Amendment No.3 USACE, Department of the Army, NYD Corps of Engineers New York, NY 10278-0090 AMENDMENT NO.3 for IFB NO. W912DS-15-B-0013

1. The following changes shall be made to the Plans and specifications The New York District has received questions about the contract.

2-SPECIFICATIONS:

-Section 00 73 00 1.15.1 next to last paragraph Revise paragraph as below

“When the acceptance area is found to be cleared to the required project depth elevation, it will be accepted. If work areas 1, 3, 5 and 6 are cleared to the required depth prior to the start of the environmental window they will be accepted as if they were an acceptance area. Should shoals occur within 100ft of work areas 2 and 4 after they are dredged those shoals will be removed along with any cleanup of work areas 2 and 4 at the Contractor’s expense.

Should more than two sounding or sweeping operations by the Government over an area be necessary by reason of work for the removal of shoals disclosed at a prior sounding or sweeping, the cost of such third and any subsequent sounding or sweeping operations will be charged against the Contractor at the rate of $12,500.00 per occurrence.

Surveys performed by the Government shall utilize shoalest depth for clearance and/or acceptance to the required project depth as described in Table 11-2 page 11-44 Dredge Clearance & Acceptance Surveys (Shoal/Strike detection) of EM 1110-2-1003.”

-Specification Section 35 20 23.00 18 Section is revised and issued in entirety.

-SECTION 35 20 23 05 “DREDGING AND PLACEMENT PVSC CORRIDOR”

Replace paragraph 5.1.1 in its entirety as below:

“5.1.1 Paid Dredge Tolerance To cover the inaccuracies of the dredging process, material actually removed from within the specified areas to be dredged (pay template), including paid dredge tolerance as specified below, will be estimated and paid for at the contract unit price. Paid dredge tolerance will only be paid in those areas where material exists above project grade of -50.0 ft MLW.

Paid dredge tolerance dredging will be permitted to a depth of not more than 1.5 ft Paid dredge tolerance dredging will be measured and paid for at the applicable contract price in the same manner as specified for the overlying material.”

The following questions and answers are provided for information only. Nothing contained below amends or revises any provision of the solicitation.

This is for bidder’s reference only, and is not to be considered as a part of the Contract Documents. Contract award will be based on what is contained in the printed Plans and Specifications in a hard copy format or Electronic Bid Set if provided. Questions and answers are issued to the Bidders for information only.

Q1. According to contract drawings [Drawing Sheet G-001, GENERAL NOTES (4)]:

“Soundings refer to the Plane of C.O.E. Mean Low Water. The Plane of Mean Low Water is 3.4 feet Below

NAVD88.”

A1. "C.O.E. Mean Low Water" does not equal NOAA's "MLW of epoch 1983-2001".

Q2. Permit No.2-6500-00053/00001 (Anchorage Channel, State of NY Permit) does not include a quotation that allows overflowing in NY. Can we overflow while dredging Anchorage Channel?

A2. This was addressed in amendment 2.

Q3. There is no amended NJ Permit included with the specifications. Was the NJ WQC Permit amended for the current project?

A3. NJDEP WQC applies to this specification also. Also see amendment 2.

Q4. Are we allowed to dredge Port Jersey Channel from February 1st through May 31st?

A4. See amendment 2.

Q5. If no dredging is allowed between February 1st and May 31st, does the 150 day dredging window include the environmental (no dredging) winter flounder period?

A5. The performance period includes the environmental window. See also the discussion of schedule in amendment 2, and also the meeting MFR included in amendment 2.

Q6. Are we allowed to use a TSHD (Trailing Suction Hopper Dredge) in the Port Jersey Channel?

A6. See amendment 2.

Q7. Are we allowed to dredge Anchorage Channel from February 1st through May 31st?

A7. This window was modified in amendment 2.

Q8. If no dredging is allowed between February 1st and May 31st, does the 150 day dredging window include the environmental (no dredging) winter flounder period?

A8. The performance period includes the environmental window. See also the discussion of schedule in amendment 2, and also the meeting MFR included in amendment 2.

