The following have been modified:
PROPOSAL SUBMISSION
A. PROPOSAL SUBMISSIONS (SECTION 00 21 16)
For clarity, the addressed section shall reference the Solicitation. The identified sections are in accordance with (IAW) the Construction Specifications Institute (CSI) pursuant to the U.S.
Army Corps of Engineers Desk Guide (UDG) 5114.201-1.
Section 00 21 16 of the Solicitation (Request for Proposal (RFP)) contains the proposal submission instructions. Section 00 21 16 includes specific information on what must be furnished with the offer and identifies evaluation criteria that will be used in evaluating proposals received. Section 00 22 16 contains the basis of award and evaluation methods/ratings.
1. INTRODUCTION
1.1. The Solicitation is an unrestricted full and open competitive acquisition using the
Federal Acquisition Regulation (FAR) Part 36, Construction and Architect- Engineer Contracts, and FAR 15.101-1, Tradeoff Source Selection Process (i.e., Best Value Tradeoff). One solicitation will be issued for the acquisition consisting of a Request for Proposal (RFP) pursuant to FAR 15.101-2 best-value tradeoff (BVTO) source selection process to award an Integrated Design and Construction (IDaC) contract.
1.2. Pursuant to Defense Federal Acquisition Regulation Supplement (DFARS)
236.204, the magnitude of construction is over $500 million.
1.3. The primary North American Industry Classification System (NAICS) code for the acquisition is 237990 – Other Heavy and Civil Engineering Construction.
Small Business Size Standard of $45 million.
1.4. Selection will be made based on the responsible Offeror whose proposal conforms to the Solicitation requirements, demonstrating high technical capability and low risk, presenting the most advantageous offer to the Government. The Government reserves the right to accept other than the lowest-priced offer or to reject all proposals.
1.5. The Government shall not reimburse any cost incurred or associated with preparing and submitting any responses to the Solicitation. Oral explanations or instructions to Offerors are not binding. Any information given to an Offeror which impacts the Solicitation and/or offers will be provided in the form of a written amendment to the Solicitation. It is the Offeror’s responsibility to acknowledge all amendments in its proposal submission.
1.6. The Offeror shall not modify the terms and conditions of the Solicitation in their technical proposals or add conditions or qualifications to their offers. If an Offeror include terms and conditions that conflict with the terms and conditions of the Solicitation, the Offeror may be determined ineligible for award. Any questions related to specific terms and conditions contained within the Solicitation should be resolved prior to the submission of an offer.
1.7. All proposals received will be considered complete and final. The evaluation board will not consider any information or data incorporated by reference or referred to other sources outside the respective proposal volumes and factors responses. The successful Offeror will be selected solely based on the stated evaluation factors. Accordingly, proposals submitted in response to the Solicitation should provide clear, complete, concise, and straightforward responses to the evaluation factors. Elaborate proposals, color brochures, and other excesses are discouraged.
1.8. Proposals that reiterate “Parroting” the contents of the Solicitation, or contain only superficial responses, may be considered unacceptable. Evidence of experience, capability, and qualifications demonstrating and supporting the Offeror’s claims is essential. The absence of such evidence will adversely influence the evaluation of the proposal.
1.9. References to “confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the Offeror’s technical proposal.
The Offeror including confidential information in its proposal that they do not want to be disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall clearly mark their proposals IAW the instructions at FAR Clause 52.215-1, Instructions to Offerors –Competitive Acquisition, paragraph (e), Restriction on disclosure and use of data.
1.10. Use of the words “shall” or “must” indicate a mandatory requirement for which failure to comply at the time and date for submission of proposals may result in the Offeror’s proposal being disqualified from consideration for the award, or a deficiency or weakness being assessed for the factor. Failure to comply with non-pricing or pricing requirements annotated with the words “should” or “may” can result in an unacceptable rating, affecting the Offeror being selected for the contract award. The Government may elect during discussions with Offerors, to provide a means by which appropriate corrections by the Offeror(s) can be made.

