About this file
This is a letter from the Washington State Department of Archaeology & Historic Preservation (DAHP) to the US Army Corps of Engineers - Walla Walla District regarding Section 106 compliance for the Mill Creek Diversion Dam Fishway Construction project. The letter, dated May 12, 2022, provides DAHP's concurrence of "NO ADVERSE EFFECT" on historic properties within the Area of Potential Effect (APE) that are listed in or eligible for the National Register of Historic Places.
The letter stipulates that the Corps must complete a revised determination of eligibility for the Mill Creek Flood Control Project, as DAHP standards require reassessment of eligibility when survey data is over ten years old or when new information becomes available. The Corps must create Historic Property Inventory Forms for each resource and compile a comprehensive report, to be completed by a qualified cultural resource professional. The letter also requires that if archaeological resources are discovered during construction, work must halt immediately and both Native American Tribes and DAHP must be consulted.

Project Tracking Code: 2022-04-02495 Property: Mill Creek Diversion Dam Fishway Construction 106 Compliance Re: NO Adverse Effect
Dear Scott Hall:
Thank you for contacting the State Historic Preservation Officer (SHPO) and Department of Archaeology and Historic Preservation (DAHP) regarding the above referenced proposal. This action has been reviewed on behalf of the SHPO under provisions of Section 106 of the National Historic Preservation Act of 1966 (as amended) and 36 CFR Part 800. Our review is based upon documentation contained in your communication.
We concur that the current project as proposed will have "NO ADVERSE EFFECT" on historic properties within the APE that are listed in, or determined eligible for listing in, the National Register of Historic Places, with the understanding that the Corps will complete a revised determination of eligibility for the Mill Creek Flood Control Project. As we noted previously, it is standard practice in Washington State, per DAHP’s Standards for Cultural Resource Reporting, that determinations of eligibility be revisited once the survey data is over ten years, or when new information becomes available. The new determination of eligibility effort must meet DAHP’s Standards, which includes the creation of individual Historic Property Inventory Forms for each resource that either contributes or does not contribute to the potential historic district. The summary of this effort must be compiled into a report that includes a discussion of the potential historic district as a whole, as well. We highly encourage the Corps ensure this survey, inventory, and report are all completed by a cultural resource professional meeting the Secretary of the Interior’s Professional Qualification Standards in Architectural History.
As a result of our concurrence, further contact with DAHP on this proposal is not necessary. However, if new information about affected resources becomes available and/or the project scope of work changes significantly, please resume consultation as our assessment may be revised. Also, if any archaeological resources are uncovered during construction, please halt work immediately in the area of discovery and contact the appropriate Native American Tribes and DAHP for further consultation.
Thank you for the opportunity to review and comment. Please ensure that the DAHP Project Number (a.k.a. Project Tracking Code) is shared with any hired cultural resource consultants and is attached to any communications or submitted reports. If you have any questions, please feel free to contact me.
Sincerely, State of Washington • Department of Archaeology & Historic Preservation
