number of awards an offeror may receive. Offerors must indicate whether the proposal is for Suite 1- Unrestricted or Suite 2 – Restricted and indicate which specific region.

CORRECTED BY AMENDMENT 0005 -

If a contractor chooses to propose on more than one region, the offeror must submit separate and complete proposals in accordance with instructions in Section L of the solicitation for each region. Because a single offeror has the potential to receive more than one award, each proposal shall include discrete key personnel and subcontractors for each proposal. The schedule of prices shall represent the region being proposed.

ADDED BY AMENDMENT 0005 -

An offeror may receive multiple awards. There is no limit on the number of awards an offeror may receive. To propose for more than one region, the offeror must submit separate and complete proposals in accordance with instructions in Section L of the solicitation for each region. Offerors must identify the specific regions and indicate whether the proposal is for Suite 1- Unrestricted, or Suite 2 – Restricted. The offeror’s proposal shall also convey how multiple missions in separate regions will be executed simultaneously if the offeror is awarded multiple regions. The schedule of prices shall represent the region being proposed. Each proposal submitted will be evaluated separately.

If the offeror is selected for award, the primary team proposed will be unavailable to be considered for additional awards because they will be assigned to that contract. Offerors shall rank the remaining proposed FACTOR I – MANAGEMENT/TECHNICAL APPROACH Key Personnel in order of precedence by region (specify Suite 1 or Suite 2 for every Region for which a proposal is submitted) so the Government understands how to consider their proposals.

Offerors shall submit fixed price and escalation rates for every Region (specify Suite 1 or Suite 2 for every Region for which a proposal is submitted) for which they wish to be considered. By requiring submission of prices for each Region, the Government will be able to take advantage of regional differences in the contractor’s cost of doing business. These prices will be contractually binding and cover each contract line item included in Section B of the solicitation.

END OF AMENDMENT 0005 ADDITION

Additionally, for an offeror who plans to submit proposals for more than one region in Suite 1 or Suite 2, the offeror’s proposal shall convey how multiple missions in separate regions will be executed simultaneously if the offeror is awarded multiple regions. Each proposal submitted will be evaluated separately.

Entering an incorrect email may result in the rejection of your proposal for lateness. Follow the instructions on the AMRDEC website and the confirmation emails you receive from AMRDEC.

RECEIPT OF PROPOSAL:

For the purposes of establishing whether a proposal is considered late, the government considers (the earlier of) the date and time of receipt of the email notification to the Contract Specialist and Contracting Officer by the AMRDEC SAFE website, NOT the date and time of uploading of the proposal into the AMRDEC SAFE website as the time of proposal submission. For proposals larger than the 2GB capacity of the AMRDEC SAFE website and require multiple submissions, the government will consider (the earlier of) the date and time of receipt of the email notification to the Contract Specialist and Contracting Officer of the last proposal submission. Do not assume that electronic communication is instantaneous. It can take several minutes or even hours in some cases. Federal Acquisition Regulation (FAR) 15.208 is clear that in order for the Contracting Officer to consider an otherwise late proposal, the proposal must be received before award is made, must not unduly delay the acquisition, and in the case of proposals transmitted through an electronic commerce method authorized by the solicitation, must be received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals.

The government will not be responsible for proposals delivered to any location or to anyone other than those designated to receive proposals on its behalf. Offerors are responsible for ensuring that proposals are submitted so as to reach the designated recipient of proposals.

Offerors are responsible for allowing sufficient time for the proposal to be received in accordance with the instructions provided.

PART 1

GENERAL INFORMATION

The purpose of this contract is to provide debris removal after any natural or man-made disaster or catastrophe in which the remediation has been assigned to USACE.

1.1 Description of Services: The contractor shall provide all personnel, equipment, tools, materials, supervision and other items necessary to perform debris removal services as defined in this Performance Work Statement (PWS) except as specified as government-furnished property and services. The contractor shall perform to the standards in this contract. To meet this requirement, all USACE assets, to include the contractor, must be able to mobilize and respond within 24 hours. This is a non-personal services contract for managing disaster generated debris after any natural or man-made catastrophe or major disaster supported by the U.S. Army Corps of Engineers (USACE). The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer (KO) immediately.

