OPTION 0011:

GATEWELL STRUCTURE at Sta.140+70 FFP

Includes all costs related to Gatewell Structure at Sta. 140+70 as outlined in plans and specifications.

Includes all related material, labor and equipment required to perform all work associated with the construction of the gatewell structure, inlet structure, pipe, pipe bedding, riprap, excavation, temporary ring levee, flap gates, outfall structure, clearing and grubbing, permanent and temporary seeding, and any necessary pumping. The lump sum price and payment shall constitute full compensation for furnishing all labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided. This work does not include the levee raise at this location. This structure must be operational 450 days after NTP.

The job price and payment made shall constitute full compensation for furnishing all labor, materials, and equipment including management of work, subcontracted work, quality control, environmental protection, meeting safety requirements, tests, and reports associated with performing all work required for which separate payment is not otherwise provided.

Section 01 22 00 Price and Payment Procedures

1.3.1 Levee and Berm Construction

1.3.1.1 Payment

Payment will be made for costs associated with Levee and Berm Construction.

Plans, profiles, and levee cross-sections provided with the contract documents have been provided to the Contractor to help with developing earthwork volume for the project. An estimate of levee and berm material volume is provided in the table that follows. This estimated volume is for information only and shall be verified by the Contractor. Losses, shrinkage, etc.

*Berm random fill only consists of underseepage berms as indicated on the drawings and discussed in the specifications.

**Neat volume refers to the volume after placement and compaction is complete.

***Topsoil to be stripped neat volume refers to the volume before the native material is disturbed by excavation.

Progress payments for construction of the berm and levee shall be based upon the percent of the total levee raise and berm material placed. This percent placed shall be represented by the Contractor in the following manner: as-built earth work cross-sections and earthwork quantity calculations in tabular format. Cross-sections shall be developed by the Contractor by surveying the progress payment final grade and superimposing this final grade survey on the cross-section drawings as represented in the Drawings. As noted, the Contractor shall also provide calculated quantities of levee and berm earthwork placed in tabular format. This calculation shall be performed by the Contractor for every cross-section interval using the average end area method.

Only levee and berm construction that meets placement specification requirements shall be included in the survey or calculations for progress payments.

Section 01 22 00 Price and Payment Procedures

Para 1.4.1.2 Measurement

Delete in its entirety

The total quantity of excavated material for which payment will be made will be the theoretical quantity between the ground surface as determined by a survey and the grade and slope of the theoretical cross sections indicated. No allowance will be made for overdepth excavating or for the removal of any material outside the required slope lines unless authorized.

Para 1.4.2.2 Measurement

Delete in its entirety

Measure riprap for payment by the ton (2,000 pounds) by weighing each truckload to the nearest 0.1 ton, and the final quantity of [each truckload] [the whole sum] is rounded to the nearest whole ton. Weigh the riprap for payment on approved scales before being placed in the work. Quarry weights will not be accepted. Use scales of sufficient length to permit simultaneous weighing all axle loads. Scales must be inspected, tested and sealed as directed to assure accuracy with 0.5 percent throughout the range of the scales. Certify scales located at the site of the work as to accuracy by an acceptable scales company representative prior to weighing any riprap. Scales will be checked and certified before riprap hauling and rechecked and recertified whenever a variance is suspected. Furnish the scales. If commercial scales are readily available in close proximity, 10 miles of site of work, the Contracting Officer may approve the use of the scales.

Weigh riprap in the presence of the Government representative. The Contracting Officer may elect to accept certified weight certificates furnished by a public weighmaster in lieu of scale weights at the jobsite.

Para 1.4.3.2 Measurement

Delete in its entirety

The measured lengths of deformed steel bars for concrete reinforcement will be converted to weights for the size of bars listed by the use of the nominal weights per lineal foot specified in ASTM A615/A615M.

