About this file
This is a Department of State consistency review letter regarding a permit application modification for a beach renourishment dredging project. The Town of Babylon, New York, submitted a modification to its previously approved U.S. Army Corps of Engineers permit application (F-2026-0321, previously F-2024-0269 and F-2021-0922) for an "add-on" dredging operation at Fire Island Inlet. The project involves obtaining up to 42,000 cubic yards of sand from the Fire Island Inlet – Shores Westerly project source to be pumped to the Town-owned Overlook Beach for beach renourishment at Cedar Beach in Suffolk County.
The primary modification involves an increase in the total volume of sand placement from 70,000 cubic yards to 100,000 cubic yards to reach the requested elevation, necessitated by increased sand loss during the current year. The proposed cross-sectional design remains unchanged from previous approvals, and no changes to the sand material source are proposed. The New York Department of State determined that the proposed modification would not result in coastal zone effects substantially different from those originally reviewed and meets general consistency concurrence criteria. Accordingly, further departmental review and individual consistency certification concurrence are not required. The determination is without prejudice and does not eliminate the need to obtain all other applicable licenses, permits, and authorizations required under New York State statutes. The letter was signed by David J. Newman, Supervisor of the Consistency Review Unit, on May 29, 2026, with copies sent to the U.S. Army Corps of Engineers/New York District and New York Department of Environmental Conservation Region 1.

U.S. Army Corps of Engineers/New York District Permit Application Town of Babylon Proposed “add-on” dredging at Fire Island Inlet to obtain up to 42,000 cubic yards of sand from the area identified under the ‘FIMP Contract 1’ Fire Island Inlet Dredging, to be pumped to the Town owned Overlook Beach for beach renourishment.
Atlantic Ocean, Cedar Beach, Town of Babylon, Suffolk County General Concurrence – Modification of a Previously Reviewed Activity
Dear Anthony Valentino:
The Department of State (DOS) received your proposed modification of the above-referenced activity on May 11, 2026. The DOS previously reviewed the original proposal and concurred with a consistency certification for it, or otherwise indicated it had no objection to authorization of the proposed activity.
The proposed modification involves: the volume of sand placement needed to reach the requested elevation has increased from 70,000 to 100,000 cubic yards. Proposed cross sections remain unchanged from previous approvals, but the increased volume is necessary to account for increased sand loss this year. There is no proposed change to the source of sand material, which is still the Fire Island Inlet – Shores Westerly project.
The Department of State has determined the proposed modification, would not result in coastal zone effects that would be substantially different than those originally reviewed and that the modified proposal meets the general consistency concurrence criteria. Therefore, further review by the Department of State and its concurrence with an individual consistency certification for the proposed activity are not required.
This determination is without prejudice to and does not obviate the need to obtain all other applicable licenses, permits, and other forms of authorization or approvals which may be required pursuant to existing New York State statutes.