1.2 Background: The required work shall include clearing and removing disaster generated debris. Tasks will normally include: (1) separating debris, (2) loading the debris, (3) hauling the debris to an approved dumpsite, and

(4) dumping the debris at a debris reduction site or as directed by the KO. When necessary, other materials such as sediment, storm surge over-wash materials, land slide materials, flood fight materials and other obstructions may be removed as directed by the KO. Curbside separation of debris may be required prior to removal when not previously accomplished by property owners, as directed by the KO. Typical separation categories include household garbage, construction debris, vegetative debris, regulated asbestos containing materials (RACM), household hazardous wastes, white goods, and electronics. The contractor shall, whenever possible and efficient, process eligible debris for beneficial re-use and / or recycling.

1.3 Objectives: The purpose of this PWS is to specify the requirements for managing disaster generated debris after any natural or man-made catastrophe supported by USACE. This contract is an Indefinite Delivery/Indefinite Quantity (IDIQ) contract. The Government will issue task orders on a fixed price basis, but reserves the right to issue other than FFP price type task orders as circumstances may vary given the nature of disaster and contingency operations. The project locations will be designated in the task orders. The Government reserves the right to make multiple awards off a single solicitation and the right to award the scope of work in partial, if required. Each contract award will be for a pre-defined geographic region as detailed in Section F, Deliverables.

1.4 Scope: Debris management services may be provided within the geographical boundaries of the United States (CONUS), its territories and commonwealths. The contractor shall, unless otherwise directed by the KO, manage disaster generated debris from the point of origin to final disposal. All actions and processes used shall be in full compliance with all applicable local, state, and Federal policies, regulations, and laws. All debris management work shall be accomplished in the most efficient and effective manner appropriate for the applicable waste stream(s) in accordance with the performance work statement. Other debris related mission specific requirements and/or tasks not specifically covered in the Schedule of Prices can be negotiated at the task order level.

1.5 Period of Performance: The contract period of performance will be 5 years with an option to extend the contract for a period of 6 months.

1.6 Mission Flow: The following is a standard mission flow to explain how FEMA, the state/territory/commonwealth, USACE and the contractor interrelate to execute an emergency debris removal mission. This section is not meant to be all inclusive as to every aspect of the emergency debris removal mission, but is intended to explain most of the process and how the various entities interrelate.

For “Notice” events (examples include hurricanes and ice storms), FEMA Regions may mobilize Federal assets into a state/territory/commonwealth in preparation of a potential disaster. Under this type of declaration, FEMA tasks USACE to mobilize resources, including the contractor, into an area in preparation to respond to a forecasted disaster. The KO shall issue a Not-to-Exceed (NTE) task order to the contractor for mobilization of agreed upon assets (personnel and/or equipment) to the pre-defined staging area. Under Pre-Disaster Declaration, Federal assets are not provided to the state/territory/commonwealth. This is FEMA’s opportunity to best align and prepare for response to the pending disaster.

Once an event (man-made or natural) is declared a “Disaster” by the President (this includes an Emergency Declaration or Major Disaster Declaration), FEMA is authorized to provide assistance to the impacted state/territory/commonwealth. FEMA will stand-up the Joint Field Office (JFO) in the capital city of the impacted state/territory/commonwealth from which to manage and execute the response and recovery efforts. All response and recovery efforts will be managed/executed from the JFO. The impacted state/territory/commonwealth will provide, via their own emergency management process, requests to FEMA. Once the validity of the request has been confirmed by FEMA, FEMA passes the request to the Action Officer (AO) located at the JFO. The requests are then forwarded to the Planning Response Team (PRT) located at a staging area. The staging area is located as close to the impacted area as possible and is where most of the personnel involved in the Mission Execution Phase of this PWS are located, including the contractor and all support personnel and equipment.

Once all debris has been removed and additional requests for emergency debris removal are not anticipated, the contractor will complete the de-mobilization process.

The ACI Debris contract can be utilized for other Federal response requirements. Examples of contract utilization include, assist EPA with hazardous waste type mission, or USDA for animal carcass removal. This is just an example of usage.

