EXECUTIVE SUMMARY

1. The objective of this performance based Single Award Task Order Contract (SATOC) is for the Contractor to perform Military Munitions Response Program (MMRP) services involving conventional munitions and Other

Munitions Related Services (OMRS) including range maintenance and support activities utilizing robotic technology and/or conventional manned technologies as necessary to permit lands to be safely and efficiently used for their intended purpose or to facilitate construction efforts. This work also may involve the removal/ disposal of hazardous, toxic, and radioactive waste (HTRW).

2. Work under this contract may occur at sites located in the lands of the Contiguous United States and possible sites in Alaska, Hawaii, and US Territories. The Contracting Officer shall make a scope determination for locations that may fall outside the United States and its territories at the task order level. Individual task orders to be issued under this contract are for services as defined by FAR 37.101 and are subject to the Service Contract Act (See FAR

52.222-41).

3. In accordance with (IAW) FAR Part 15, the Government is awarding an Indefinite Delivery Indefinite Quantity

(IDIQ) - Single Award Task Order Contract (SATOC) with Firm Fixed Price (FFP) and Cost Plus Fixed Fee (CPFF) provisions. The estimated maximum dollar value of this effort is $40 million. This requirement will be 100% small business set-aside. The minimum guaranteed order shall be $2,500 for the base period only. The specific task order contract types will be determined IAW FAR Subpart 16.1. The fixed fee for CPFF task orders will be established at the task order level.

4. The ordering period shall commence upon the date of award and may continue for a period of performance of one

(1) 12-month base period and three (3) 12-month option periods, for a total of 48 months if all options are exercised.

The contract will include the option to extend services IAW FAR 52.217-8, Option to Extend Services. Labor rates may be escalated annually at the beginning of each option period (See FAR 52.222-43 (b) for limitations) as provided in the Schedule; however, the labor rates in effect at the time an effort is awarded will remain in effect through completion of the awarded effort, unless modified due to an increase in the Department of Labor wage rates in accordance with FAR 52.222-43, FAR 52.222-44, and Chapter 7 of Engineer Pamphlet 1180-1-1.

5. Evaluation of Options: IAW FAR Subpart 17.1, the Contracting Officer has made the required determination that the inclusion of options is in the Government’s interest; and, that it is anticipated that the Government may exercise the option at time of award IAW FAR 52.217-9. IAW FAR 17.203(b), the Contracting Officer shall evaluate the price of the options as part of the source selection. If services are required past the period of performance and the option IAW 52.217-8 is exercised the current binding rate for the period in which the option is being exercised shall be applicable, as these rates will have been evaluated at time of source selection and prior to contract award -escalation or negotiation of rates are not authorized.

If options are exercised at the task order level at any time, evaluation of the maximum binding rates and pricing will be per the Task Order PWS.

6. The negotiated FFP hourly labor rates contained in Section J shall be binding maximum rates for the FFP effort;

and, the negotiated Cost hourly labor rates contained in Section J shall be binding maximum rates for the Cost effort.

If a cost reimbursable CLIN is used at the task order level, the Government will conduct an analysis of the

Contractor’s proposed cost elements to evaluate fairness, reasonableness and cost realism.

7. When the Request for Proposal (RFP) for task order requirements are issued, relevant and competent data supporting proposed labor rates, indirect rates, labor categories, labor hours, materials, equipment, and travel may be required to be provided by the Contractor to allow an examination of the proposed cost elements and/or prices as required by each task order.

8. The Government has the unilateral right to move unused capacity between the Contract Line Item Numbers

(CLINs) to include subsequent option year CLINs, as the need develops during contract performance.

9. Profit will be negotiated, as needed, for each task order. Profit and Fee will be determined and/or evaluated in accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 215.404-4. The only authorized ordering office is the U.S. Army Engineering and Support Center, Huntsville (CEHNC), unless otherwise designated as a result of a task order transfer to another USACE office for contract administration.

Contractor will contact the responsible Contracting Officer and the appropriate point of contact in their Work Plan

(WP)/Accident Prevention Plan (APP). The Contractor shall secure the area and provide two personnel to secure the site until relieved by the Department of the Army emergency response personnel. Additional support may be required by the emergency response personnel, e.g., construction of blast mitigation controls.

2.8 Performance-Based Milestones/Objectives: The Government defines Performance Based Milestones/Objectives as the desired outcome(s) that have been defined in the Performance Work Statement in clear, simple, concise, results-oriented, measurable and legally enforceable terms. The Government defines the completion of a

Performance Based Milestone/Objective as: an outcome that has been 100% completed and approved and accepted by the approval authority under the Task Order/Contract. Simply meeting the Milestone/Objective, (i.e., submittal of a document for review) is not the same as completion of the Milestone/Objective, (i.e., approval and acceptance of the document by the regulators). Only upon the completion, approval, and acceptance will the Government pay for that Milestone/Objective.

