Solicitation W912DR-10-R-0107, Attachment A, Continuation of Schedule B revised 8-31-10 Contractor may propose additional labor categories in a competitive environment when necessary to meet the requirements of a task order.
Contractor may also propose a discount on the contract labor rate but may not exceed the rate in Section B.
NOTES:
1. See Note 12 for additional information required as part of the cost/price proposal but not to be included on the pricing schedule.
2. See Sections J, L and M for complete discussion of the content of the Cost/Price Proposal and its evaluation. The Pricing Schedule is only one part of the contents of the required Cost/Price Proposal.
3. Subcontractors: The subcontractors who will be included by the prime in the Pricing Schedule and in the full cost/price proposal are those identified by the prime contractor as “team subcontractors.” Team subcontractors are one that the prime propose to perform 10% or more of the effort to qualify for this contact and/or are subcontractors that the prime wishes to use during the life of the contract without having to obtain competition.
4. Definition of Other Direct Costs (ODCs): All direct costs other than labor.
5. The Pricing Schedule requires use of fully burdened hourly labor rates and fully burdened unit prices for all anticipated Other Direct Costs (ODCs). “Fully Burdened” for the prime contractor means the direct cost (labor or ODC) plus all indirect costs and mark-ups consistent with the prime’s accounting system for which the prime expects payment EXCLUDING profit. The profit for the prime contractor will be negotiated for each task order. “Fully Burdened” for the subcontractors means the direct cost (labor or ODC) plus all indirect costs and mark-ups consistent with the subcontractor’s accounting system for which the subcontractor expects payment INCLUDING profit. The offeror and their subcontractors will account for all of their costs in the unit prices entered into the Pricing Schedule – direct costs and all indirect costs (labor overhead, all other overhead costs, general and administrative (G&A), the prime’s markup to subcontractor’s fully burdened rates (indirect costs only, not to include any profit going to the prime) and any other multipliers consistent with the prospective accounting system. Labor rates and Other Direct Cost rates will be fully burdened as directed in this paragraph. When the contract is awarded, the unit prices in the contract’s Pricing Schedule for the prime contractor and for the subcontractors will be the contract rates; they will not be renegotiated if they are not correctly calculated and proposed by the contractor or the subcontractor as directed in this paragraph.
6. The job titles and classifications noted in the Pricing Schedule at the solicitation phase are the Government’s anticipated job titles and classifications. All offerors must include and price all of these job titles and classifications as a minimum, whether through the use of personnel from the prime’s firm or through subcontractors. However, there may be job titles in the Government’s solicitation pricing schedule that are not, under the Offeror’s accounting system, direct charged on projects; if the Offeror does not give a labor rate for a job title for that reason, the Offeror shall so state. Offerors shall add to the Government’s list all anticipated job titles and classifications for both prime and subcontractor(s) that are not included by the Government to include every job title and classification the contractor anticipates using over the life of the contract. The Government has shown the job classifications within job titles as Senior, Staff and Junior levels. The following definitions apply to the use of these classifications:
Senior Level of the Profession: Job management with some review function.
Staff Level of the Profession: Hands-on work effort; responsible for most of the work on a task order.
Junior Level of the Profession: Relatively new to the profession; still in an apprenticeship, not fully credentialed; works under the supervision of a staff or senior level person.
The Offeror and its subcontractors may separate the job titles into classifications by whatever method is common to their firm rather than the Senior, Staff and Junior scheme but the offeror must define their scheme and give definitions of the levels.
The Government intends the following job titles to have the following definition:
Principal: The owner, president, vice-president or CEO of the firm.
7. Other Direct Costs to include equipment, material and supply direct costs will be negotiated as required on each Task Order and not pre-priced or listed on the Pricing Schedule. The Contractor shall present the Government, as part of each task order’s cost proposal, the equipment, material and supply costs for the task order with support for the proposed costs which indicate that they are fair and reasonable. The Contractor will be allowed to apply indirect cost rates as proposed (the multiplier identified (in schedule above) as appropriate to ODCs), and profit as negotiated on each task order for equipment, material and supply costs.
8. Travel, Per Diem, and Vehicle Rental/Mileage Costs: If required by a task order under this contract, cost for travel, lodging, meals, vehicle rental, and mileage are allowable subject to the limitations of FAR 31.205-46. These costs will be negotiated on each task order. The contractor is allowed to apply indirect costs as proposed and consistent with contractor’s accounting system and profit as negotiated on each task order to travel costs.
9. Laboratory costs will be negotiated as required on each Task Order and not pre-priced or listed on the Pricing Schedule. The Contractor shall present the Government, as part of each task order’s cost proposal, the laboratory costs for the task order with support for the proposed costs which indicate that they are fair and reasonable. The Contractor shall present the Government, with the task order’s cost proposal, with at least two quotes on required laboratory costs obtained from subcontractors by the Prime Contractor to support the Contractor’s proposed costs. The Contractor will be allowed to apply indirect cost rates as proposed (the multiplier identified as appropriate to ODCs and consistent with the accounting system), and profit as negotiated on each task order to laboratory costs.
10. Any labor classification rates or other direct costs for the prime or subcontractors that are needed during the life of the contract but were not included in the Pricing Schedule will be negotiated on the task order and added by modification to the contract as necessary. However, the fully burdened hourly labor rates and multiplier on Other Direct Costs (ODCs) entered on the Pricing Schedule and thereby, proposed by the Contractor will be the contract’s rates and prices for the period for which they are proposed (base contract period) and will not be renegotiated during that period.
11. Escalation, Firm, Fixed-Price Task Orders: All escalation rates, as proposed and accepted by the Government by contract award, to direct and indirect costs for the life of the contract will become the ceiling escalation rates for the firm, fixed-price task orders issued off of this contract.
12. The prime’s proposed total multiplier (excluding profit) to labor rates and all other direct costs (including equipment, materials and supplies, laboratory costs, travel costs and subcontracts) are to be submitted with the cost/price proposal, on the pricing schedule (see Sections J, Attachment E, F and G, and M). .The proposed multipliers will become part of the contract’s terms and conditions. The prime’s escalation rates to direct costs and indirect costs from year to year throughout the life of the contract are to be submitted with the cost/price proposal on the pricing schedule. (See Sections J, Attachment E, F and G L, and M).
13. The fully burdened unit prices on the pricing schedule will match the fully burdened unit prices used to develop the cost/price proposal (see Sections J, L, and M).