Q9. No coordinates were provided for Hempstead Reef. Should the contractor anticipate using this area? Are we expected to dredge / transport / dispose of rock (with quantities up to over 75% of container vessel)? Are we expected to do any rock blasting?

A9. The Government does not anticipate encountering rock in this contract.

Q10. Please provide the PowerPoint presentation that was shown during the Pre-Bid Conference.

A10. This was provided in amendment 2.

Q11. Please confirm that once dredging is allowed over the north and south water siphons (Work Areas 2 and 4), the old siphons will be treated as debris, if encountered.

A11. Confirmed.

Q12. Please modify the Port Jersey Channel plan sheet C-105 to better depict the exact limits of the work to be performed under this contract (beginning and ending stations and widths, if appropriate).

A12. Updated in this amendment.

Q13. Please confirm that the portion of the Port Jersey Channel that is in this contract is not subject to any environmental windows.

A13. Confirmed.

Q14. It was mentioned that the Corps is working on obtaining a waiver allowing Work Areas 2 and 4 to be done during the Feb 1 to May 31 environmental window. Please provide a status on this request. Also, please provide the ramifications to the contract if a waiver is obtained or denied.

A14. See amendment 2

Q15. Since start of the no-dredge environmental window will occur prior to the required completion date (NTP + 150 days), how will the Corps account for the window? Will only days outside of the window count towards the 150 days allowed?

A15. The performance period includes the environmental window. See also the discussion of schedule in amendment 2, WQC and plan sheet amendments, and also the meeting MFR included in amendment 2.

Q16. Will the Corps allow box-cutting of the slopes? For clarity, it is defined in other Districts’ specifications as follows: “The material may be dredged from the original position or by "boxcut" dredging the space below the pay slope plane at the bottom of the slope for upslope material capable of falling into the cut. Payment will not be made for material in excess of the amount originally lying above the pay slope plane.”

A16. Box cutting is permitted, but the Contractor is still required to meet the slopes and dredging limits in this contract.

Q17. It was mentioned that the Corps may consider changing the overdepth language to allow overdepth material to be paid even if there is no overlying material in the required prism (above grade). As this contract has numerous locations where there is very little material above grade, we ask that the Corps change the overdepth language to pay for all overdepth material removed.

A17. See amendment 2

Q18. Please confirm that buckets will be allowed for the entire project, with the understanding that no teeth will be allowed over the utility corridors (Work Area 6).

A18. The use of buckets is are un-restricted in work areas 1-5, and 7. Permits allow the use of buckets in Port Jersey, but with restrictions. See the permits further details. When working in Port Jersey be careful of underlying utility protection in place measures. Per 35 20 23.00 18-5.3 the Contractor will prepare a plan for removing the material in Work Area 6. This plan requires various approvals. See the referenced clause for further details.

Q19. Please confirm that spuds and anchors are allowed over the entire work area, with the exception of Work Area 6 and the remaining portions of the Utility Corridors.

A19. Confirmed for the Anchorage work areas. In the PJ work area, spuds and anchors are not allowed in the PVSC 100 ft. wide corridor.

Q20. Please confirm that the steel piles to be removed from the Port Jersey Channel slope can be either removed completely or cut off below the Required Prism.

A20. Confirmed.

Q21. Does the Corps have any information that would indicate how deep the above referenced steel piles are driven?

A21. No.

Q22. Please provide a description of the debris west of Anchorage Channel to be removed under Bit Item 7. How will acceptance of the debris removal be determined?

A22. See amendment 2.

Q23. Section 00 73 00.00 18(f) of the Solicitation describes direction for Contractors in areas of encounter rock with a regard to blasting. Should the Contractor expect to encounter material within the scope of W912DS-15-B- 0013 that requires blasting? Does the Government expect the Contractor to include blasting as a potential portion of works to be executed?

A23. The Government does not anticipate encountering rock. Bidders are to determine their own means and methods.

Q24. Specification Section 35 10 00.00 18, Clause 5.2 describes Coordination with Adjacent Worksites. Could the Government describe and/or provide additional detail to the nature of adjacent worksites which will be operationally concurrent with W912DS-15-B-0013 and will require coordination?