Section 01 30 00 Administrative Requirements Para 1.31 Railroad Information

1.31.1 Railroad Insurance

a. The Contractor shall furnish contractual public liability and property damage insurance acceptable to the Government in form and with coverage and provisions contained in the "Railroad Protective Liability Form (State and Federal Highway Projects)" a copy of which will be made available to the Contractor, which insurance shall provide protection to (The Atchison, Topeka, and Santa Fe Railway Company) (Union Pacific Railroad Company) (Chicago, Rock Island and Pacific Railroad Company) (and to the) (Missouri Pacific Railroad Company) from and against all claims, demands, judgments, loss, cost and expenses for bodily injuries and property damage arising from or growing out of the Contractor's operations hereunder for the following limits of liability:

(1) (The Railroad) (Each of the railroads) shall be indemnified for a limit of not less than $_____________ for all damages arising out of bodily injuries to or death of one person, and, subject to the limit of each person, a total of $___________ for all damages arising out of bodily injuries to or death of one or more persons in each occurrence.

(2) (The Railroad) (Each of the railroads) shall be indemnified by regular protective property damage liability insurance policies in the amount of $___________ for each occurrence and an aggregate amount of $_________ to cover liability imposed by law upon the Railroad companies for damages because of the damage to or destruction of property arising out of the operations of the project Contractor.

b. (A separate policy shall be issued for each railroad company.) Three original counterparts of (each) (the) policy shall be furnished to the Contracting Officer, one of which will be submitted by the Government to the insured.

c. The Railroad Protective Liability Policy (for each of the railroad companies) shall be furnished and approved prior to the commencement of any work hereunder on the railroad right-of-way by the Contractor or any subcontractor.

1.31.2 Operations on Railroad Right-of-Way

a. General: The Contractor shall schedule and coordinate his operations with the operations of the Union Pacific Railroad to prevent interference with railroad traffic. The Contractor shall not perform any construction operations or place any materials within the minimum clearance distance from the centerline of the tracks, as prescribed by the railroad company, without prior approval of the railroad company; he shall provide all safety measures such as lights, flares, and flagmen, as required by the Contracting Officer, and shall be fully responsible for any and all damage to life or property resulting from his operations on or adjacent to the railroad right-of-way.

b. Crossings: Where railroad crossings are required for the Contractor's operations, he shall secure any permits required by the railroad company and shall construct the crossings and operate over the crossings at his own expense under the terms and conditions imposed by the railroad company.

Section 01 30 00 Administrative Requirements Para 1.32 Signal Lights

The Contractor shall display signal lights and conduct his operations in accordance with the General Regulations of the Department of the Army and of the Coast Guard governing lights and day signals to be displayed by towing vessels with tows on which no signals can be displayed, vessels working on wrecks, dredges, and vessels engaged in laying cables or pipe or in submarine or bank protection operations, lights to be displayed on dredge pipelines, and day signals to be displayed by vessels of more than 65 feet in length moored or anchored in a fairway or channel, and the passing by other vessels of floating plant working in navigable channels, as approved by the Secretary of the Army (33 C.F.R. 201.1- 201.16) and the Commandant, US Coast Guard (33 C.F.R. 80.18-80.31a and 33 C.F.R. 95.51-95.70).

Section 01 57 19 Temporary Environmental Controls Add Para 1.7 and renumber those after.

1.7 LICENSES AND PERMITS

Obtain licenses and permits required for the construction of the project and in accordance with FAR 52.236-7 Permits and Responsibilities. Notify the Government of all general use permitted equipment the Contractor plans to use on site.

This paragraph supplements the Contractor’s Responsibility under FAR 52.236-7 Permits and Responsibilities.

a. The following authorization has been obtained by the City of Manhattan:

(1) Riley County Conditional Use Authorization (CUA) for the project borrow area. Contractor is required to comply with all requirements within the CUA. CUA identifies specific permits and fees required prior to beginning construction. “Riley Co CUP for Levee Borrow June 2021” is available as an attachment to this specification.

b. The following supplemental assessment/permits have been obtained by the Government:

(1) Supplemental NEPA Memorandum (serves Section 10/404 compliance document for Nationwide Permit 7 authorization). The contractor shall follow the permit conditions of Nationwide Permit 7 and associated Section 401 conditions relevant to Nationwide Permit 7.

2. DRAWINGS:

a. Microstation (.dgn) files have been provided in the project Plan Room for Cross Sections. Download from the Plan Room with the instructions provided within the original project solicitation. Files provided are:

SECTION 00 72 00 - GENERAL CONDITIONS

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work and ready for use not later than 913 calendar days. The Period of Performance for Option CLIN 0011 shall be 450 days from Notice to Proceed. * The time stated for completion shall include final cleanup of the premises.