1.7 General Information: Disaster generated debris is defined as materials originating from the effects of any natural or man-made catastrophe or major disaster. Materials included are of both man-made and natural origins, and may include hazardous/toxic/radiological wastes (HTRW) and household hazardous waste (HHW). Man-made debris, construction/demolition (C&D) materials includes, but is not limited to, lumber, concrete, asphalt, masonry, metals, regulated asbestos containing material, and plastics. Debris of natural origins includes, but is not limited to, all vegetative debris (grass, shrubs, stumps, and trees, including trees on houses when specified by task order) and earthen materials or storm surge materials (clay, sand, gravel, rock, residual solids), waterway debris, and earth collected with the debris while loading trucks. Debris may also include electronic wastes, appliances, vehicles, putrefied foods, flood fight materials, vessels, and dead animals. Removing materials such as sediment, storm surge over-wash materials, land slide materials, and other obstructions may be necessary to access disaster generated debris or to prepare the worksite for debris management work. Screening and sorting may be required to separate debris waste streams for processing or to remove earthen material prior to reduction.

1.7.1 Hours of Operation: Unless otherwise directed by the KO, the contractor shall work during daylight hours only, 7 days per week. The contractor shall maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the work force are essential.

1.7.2 Quality Assurance (QA): The Government shall evaluate the contractor's performance under this contract in accordance with (IAW) the quality assurance surveillance plan (QASP). This plan is primarily focused on what the Government must do to ensure the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rates.

1.7.3 Quality Control (QC): The contractor shall develop and maintain an effective QC program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. As a minimum, the contractor shall develop QC procedures addressing the areas identified in the "Performance Requirements Summary." See Section 3.8.3 for submittal requirements. After acceptance of the QC plan, the contractor shall receive the KO's acceptance in writing of any proposed change to the QC plan.

1.7.4 Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office. The KO, COR, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the KO will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

1.7.5 Contracting Officer's Representative: The COR will be identified by separate letter for each individual task order. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor contractor's performance and notifies both the KO and contractor of any deficiencies; coordinate availability of Government furnished property, and provide site entry of contractor personnel. A letter of designation issued to the COR states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting contract. A copy of this designation letter will be provided to the contractor.

1.7.6 Contractor’s 24-Hour Emergency Contact: The contractor shall provide to the KO a list of personnel available 24 hours a day in the event a requirement for contract performance arises after regular working hours. At a minimum, this list will include personnel names, day and evening phone numbers (land and cellular, pager number), and e-mail addresses. The primary point of contact (POC) shall be clearly identified on the list. The standard for responding by voice communications shall be within 30 minutes. After issuance of a task order, the contractor shall maintain a task order specific personnel roster that is updated and submitted on a daily basis to the KO and COR.

This ensures streamlined communications between the contractor and the KO.

1.7.7 Identification of Contractor Employees: The contractor shall be responsible for furnishing an identification badge to all personnel (contractor and sub-contractors) prior to the employee working on-site. The contractor shall be responsible to ensure each employee engaged in the work displays identification. Identification shall consist of badges that include the name of the contractor or subcontractor identification of working on this contract (i.e. contract number), and the employee's name. At a minimum, a valid state driver's license or other Government-issued photo identification card is required for positive identification. All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.7.8 Business Relations: The contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The contractor shall manage the timeliness, completeness, and quality of problem identification.

The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.

1.7.9 Personnel Administration: The contractor shall provide the management and support for its personnel in order to meet the PWS requirements. This includes training, travel arrangements, equipment supply, time keeping, leave processing, pay, emergency needs, and any other required administrative need arising.

1.7.10 Contract Management: The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor must maintain continuity between the support operations at the emergency debris removal site and the contractor's corporate offices.

1.7.11 Contract Administration: The contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The contractor shall respond to Government requests for contractual actions in a timely fashion. The contractor shall have a single POC between the Government and contractor personnel assigned to support contracts or task orders. The contractor shall assign work effort and maintain proper and accurate time keeping records of personnel assigned to work on the requirement.

1.7.12 Contractor Travel: Travel costs shall be included in the existing schedule of prices. Travel will not be reimbursed as a separate cost.

1.7.13 Subcontract Management: The contractor shall provide to the KO a current and comprehensive list of all subcontractors at each tier below the prime with updated lists as conditions change.