A24. There is no Section 35 10 00.00 18. It is possible that the question means to refer to the similar 00 73 00-1.5.8, “Other Work in Area.” At this time there are no adjacent new work contracts scheduled for this area. Future maintenance contracts are a possibility.

Q25. Section 35 20 23, Clause 2.1.2 of the specification states: "Offerors are invited to examine Corps of Engineers subsurface exploration logs and to decide for themselves the character of the materials. The subsurface investigation and other reports are available for review at the New York District and some are posted in the FBO with the plans and specifications."

Please provide names of investigations and reports available for review that have not been posted to FBO under the W912DS-15-B-0013 FBO site.

A25. Several reports have not been posted, as they contain information describing a no longer existing pre-construction condition, or have their data included or otherwise superseded in subsequent reports. Also note that additional reports were posted in a prior amendment.

Q26. The Main Table of Contents within the Specification lists "35 10 00.00 18 WATER SIPHONS PROTECTIVE MEASURES AND REP AIRS" as a specification section, yet there does not appear to be a section with the specification for Section 35 10 00.00 18. Please confirm that Specification Section 35 10 00.00 18 has been removed from the Contractual Documents.

A26. Confirmed.

Q27. Section 35 20 23 23.05 (sic), Clause 2.2.1.2 of the specification describes a dredge tolerance of 1.5 feet.

Paragraph 5.1.1 of the same section states "paid dredge tolerance will be permitted to a depth of not more than 1.5 ft.

". Please confirm the dredge location for which the 1.5 feet of tolerance applies.

A27. The requirements of 35 20 23.05, as per the section title, apply to the PJ work area in Port Jersey Channel.

Q28. Please provide as-built drawings of:

Siphon 1, including information regarding any material backfilled in the vicinity of the Siphon 1.

Siphon 2, including information regarding any material backfilled in the vicinity of the Siphon 2.

Utility 1, including information regarding any material backfilled in the vicinity of the Utility 1.

Utility 2, including information regarding any material backfilled in the vicinity of the Utility 2.

Port Jersey tunnel project with respect to the final plate and gravel placement.

A28. See the data provided in Amendment 2.

Q29. Please provide detail regarding the Stapleton Area Debris (Pay Item 0007) identified on C- 101.

a. What material(s) does the USACE believe the debris is composed of?

b. How did the USACE discover the Stapleton Area Debris?

c. How many tons of debris are anticipated to be removed in this area?

d. Please specify the acceptance criteria of the debris removal.

A29. See the data provided in amendment 2 for survey information. NYPD divers dove on the obstruction this afternoon and report it to be “a pile of concrete rubble (been there a while - covered with growth) approximately 4-5 feet high, 12-15 ft. wide.” The Sandy Hook Pilots identified the high spot as a concern. The mass of the concrete is not identified. Bidders should prepare their own estimates. Payment will be by “job” as this is a small element of the contract. Acceptance criteria are added in this amendment.

Q30. On Page G-0001 of the Plans, it is stated that "existing utilities shall be protected during construction by the contractor". Please provide detail regarding required protection of existing utilities.

A30. The Contractor is expected develop their own means and methods to protect utilities and any protection-in-place measures that they have, which are appropriate to their means and methods of excavation. The Contractor is expected to not damage the utilities or their protection-in-place measures and are to take appropriate steps to ensure they are not harmed.

Q31. Section 01 35 26, Clause 3.8.2 states the Contractor is to: "physically verify underground utility locations, including utility depth, by hand digging using wood or fiberglass handled tools when any adjacent construction work is expected to come within three feet of the underground system." This language appears to be intended for land construction, does the USACE intend for the Contractor to physically verify underground utility locations, including utility depth, by hand digging using wood or fiberglass handled tools when any adjacent construction work is expected to come within three feet of the underground system with divers?

A31. No. The cited clause is intended for on land utilities.

Q32. When does the USACE anticipate to issue the Project (sic) Award?

A32. The Government desires to award as quickly as possible. Barring unanticipated delays in December.

Q33. When does the USACE anticipate to issue the Notice to Proceed?

A33. Pending bonds by the winning offeror, mid-December (ASAP).