2.9 Protection of Classified and/or Sensitive Materials. All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

3.0 SPECIFIC SERVICES.

3.1 Initial and Follow-on Equipment Acquisition and Configuration. Because of the relative newness of employing robotic techniques to perform MMRP services and conduct OMRS one of the initial contract requirements will be for the Contractor to procure and configure as necessary equipment including, but not limited to robotic equipment to complete the objectives described herein and in subsequent task orders. The Government prefers robotic equipment that minimizes capital cost utilizing commercially available off-the-shelf components and technology to the greatest extent practical and economically advantageous. Additionally, it is envisioned that with Contracting

Officer approval, the acquisition and configuration of long term leased equipment to augment GFP inventories would be supported under this contract and subsequent task order(s). It is envisioned that Contractor cost incurred for short term equipment rentals would be included in Contractor prices for work of specific projects as project requirements dictate. All acquired robotics equipment should employ industry standard robotics safety features (to be specified as a task order requirement). In any event the Contractor is not precluded from using rented or leased equipment or from using Contractor owned equipment in lieu of, or to augment GFP to provide services and meet contract/task order objectives.

3.2 Storage, Maintenance and Transportation of Government Furnished Property. The Contractor shall store, maintain (i.e., perform preventative and corrective maintenance) and transport as necessary all GFP including robotics equipment acquired under this Contract and as described by subsequent task orders.

3.3 Corporate UFP-QAPP and Corporate Accident Prevention Plan. The Contractor shall prepare and maintain a

Corporate UFP-QAPP approved by the Contracting Officer that addresses all of the typical conventional MEC and

This Corporate UFP-QAPP will be structured IAW Data Item Description (DID) HNC-001.02, EM 200-1-15; EM 385-1-1; EM 385-1-97 including Errata Sheets and Changes; Intergovernmental Data Quality Task Force Uniform Federal Policy (UFP)-

QAPP Manual: and other Interim Guidance and DIDs as appropriate. The Corporate UFP-QAPP shall additionally include as an appendix a Corporate Geophysical Investigation Plan prepared generally IAW DID HNC-003.02. The

Corporate UFP-QAPP/QAPP shall also include as an appendix a Corporate Property Management Plan (PMP) which prepared IAW FAR 52.245-1 shall address Government Furnished Property (GFP) issuance and Contractor acquisition of Contractor Acquired Property (CAP). The Contractor shall prepare and maintain a Corporate

Accident Prevention Plan (APP) in accordance with EM 200-1-15. The Corporate APP shall be approved by the

Contracting Officer and shall address all the typical hazards associated with conventional MEC and MPPEH related operations that may be encountered during work within the 50 States. Site Specific UFP-QAPP and APP addenda designed to complement the Corporate UFP-QAPP and APP will normally be required for each individual work location. It is envisioned, however, that for some projects sufficient site/project information may be known which would permit the submission of such project/site specific UFP-QAPP and APP information as part of the

Contractor’s Task Order proposal with Task Order award constituting acceptance of the UFP-QAPP and APP addenda. However, for projects identified by the Government as requiring a rapid response, and/or projects which require a Contractor conducted initial site assessment to facilitate proposal preparation, submission of these addenda with the Contractor’s proposal may not be necessary, but rather would be made available on-site by the Contractor, and shall be subject to quality assurance (QA) review and ultimate acceptance. Additionally, it is envisioned that collectively, the Corporate APP and Contractor prepared addenda for the project site of concern would contain information (as well as additional information) which normally would be submitted as a separate Abbreviated Site

Safety and Health Plan (ASSHP) thus permitting site assessment and other Contractor conducted site activities.

3.4 Task Orders. Task orders issued under this Contract may be Firm-Fixed Price, and/or Cost Plus Fixed Fee incorporating Service Contract Act wages, as applicable, depending on the type of work being performed in each individual task order. Task orders under this Contract may include, but not be limited to project planning;

assessments; inspections; surveys; geophysical investigations; studies; cost analyses; preparation of UFP-

QAPP/APP addenda; and preparation of Explosive Safety Submissions (ESS) and Explosives Siting Plans (ESP);

public involvement; remedial actions; recovery, storage, and disposal of MPPEH, MEC, MD and RRD; data management; training; permitting; and logistical support. In addition, OMRS work may also include vegetation
