About this file

This is Amendment No. 0002 to Solicitation W912DS26BA022, issued by the U.S. Army Corps of Engineers (USACE), New York District, on July 20, 2026. The amendment addresses bidder questions and revises the bid schedule for a dredging and beach placement project at Fire Island Inlet and Gilgo Beach, New York.

The amendment clarifies the scope of work across two contract line items (CLINs): CLIN 0002 covers Area 1 dredging operations (removal of material to -14 feet below mean lower low water plus 2 feet allowable overdepth) with placement of 800,000 cubic yards (CY) of dredged sand along Gilgo Beach (Survey Stations 0+00 to 180+75) within 56 calendar days, while CLIN 0003 covers Area 2 dredging with placement of 700,000 CY of dredged sand within 49 calendar days. Key operational windows are defined by the New York State Department of Environmental Conservation Permit No. 1-4799-00134, Modification 1: Area 1 dredging is permitted September 21 through November 30, 2026, and Area 2 dredging is permitted December 1, 2026, through March 31, 2027. Additional clarifications address survey requirements (must be conducted by New York licensed surveyors and certified hydrographers), Red Knot environmental monitoring (required at least 7 days prior to dredging), monthly progress payments based on before-and-after fill surveys submitted in 500-foot sections, and warranty of construction coverage under FAR 52.246-21 (covering the final accepted product, with post-acceptance erosion or weather changes governed by the changes clause). Bidders must acknowledge receipt of this amendment by the solicitation deadline or face rejection.

Miscellaneous text in this section has been modified to:

BIDDER'S QUESTIONS AND GOVERNMENT REPLY

The following questions and answers are provided for information only. Nothing contained below amends or revises any provision of the solicitation. This is for bidder's reference only, and is not to be considered as a part of the Contract Documents. Contract award will be based on what is contained in the printed Plans and Specifications in a hard copy format or Electronic Bid Set if provided and as posted on SAM.Gov.

Q1. A2 of the RFI answers states "Area 1 material will be dredged, transported, and placed onto the Gilgo Beach and paid under CLIN Item 00002. Area 2 material will be dredged, transported, and placed onto Gilgo Beach and paid under CLIN Item 00002. See revised Bid Schedule." Please clarify if Area 2 material should fall under CLIN Item 00003.

A1. Area 2 material will be under CLIN Item 0003. See Revised Bid Schedule.

Q2. The Bid schedule was not revised to say Area 1 in the description for CLIN Item 00002 and Area 2 in the description for CLIN Item 00003. Please correct the bid schedule to reflect this.

A2. See Revised Bid Schedule.

Q3. CLIN Item 0003 description states "placement of 800,000 cy of dredge material" but the quantity in the quantity column is 700,000. Please clarify if the quantity being priced is 800,000cy or 700,000 cy.

A3. CLIN Item 0003 has a quantity of 700,000 CY. See Revised Bid Schedule.

Q4. In response to A9 of the RFI answers, per the New York State Department of Environmental Conservation, Attachment "A" - Activity Window Restriction, inside the sore thumb is allowed to be dug up until December 31st but the answer to RFI #9 says the Contractor can only dig inside until November 30th. Please explain why the contractor will not be able to dig inside sore thumb until December 31st as per the Activity Window Restriction. Limiting the inside window to an early

W912DS26BA0220002

closure which is the day before the outside window opens leaves no overlap for contractors to transition between areas, resulting in varying standby risk assumptions by contractors.

A4. "Please refer to NYSDEC Permit No. 1-4799-00134, Modification 1, dated June 5, 2026.

Under this modification, the New York State Department of Environmental Conservation (NYSDEC) authorized a temporary relocation of the demarcation line and an alleviation of the seasonal activity window restriction.

Dredging within Area 1 (north of the revised demarcation line, which includes the Inner Sore Thumb and Outer Sore Thumb) is permitted from September 21, 2026, through November 30, 2026; dredging will not be permitted in Area 1 after this date. Dredging within Area 2 (south of the revised demarcation line) is permitted from December 1, 2026, through March 31, 2027. No dredging is permitted in the Fire Island Inlet after March 31, 2027

Q5. Is dredging permitted north of the new demarcation line after November 30?

A5. No dredging is permitted in the Fire Island Inlet after March 31, 2027. Refer to Government Response A4 of this amendment.

Q6. Amendment #1 removed the requirement that all surveys conducted by the Contractor must be done by a New York licensed surveyor and certified hydrographer subjected to approval by the Contracting Officer (Section 31 24 00.00 18 Initial and Final Surveys). Please confirm a New York licensed surveyor is not required to conduct initial and final surveys.

A6. All survey conducted by the Contractor must be done by a

New York Licensed surveyor and certified hydrographer subjected to approval by the Contracting Officer. Language is included in revised specifications included in Amendment 0001. See attachment "c - W912DS26BA022 AMD 0001- SPECS.pdf".

Q7. Permit Number NAN-101-01105, dated December 7, 2021, states a Red Knot survey will be required no more than 7 days before dredging. Since dredging is anticipated to occur between September 1 and November 30, will a Red Knot survey be required?

A7. The Contractor will be required to conduct at least 7 days prior to dredging. The Contractor shall ensure continuous monitoring for Red Knots (in addition to any applicable protected species).

Q8. The specifications reference various acceptance criteria for the beach fill. There are references of 500' long sections and references of no acceptance sections. Please clarify if the beach will be accepted in sections and how many feet the acceptance sections will be.

A8. Monthly Progress Payments will be based on before and after fill surveys collected by the contractor and reviewed and approved by the Government. The Contractor shall submit data survey data broken into 500' long sections. For example, in September 2026 the Contractor filled from STA 0+00 to STA11+50, the Contactor will submit two sections: (1) STA0+00 to STA5+00 and (2) STA5+00 to STA10+50 for Government review.

Q9. FAR 52.246-21, Warranty of Construction, is incorporated into the Contract. Please confirm that this warranty does not apply to post-acceptance changes in beach fill caused by erosion, weather, or similar conditions. We ask that FAR 52.246-21 be removed from the Contract or, alternatively, revised to clarify that the warranty applies only to nonconforming work existing at the time of Government acceptance.

A9. The office of counsel wants this clause in place for the contract so it will not be removed and we cannot revise FAR clauses. The warranty of construction covers the final, accepted product.

What you are inquiring about would be covered under the changes clause.
