REVISED SPECIFICATIONS:

-Section 01 56 10.00 18 – added new paragraph 3.1.11
-Section 31 24 00.00 18 – revised last sentence
1- Specification section 01 30 00 par 1.2 was revised to state “March 2021”.
Questions and Answers:
The following questions and answers are provided for information only. Nothing contained below amends or revises any provision of the solicitation.
This is for bidder’s reference only, and is not to be considered as a part of the Contract Documents.
Contract award will be based on what is contained in the printed Plans and Specifications in a hard copy format or Electronic Bid Set if provided and as posted in the SAM.gov.
RFI SET #1:
Question 1. On drawing C-120, there is a cross hatched area, which according to note 1 we are not to “devegetate”, although the drawing shows the area to be regraded with new contour lines running through
it. This is a conflict as you cannot grade an area to the new contours without removing vegetation. How should the contractor proceed in the hatched area?
Response: Note 1 on C-120 states “Contractor must devegetate CPF 1 area that is being regraded, except approximate area that is cross hatched. This is to be coordinated with project biologist prior to construction”. This area does not have major cut/fill and actual location of area not to be devegated (cleared and grubbed) will be coordinated with project biologist. If the cross hatched area requires fill, the contractor may place fill on top of the vegetation. If the cross hatched area requires cut, the contractor may remove the vegetation while cutting.
Question 2. The xyz survey of the CPF area does not include data inside the pond. The cross sections show considerable fill going into the pond. While doing a site visit of the area, someone was standing in the pond with water to about midshin (roughly 1’ deep). The cross sections provided show up to 10’ deep or so. If there is excess fill leftover, where will the material go?
Response: Data for the pond area was used from NOAA data viewer 2020 USACE NAN Topobathy Lidar:
New Jersey and New York - https://coast.noaa.gov/dataviewer/#/lidar/search/ If there is excess fill, the elevations can be increased as long as slopes are <= 3%.
Question 3. As per Amendment 2, under revised specifications, it states “(iii) complete the entire work ready for use, before March 17, 2022. The date stated for completion must include final cleanup of premises”. Please explain why it has changed from April 1st, 2022. The environmental window for all sand placement on Gilgo, RMSP and CPFs does not start until April 1st, 2022. We request that the entire work ready for use date remains April 1st, 2022 to meet the Piping Plover and Least Turns environmental window.
Response: "Date has changed to March 17, 2022, to ensure that all work is complete and all equipment is off the beach by 31 March so there is a two week buffer before the start of the piping plover nesting season.”
Question 4. Reference: clause 52.211-12, Liquidated Damages; Question: What’s the difference between first tier and second tier? Please clarify each tier.
Response: “First tier” demurrage is based upon costs incurred in administration of the contract past the completion date. This amount does not include any liquidated damages for each day of delay that would accrue to the using service from exclusion of beneficial occupancy. The “second tier” demurrage is if the contractor fails to complete documented punchlist items after the date of beneficial occupancy.
Question 5. Reference: Section 01 56 10.00 18, Endangered Species Observers; Question: Are endangered species observers required for a cutterhead dredge?
Response: No, formal NMFS approved endangered species observers are not required for a cutterhead dredge. Please refer to paragraph 3.1.11 that was added to section 01 56 10.00 18 of the specifications for cutterhead required best management practices, including posting a bridge watch for listed species.
Question 6. Reference: Section 01 57 19, paragraph 3.1.4 reference to Villages; Question: Does the reference to “Villages” apply to this contract?
Response: Reference to “Villages” does not apply to this contract.
Question 7. Reference: Section 31 24 00.00 18, paragraph 3.2.1 and the Contract Drawings; Question:
The specification section states the 0.5 foot paid tolerance is only above elevation +3.0 NAVD; however, the drawings show the paid tolerance for the full template. How will the 0.5 foot paid tolerance be applied to the required beach fill template?
Response: Drawings are correct. Section 31 24 00.00 18, last sentence of paragraph 3.2.1 was revised to state “A tolerance of plus 0.5 foot, measured vertically, will be allowed and paid for on material placed above the required design grades.”
Question 8. Please provide the template and all xyz data for the Overlook Beach Option.
Response: Revised sheets, including template, and xyz data for Overlook Beach Option provided.
