PERFORMANCE WORK STATEMENT

PARK CUSTODIAN

AREA 1

STOCKTON PROJECT

1. GENERAL INFORMATION

1.1. BACKGROUND. Stockton Lake is a flood control reservoir located on the Sac River in southwest

Missouri, tucked into the foothills of the scenic Ozark Mountain range. The lake spans three county boundaries: Cedar, Dade, and Polk. It is approximately 50 miles northwest of the metropolitan area of

Springfield, Missouri, and approximately 130 miles south of Kansas City, MO. A map of Stockton Lake can be found at: http://www.nwk.usace.army.mil/Locations/DistrictLakes/StocktonLake.aspx.

Stockton Lake provides flood protection for downstream areas and is part of a network of Corps of

Engineer Lakes that help control flooding in the Missouri and Mississippi River basins. Stockton Lake encompasses approximately 25,000 acres of surface water. Federal land surrounding Stockton Lake totals

36,047 acres, of which 16,572 acres are leased to the Missouri Department of Conservation (MDC) for management. Land management practices used by the Corps of Engineers and MDC are engineered to preserve their natural value, providing benefits to the nation in areas of flood damage reduction, recreation, fish and wildlife management, hydroelectric power, and water quality improvement.

Eight parks around the lake are managed and maintained by the Corps of Engineers. These parks include roads, utility systems, campsites, beaches, boat ramps, picnic grounds, and playground areas. In addition to Corps-managed areas, the Corps also maintains active lease agreements with the Missouri Department of Natural Resources and private entities. The lessees provide a full range of marina services, restaurants, and camping to the public. Additional services contracted to the private sector include mowing, refuse collection, facility cleaning, and park attendant. The Corps manages the contracts and conducts inspections to insure that the services are provided for visitors to the lake.

1.2. SCOPE OF WORK. Contractors shall provide all labor, equipment, fuel, materials and supplies, and supervision necessary to perform park custodial duties, as specified for the particular area, at Stockton

Lake Project, near Stockton, Missouri as defined in this Performance Work Statement (PWS), Section C-5 in particular, except those items specified in Section C-3 as Government-furnished. Contractors shall perform to the standards in this contract and shall monitor performance and ensure compliance in accordance with the terms and conditions.

1.3. PERIOD OF PERFORMANCE. Park Contractors work during the recreational season. Season dates vary among parks - refer to schedule appearing at the end of this PWS. Work shall be performed on all Federal holidays and weekends during this period at no additional cost. Custodial services shall be performed between the hours of 5 a.m. and 10 p.m. Each individual work item shall be performed pursuant to the schedule for that work item set forth in Section C.5.

1.4. POST-AWARD (“PRE-WORK”) CONFERENCE. After award, but prior to start of services, the Project

Office will arrange a Pre-Work Conference to be held at the Project. The purpose of the Conference is to discuss contract requirements and details of contract performance. Usually the Pre-Work Conference is held with all Park Attendants and/or Custodians for the season present together at the same time. All

Contractor personnel must attend the Pre-Work Conference.

1.6. DOCUMENTS AND CORRESPONDENCE. After award, all documents and related correspondence shall be routed to the Contracting Officer; or through the Contracting Officer’s Representative (COR) at the Project Office to the Contracting Officer. Day to day contact and telephone communication with

Government personnel shall normally provide adequate information exchange. The Government reserves the right to schedule meetings at the Project Office as necessary to insure strict compliance with the terms of this contract. Such meetings shall be scheduled, to the extent possible, at mutually convenient times.

However, upon notice, the Contractor shall attend meetings regarding matters affecting this contract, and the time spent in such meetings shall be at no additional charge to the Government.

1.7. CONTRACTOR PERSONNEL.

1.7.1. MANPOWER REQUIREMENT:

The Contractor shall either personally perform or provide direct personal superintendence of employees engaged in the performance of duties under the contract. All employees working under this Contract shall be as identified in the Contractor's proposal and shall be subject to approval of the

COR. Approval shall be conditioned on proof of bonding and a criminal records check demonstrating no felony adjudications of any type or misdemeanor adjudications involving theft or sexual offenses. An "adjudication" shall mean a conviction or or any plea of guilty or no contest, or any judicial finding of guilty to the charge, regardless of whether sentence is actually imposed.

Equally-qualified employees may be substituted upon written request and the concurrence of the

COR based on the criteria stated. All personnel shall be covered by the insurance and bonding requirements of this Contract.

The Contractor shall designate, in writing, a responsible member of each work crew who shall serve as the contact for matters involving quality and performance of the required work assigned to that crew. The employee(s) designated in accordance with the above requirement shall insure that the work described herein is performed in accordance with these specifications. The Contractor shall furnish the above written designation to the COR at the project, the first day that an individual is a

“responsible party.” The designation shall include the name(s), address(es), and telephone number(s) of the responsible individual(s).

1.7.2. CONTRACTOR CONDUCT: Contractor personnel shall be fully clothed at all times while performing these services. Clothing shall be clean and neat in appearance. Contractor personnel shall utilize tact, diplomacy, and courtesy at all times during contact with the public. Any illegal or criminal activity may result in termination of the contract. No person performing this Contract shall consume any alcohol or drugs (except prescription drugs not affecting duty performance) during duty hours or within the eight (8) hour period next preceding duty hours.

