Contract award will be based on what is contained in the printed Plans and Specifications in a hard copy format or Electronic Bid Set if provided. Questions and answers are issued to the Bidders for information only.
Q1. Based on the timing conflicts listed above, we respectfully request that the USACE consider modifying the contract documents to reflect an anticipated NTP issuance of 01 June 2016 (or an amendment that similarly alleviates the timing conflicts present in this solicitation).
A1. The Government expects to either 1) expeditiously award and issue the NTP with the winning offeror mobilizing quickly so that areas with environmental windows can be largely, if not altogether cleared, prior to the window. (As part of this expectation, efforts are underway to allow some flexibility in the work as it relates to environmental windows. For bidding purposes, unless changed in a future amendment, bidders should prepare their bid assuming that there are no windows on the water siphons, referred to as “WORK AREA 2” and “WORK AREA 4”), or 2) should no flexibility be achieved regarding the solicitation's existing environmental windows, that the government expects to postpone bid opening to early 2016 so sufficient time exists following bid opening for the work to be performed consistent with the existing environmental windows.
Q2. Do Work Areas 1, 3, and 5 allow excavation utilizing a hopper dredge?
A2. A hopper dredge is not precluded by the NYSDEC permit. Some operational restrictions have been included by NMFS. See Section 00902. See the technical specifications for specific hopper dredge related requirements.
Q3. Do Work Areas 1, 3, and 5 allow hopper dredge overflow?
A3. Hopper dredge overflow is not precluded by the NYSDEC permit. Some operational restrictions have been included by NMFS. See Section 00902. See the technical specifications for specific hopper dredge related requirements.
Q4. Do Work Areas 2 and 4 allow excavation utilizing a hopper dredge?
A4. A hopper dredge is not precluded by the NYSDEC permit. Some operational restrictions have been included by NMFS. See Section 00902. See the technical specifications for specific hopper dredge related requirements.

A5. Hopper dredge overflow is not precluded by the NYSDEC permit. Some operational restrictions have been included by NMFS. See Section 00902. See the technical specifications for specific hopper dredge related requirements.
Q6. Does Work Area 6 allow excavation utilizing a hopper dredge?
A6. A hopper dredge is not precluded by the NYSDEC permit. Some operational restrictions have been included by NMFS. See Section 00902. See the technical specifications for specific hopper dredge related requirements.
Q7. Does Work Area 6 allow hopper dredge overflow?
A7. Hopper dredge overflow is not precluded by the NYSDEC permit. Some operational restrictions have been included by NMFS. See Section 00902. See the technical specifications for specific hopper dredge related requirements.
Q8. Does the work in the Port Jersey Channel allow excavation utilizing a hopper dredge? Does the work in the Port Jersey Channel allow hopper dredge overflow?
A8. The Corps of Engineers has requested that the NJDEP permit be amended to permit this. For purposes of bidding, unless a future amendment states otherwise, offerors are to assume that a hopper dredge will be allowed to operate in Port Jersey with no barge overflow.