Offerors shall submit an offer subject to Project Labor Agreement (PLA) requirements IAW FAR 22.504, General requirements for project labor agreements. Any PLA reached pursuant to the PLA requirements in the solicitation does not change the terms of the contract or provide for any price adjustment by the Government.
2. E-BUSINESS REGISTRATION REQUIREMENTS
2.1. System for Award Management (SAM). The Offeror shall be registered in SAM at the time an offer is submitted. Failure to have an active and completed registration in SAM [https://sam.gov/] may determine an Offeror ineligible for the award and removed from the competition. In such instances, the Government will award to the next successful Offeror who is eligible for the award. Information contained within an Offeror’s registration shall be current and valid. The responsibility of maintaining current information contained in an Offeror’s registration rests solely on the Offeror.

2.5. Pre-Proposal Conference/Site Visit. A formal site visit will be conducted. The Offerors are encouraged to visit the site prior to submitting a proposal.
2.6. Late Proposals. Any proposals, amendments, or revision received by the
Government after the exact time specified for receipt offers is “late” and will not be considered unless it is received before award is made, the KO determines that accepting the late offer would not unduly delay the acquisition, and 1) if it was transmitted through an electronic commerce method authorized by the Solicitation, and it was received at the initial point of entry to the Government infrastructure no later than 4:00 PM (Pacific Standard Time), one calendar day prior to the date specified for receipt of proposals; or 2) there is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or 3) it is the only proposal received. However, a late amendment of an otherwise successful proposal that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
2.7. Joint Venture. A joint venture (JV) is defined as a legal business entity formed between two or more companies to undertake the performance activities of a contract together. The Offerors proposing as JV shall provide evidence that the JV as a legal entity has been duly formed. The JV shall include a copy of the legal JV agreement signed by an authorized officer from each of the firms comprising the JV, with the Chief Executive of each entity identified. The Government will not evaluate the capability of any firms that are not included in the JV agreement. If submitting a proposal as a JV, the experience of each of the JV partners can be submitted for the JV entity. The experience of either JV partner will be considered the experience of the JV entity. Prospective Offerors that submit proposals may not change their JV firms, if selected for award. If an Offeror is a JV, the JV entity shall have a valid registration representing the JV as one business/firm/entity in SAM. The Government will not accept separate registrations and licenses from each separate entity representing the JV.
2.8. Subcontractor Substitutions. Approval will not be given unless the KO considers the proposed substitute equal or better in all respects to the originally proposed subcontractor and that the substitution is in the Government’s best interests. If the Offeror’s proposal includes the use of subcontractors, the Offeror may only change subcontractors with the KO approval. If the Offeror proposes to change subcontractors after award, the Offeror may not change subcontractors or Letter of Commitment (LOC) without the KO’s approval.
2.9. Unsuccessful Offerors will be notified IAW FAR Subpart 15.5. An unsuccessful offeror may request a pre-award debriefing or a delayed debriefing after award (post-award debriefing) by submitting a written request to the KO within three-calendar days after receipt of the notice excluding an offeror from the competition and award. The Offerors are entitled to no more than one debriefing for each proposal (e.g., pre- or post-award debriefing).
3. PROPOSAL VOLUME INSTRUCTIONS, REQUIREMENTS, CONTENTS, AND
FORMAT
INSTRUCTIONS TO OFFERORS
3.1. Content – General.
An Offeror’s proposal without the minimum content may be determined ineligible for award and removed from the competition. The Government may reject incomplete proposals after initial evaluation without further consideration.
All information intended to be evaluated as part of the technical proposal shall be submitted within the technical proposal. Do not include references to material or information not found within its respective volumes. Information submitted in the wrong volumes could lead to an Offeror’s proposal being determined unacceptable if materially incomplete in any aspect.

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner.
A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating.
Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
ADJECTIVAL RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.
There should have been NO significant weaknesses identified.
Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory
Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable
No information or did not apply to your contract
Rating will be neither positive nor negative.

ATTACHMENT C – SMALL BUSINESS COMMITMENT DOCUMENT
Other than small businesses (OTSB) Offerors are required to complete a Small Business Commitment Document (SBCD). The Offeror shall propose the level of commitment of SB concerns (e.g., Small Disadvantaged Business (SDB) (including ANCs and Indian Tribes), Service-Disabled Veteran-Owned SB (SDVOSB), Woman- Owned SB (WOSB), or Historically Underutilized Business Zone (HUBZone) in the performance of the acquisition relative to the objectives/goals set-forth in the evaluation of this factor.
A Minimum Quantitative Requirement (MQR) total small business commitment of 10% of the total contract (dollar) value is assigned to the acquisition for Small Business, as well as suggested minimums of % for SDB, % for SDVOSB, % for WOSB and % for HUBZone. The MQR must be met for the offeror to be eligible for award.
1. Indicate the total contract percentage of work based on total contract dollars of the acquisition to be performed by both large and SB (include the percentage of work to be performed by both the prime and subcontractors):
For example: If the Prime proposes a price of $1,000,000 (including all options), and SB will provide $250,000 in supplies/services as a prime or subcontractor, the %-age planed for SB is 25%; and 75% for large business equating to 100%.
Total percentage planned for Large Subcontractor(s) %
Total percentage planned to be self-performed by Prime
Total percentage planned for Small Business(es) %
Total: 100%
2. Indicate the total combined percentage of work based on total contract dollars of the acquisition to be performed by each SB concerns. The percentage of work performed by SB that qualify in multiple SB concerns should be counted in each status.
For example: Subcontractor A (SDVOSB, and WOSB) performing 2%; and Subcontractor B (a SDB, HUBZone, and WOSB) performing 3%. The results will equate to SB 5%, SDB 3%, HUBZone 3%, WOSB 5%, and SDVOSB 2%).
Small Disadvantaged Business (SDB) (including ANCs and Indian Tribes) (8% suggested goal)
Service-Disabled Veteran-Owned SB (SDVOSB) ( 2 % suggested goal)
Woman-Owned SB (WOSB) (4% suggested goal) % Historically Underutilized Business Zone (HUBZone) (2% suggested goal)
3. Identify the Prime Offeror and type of supply/service that the Prime will provide. Then list each of the intended SB concern subcontract and principal supply/services to be provided by the SB concern. Information provided is to be based on supply / services known at time of proposal. Provide the Unique Entity Identifier and/or Commercial and Government Entity (CAGE) code for the Prime and each intended subcontractor. Also, provide the anticipated North American Industry Classification System (NAICS) code(s) that the Prime believes best describes the supply/service being acquired by the subcontracts with each intended subcontractor. SB subcontractors that qualify in multiple SB concern(s), as previously mentioned, should be listed in each applicable SB category.
Example: If a SB concern qualifies as a WOSB and a SDVOSB, the Offeror can add them to each category, below, in which they qualify.
1. Prime Offeror:
Name of Company Identified (include UEI and/or CAGE Code)
Type of Supply/Services (include NAICS Code for Subcontractor)
Note, adjust/modify format for information box, if applicable.
2. SB Concerns
3. SDB Concerns (including ANCs and Indian Tribes)
4. WOSB Concerns
5. HUBZone Concerns
6. SDVOSB Concerns
Note: Pursuant to the Small Business Act, Section 8(d), a business is considered small for Government procurement if it does not exceed the size standard for the NAICS code that the prime contractor believes best describes supply/service being acquired. In other words, the size of the prime’s supplier is determined by the applicable NAICS code of their joint-venture, teaming, partnership, or subcontract, which may or may not be the same NAICS code as the one for the prime contract with the Government.