1.7.3. SECURITY REQUIREMENTS: Contractors shall safeguard all Government property. Keys to storage sheds will be provided to Contractors. Contractors shall establish and implement methods of making sure all keys issued by the Government for Contractor’s use are not lost or misplaced, and are not used by unauthorized persons. Contractors shall immediately report to the COR any occurrences of loss, unauthorized use, or unauthorized duplication of keys. In the event keys, other than master keys, are lost or duplicated, Contractors may be required, upon written direction of the

Contracting Officer, to rekey or replace the affected lock or locks without cost to the Government.

1.7.4. FOUND ITEMS: To assist the visiting public in reclaiming lost articles, all property left by visitors and found during the performance of duties shall be turned in to the COR. Contractors shall report any observed instance of vandalism, facilities not operating properly, or facilities in need of repair to the COR.

1.8. QUALITY CONTROL (CONTRACTOR’S RESPONSIBILITY). The Contractor shall develop a Quality

Control Plan designed to demonstrate how the Contractor will meet the needs of the project. The Quality

Control Plan shall document how the Contractor will identify and correct performance shortfalls.

Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance.

1.9. QUALITY ASSURANCE (GOVERNMENT’S RESPONSIBILITY).

1.9.1. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). A Quality Assurance Surveillance

Plan will be used during the life of each contract to ensure that the service provider is performing the services required by this PWS in an acceptable manner. The Government develops the QASP, and the Project Office administers the plan through Quality Assurance Evaluators (QAEs) which monitor

Contractor performance using quality assurance procedures developed by the Government. Typical procedures might include random sampling, checklists, and customer complaints. This should not be considered an exhaustive list. A primary objective of Government Quality Assurance will be to determine the effectiveness of the Contractor’s quality control system.

1.9.2. INSPECTIONS. According to the Inspection of Services clause (52.246-4 Inspection of Services-

Fixed Price), the Government reserves the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The

Government will perform inspections in a manner that will not unduly delay the work.

1.9.3. The Contractor understands that the QASP is solely for the benefit of the Government in ensuring the Contractor completes its required work in accordance with this contract. Government officers shall never exercise supervision over the Contractor’s employees, and any defects noted shall be brought to the attention of the COR. Failure of the Government to identify a defect shall not constitute waiver of the Government’s rights concerning that defect.

1.9.4. UNSATISFACTORY PERFORMANCE. If any of the services do not conform to contract requirements, the Government may direct the Contractor to perform the unsatisfactory services at no additional cost to the Government. Re-performance as directed by the Government shall be completed within two (2) hours. Failure of the Contractor to perform the work as specified, or to re-perform work as directed within the allotted time, may result in reduction of the contract price in proportion to the portion(s) of the work not accomplished. Amounts to be withheld will be determined by prorating the amount of services satisfactorily performed against the amount of services required. When the defects in services cannot be corrected by re-performance, the

Government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements, and (2) reduce the contract price to reflect the reduced value of the services performed. Payment will NOT be made for work not performed or not performed to standard.

1.9.5. If the Contractor fails to promptly re-perform the services or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may: (1) by contract, or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service, or (2) terminate the contract in whole or in part.

When outside, pets shall be on a leash at all times.

1.13. SMOKING POLICY. Smoking is not allowed in any Government buildings, including shower buildings, vault toilets, etc. Smoking is also not allowed by Contractors or their employees while in direct contact with the public.

1.15.2. All services shall be performed in accordance with applicable safety requirements set forth in

Corps of Engineers Manual EM-385-1-1, “Safety and Health Requirements Manual” and supplements thereto. The EM-385-1-1 is hereby incorporated by reference, and the Contractor is required to perform this contract in accordance with the standards set forth therein. Contractor shall not allow water or other liquids to contact hand dryers, electrical fixtures, or other electrical equipment and lines during cleaning. Contractor shall be liable for all damage resulting from failure to comply with this requirement.

1.16. PAYMENT. Payment will not be made for services not performed. Contractors shall provide the Project

Office with an invoice at the end of each month, requesting payment for that month’s services (the

Government will furnish blank invoices for Contractor use). Payment shall be made via Electronic Funds

Transfer (EFT) into the Contractor’s banking account on file as registered with CCR. In accordance with the Prompt Payment Act, payment will be made approximately 30 days after the last day of services received for the billing period, or 30 days from receipt of the invoice, whichever is later. For example, services performed during April shall be billed at the end of April, and payment will be made at the end of

May. Likewise services performed during May shall be billed at the end of May, and will be paid at the end of June. NOTE: Contractors may choose of their own will to offer a "discount" (for example, "½% discount if paid by 10 days") which the paying office may or may not choose to honor. Historically the paying office has honored most discounts, meaning a Contractor might be paid in 10 days instead of 30, at the discounted rate offered on the Contractor’s invoice. However, this is not guaranteed, and payment may be made in 30 days as usual.

1.17. ENVIRONMENTAL CONTROLS.

1.17.1. PARK CUSTODIAN CLEANING PRODUCTS. Contractors will use standard commercial cleaning products generally available in the local marketplace and shall use those products only in accordance with their labeled instructions and uses.
