FOR OFFICIAL USE ONLY - IAW FAR 3.104

Justification and Approval For

Other Than Full and Open Competition

Authority: FAR 13.501 Estimate amount:

1. CONTRACTING ACTIVITY: United States Army Corps of Engineers, Engineering and Support Center (CEHNC),

2. DESCRIPTION OF ACTION: To require brand- name Speed Queen Dryers, Sealy Cardiff Mattresses and Boxsprings, Summit Appliance Under-Counter Refrigerators.

The requirement for these items (listed below) for the Army Lodging Pacific Region FY17 project will be incorporated via the Request for Quote (RFQ)W912DY-17-T-0241.

I. Dryers o Speed Queen dryers Model SSEMNAGS303NW01

II. Mattresses and Boxsprings o Sealy Cardiff

III. Under-Counter Refrigerators o Summit Appliance FF433ESADA 3.6 CF Under-Counter Refrigerator

3. DESCRIPTION OF SUPPLIES OR SERVICES: The purpose of this portion of a larger order is to purchase and install brand-name dryers, mattresses and boxsprings, and under counter refrigerators that meet Customer Requirements valued at approximately as part of the overall Lodging Procurement requirement for the FY17 Lodging Pacific Region Project.

4. AUTHORITY CITED: 41 U.S.C 1901 as implemented in FAR 13.106-1(b), Items Peculiar to One Manufacturer (Brand-Name).

5. REASON FOR AUTHORITY CITED:

It is in the best interest of the Government to issue a solicitation to require dryers, mattresses and boxsprings, and under-counter refrigerators because only these items will meet the Customer Requirements. The Market Research done by HNC shows that there is only one manufacturer that can meet all of the specifications for the dryers, mattresses and boxsprings, and under-counter refrigerator specs in the FY17 Lodging Pacific Region Procurement. The specs that only (1) manufacturer can meet are as follows:

I. Dryers

1) These are the Specs that only (1) dryer manufacturer can meet:

The facility requesting this item has 230 Volts / 50 Hz / 1 with (2) 30 amp circuits electrical building power

2) This is why this is the requirement for the dryers:

Speed Queen, Model: SSEMNAGS303NW01 is the only stack dryer that can be found compatible with the electrical power service for the facility requiring this item.

Other commercial manufacturers have been researched such as Maytag, LG, Whirlpool that have the 220V power compatibility but do not have 230 Volts / 50 Hz / 1 with (2) 30 amp circuits Contractors that specialize in export appliance do not have other models that meet these power requirements.

II. Mattresses & Boxsprings

1) These are the Specs that only (1) mattress and boxspring manufacturer can meet:

Height Requirement: 11” high mattress; 9” high foundation Firmness and Coil count (applies to mattress only): Firm, 638 density minimum coil count

2) This is why this is the requirement for the mattresses and boxsprings:

The height of the mattresses and foundations is critical because The Customer has existing mattress and foundation encasements into which the new mattresses and foundations must be able to fit.

The Customer requires a firm mattress with a minimum 638 density coil count.

The most comparable product made by Simmons that meets the height requirements provides a coil density of 460, but is only available in plush. The most comparable product made by Serta is available in firm, but it only provides a coil density of 532.

III. Under-Counter Refrigerators

1) These are the Specs that only (1) refrigerator manufacturer can meet:

Dimension Requirements: 18.75”W x 20.25” x D32”H enables the unit to fit within the existing opening.

ADA Compliance: Height shall be 32”H to fit under ADA compliant counters Color: Shall have black exterior

2) This is why this is the requirement for the refrigerators:

The dimensions of the refrigerator is critical because the customer has existing cabinetry into which the new refrigerator must be able to fit.

The exterior finish is essential to match the adjacent appliance installed in the existing cabinetry.

6. EFFORTS TO OBTAIN COMPETITION: The solicitation will be posted as full and open to FedBizOpps (FBO) for a total of thirty (30) days with the requirement for the require dryers, mattresses and boxsprings, and under-counter refrigerators to be brand-name. The Furniture Program attempted to get competition on these portions of the order, but the reasons stated in Market Research below limit adequate competition. An effort was made to determine if the requirements could be loosened to facilitate more competition, but the specifications required are considered necessary, valid, and not able to be changed.

7. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.

The Government will use price analysis techniques in FAR 15.404-1(b)(2) to ensure a fair and reasonable price is achieved.

8. Market Research: CEHNC conducts market research appropriate to the circumstances by consulting with professionals in the furniture market and relying upon interior design experts who have kept up to date with recent market trends and available products of manufacturers and distributors of furniture that will meet the Army’s specifications. HNC conducted market research after evaluating the requirements from the customer. See the details by-item type below which led to the conclusion that only (1) manufacturer can meet all the requirements in the FID (see details outlined in Para. 5, section 1 and 2 above).

I. Dryers

Other commercial dryer manufacturers have been researched such as Maytag, LG, Whirlpool that have the 220V power compatibility but do not have 230 Volts / 50 Hz / 1 with (2) 30 amp circuits.

Contractors that specialize in export appliance do not have other dryer models that meet these power requirements.

II. Mattresses and Boxsprings

HNC originally considered (3) mattress and foundation manufacturers (after thoroughly researching approximately (8) or (9) manufacturers in FY16). After doing additional market research considering Sealy, Serta and Simmons we realized that only (1) manufacturer can meet all the requirements of the specs (see details outlined in Section 4 #2 above). Simmons has a mattress that is 11”h, but the coil count and density requirements. Serta has a mattress that will meet the height requirement, but it doesn’t meet the coil count requirement.

III. Under-Counter Refrigerators

Other under-counter refrigerator manufacturers have been researched such as Accucold, Frigidaire, Marvel. Resellers such as AJ Madison and Export220V.com were also researched. None of them had an under-counter refrigerator that was the required size in the required black exterior cabinet finish.

9. OTHER FACTS: N/A

10. INTERESTED SOURCES: The initial solicitation for this requirement will be posted to FBO on 28 July 2017 with quotes due on 28 Aug 2017, an initial solicitation response time of thirty days. As much time as possible was allowed during the solicitation response time for receipt of quotes to accommodate competition.

11. ACTIONS TO INCREASE COMPETITION: In this case we are only limiting competition with respect to the dryers, mattresses and boxsprings, and under-counter refrigerators. The remaining requirements are being competed full and open through FBO. In order to overcome barriers to future competition, we will continue to procure all forms of agency supplies and services using competitive procurement procedures at every possible opportunity.