4. Describe the extent of commitment to use SB concerns (e.g., what types of commitments and of what duration, if any, are in place for this specific acquisition
- either SB prime, written contract, verbal, enforceable, non-enforceable, joint-venturing, mentor-protégé, etc.).
5. When the type of commitment noted is a written commitment, provide copies of written commitment agreements.

EVALUATION CRITERIA
SUPPLEMENTARY PROPOSAL SUBMISSIONS (SECTION 00 22 16)
BASIS OF AWARD
1. EVALUATION PROCESS
The Government intends to conduct discussions as part of its evaluation of Offerors’ proposals IAW DFARS 215.306.
1.1. Compliance with Terms and Conditions. The Offerors are cautioned to submit sufficient information in the format specified in the proposal preparation instructions. Failure to comply with the terms and conditions of the Solicitation may result in the Offeror being removed from consideration for award. The proposal will be evaluated to determine whether the Offeror’s proposal adequately and completely considered, defined, and satisfied the requirements as specified in the Solicitation. The proposal will be evaluated to determine whether each requirement has been sufficiently addressed in the proposal IAW the proposal submission section of the Solicitation. The SSEB must not assume that an Offeror’s performance includes the requirements of the Solicitation that are not specified in the Offeror’s proposal.
1.2. Adequacy of Response. The Offeror’s proposal will be evaluated to determine whether the proposal adequately and completely considered, defined, and satisfied the requirements as specified in the Solicitation.
1.3. Rejection of Proposals. The Government may reject any proposal that is evaluated and determined to be unacceptable or fails to comply with the Solicitation terms and conditions.
1.4. The Offeror’s proposal shall meet the criteria stated in the Solicitation in order to be eligible for award, to include responsibility, and technical acceptability.
1.5. Discussions. The Government reserves the right to allow proposal revisions during discussions. The SSA will include only those firms determined to be the most highly rated; those whose proposals are reasonably susceptible to being made acceptable; but not those that are so deficient as to essentially require major revisions or a total re-write of their proposal. In certain circumstances, the Government may limit Offers in the competitive range to a number that will permit an efficient competition. The SSEB will follow the evaluation process herein until discussions are closed. Upon the conclusion of discussions, those Offerors still within the competitive range will be afforded an opportunity to revise their proposals and submit a Final Proposal Revision (FPR) for evaluation.
The Offerors are required to submit their responses to comments electronically and detailed instructions on responses will be provided. Electronic submissions shall meet the submission deadline set forth by the Government during discussions or indicated in the Amendment requesting the FPR. The KO will notify all the Offerors in the competitive range, in writing, how and when interim revisions and FPR are to be submitted.
1.6. Selection Process. The Solicitation contains certain mandatory or minimum requirements to be met for evaluation. The Solicitation also contains within the described factors certain documents for submission. Failure to satisfy any mandatory or minimum requirement may result in a determination that an offer is unacceptable. (A final determination that an offer is unacceptable means that an award to the Offeror involved cannot be made.)
All of the submission items to be evaluated pertain to the Prime Offeror, whether a single contractor entity, partnership, or a JV. The Government will consider information provided concerning primary subcontractors (those performing the likelihood that the proposed subcontractor will be available for the Solicitation project), then that submitted information will largely be diminished in the evaluation and selection process. At the same time, an Offeror that intends to have a significant on-site subcontractor participation (20% or more of the total on-site management and construction efforts) should provide information pertaining to those subcontractors IAW the Solicitation, Section 00 21 16.
1.7 Project Labor Agreements (PLA): All Offerors are required to submit a complete and signed Project Labor Agreement (PLA) for evaluation by the Contracting Officer. Any PLA submitted with the offer must comply with the requirements of FAR Provision 52.222-33. (A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f)).
2. EVALUATION FACTORS FOR AWARD AND METHODOLOGY
The SSEB composed of the USACE personnel and as necessary, technical advisors will conduct the evaluation.