Q34. The provided NYSDEC permits for Port Jersey and SANUC both state: "For protection of winter flounder, dredging is prohibited between February 1 and May 31 ", yet this language is not provided in the Environmental sections of the Specification (01 57 20 & 01 57 23). Please confirm that dredging is not allowed between February 1 and May 31.

A34. The window was revised in amendment 2.

Q35. Within Section 00 10 00, Pay Item 0002 (Siphon 1 & 2), it is stated that "No physical construction work on this CLIN shall be performed until directed by the ACO/COR in writing which is expected on/about 1 March 2016".

Could the USACE please provide detail regarding the specified date of March 1st 2016 regarding the anticipated start for the work associated with Pay Item 0002?

A35. NYCDEP anticipates abandoning Siphons 1 & 2 on or around 29 February 2016. Completion of the new siphon may be advanced or delayed which would result in a change in the date of the notification to the Contractor.

The contractor is not to perform any physical construction work in work areas 2 and 4 until directed in writing by the ACO/COR.

Q36. Please provide additional information regarding Port Jersey Steel Pilings (Pay Item 0006).

a. When were the pilings installed?

b. What depth were the pilings installed to?

c. What are the pilings made of?

d. Are the pilings currently exposed above existing grade?

e. What type of pilings were used and how are the pilings connected?

f. Please provide the USACE provide as-built drawings of the pilings?

g. Please specify the acceptance criteria of piling removal.

A36. Information as to the location and height above the slope of these piles was provided in amendment 2. There is no available as built information on the piles. It is possible that they are the same as nearby steel H-piles that are above the water surface, but this hasn’t been verified.

Q37. Please provide survey data (x, y, z) for the Port Jersey section of work.

A37. Included in this amendment

Q38. The Contract performance period requires completion within 150 days from Notice to Proceed. Our interpretation of the New York and New Jersey permits are that dredging is prohibited from February 1st through May 31st.

a. How will the 120 day dredge prohibition period affect the project schedule?

b. Will the 120 day dredge prohibition period count against the contract performance period?

A38. See the discussion of schedule in amendment 2, WQC and plan sheet amendments, and also the meeting MFR included in amendment 2.

Q39. Within Section 35 20 23.05, Clause 5.1.1, it appears there are some internal notes within the specification, please clarify.

A39. Clause is revised in this amendment.

Q40. Section 35 20 23.05 Clause 5.1 states that protective plates and gravel below the project prism are not to be "disturbed". Please define "disturbed".

A40. “Disturbed” in this context means physically altered or moved from its current position. If the contractor has reason to believe that the steel plates (which are protection-in-place measures for the underlying PVSC utility) current position is other than the documented “as-built” steel plate locations, the contractor is to raise this issue (and data supporting it) to the Government prior to performing any physical construction in the PJ work area.

Q41. Please provide the required dredge limits (coordinates) for digging within Port Jersey.

A41. Provided in this amendment.

Q42. On page C-102 of the provided plans, the required dredging depth for Siphon 1 and Siphon 2 is stated as "el. -52 plus 1 ft overdredge", yet Note #5 on the same page states "required dredging depth in Siphon 1 and 2 is -50 and two ft over dredge". These statements conflict, please specify the required dredge depth and the allowed over dredge depth for Siphon 1 and Siphon 2.

A42. Corrected in this amendment.

Q43. Is the contractor only going to be held responsible for removing those shoals that appear on the pre-dredge survey?

A43. No, the Contractor must achieve acceptance within the work area. A smaller work areas has been defined for Port Jersey.

Q44. If additional (new) shoals appear on the post-dredge survey and they are located outside of the contractor’s area of influence, it was conveyed at the pre-dredge meeting that those shoals would be dredged if mutually agreeable to both the Corps and the contractor. Please confirm that this is correct. Would the dredging of these new shoals be paid for under the associated bid item for the Work Area wherein the shoal resides?

A44. Yes.

Q45. Regarding Stapleton debris removal, Option 1, what is the criteria for acceptance, i.e. how will the Contractor know that he’s removed all of the debris? Will the Contractor be required to remove debris to a certain elevation?

If so, what elevation is required to be considered clear for acceptance?

A45. This has been revised in this amendment.
