The Total Evaluated Price (TEP) shall be comprised of the summation of all CLINs. In the event there is a difference between a unit price and the total amount, the unit price will be held to be the intended quote and the total of the CLIN will be recomputed accordingly.
As part of the price evaluation, the Government will evaluate the Option to Extend Services under FAR Clause 52.217-8 by adding one-half of the Quoter's final option period price to the Quoter's total price. Therefore, the Quoter's TEP will include the base period and each option period, plus one-half of the final option period's price. If, however, the option to extend services is used prior to the end of the last option period, the option to extend services will be exercised at the rate proposed for the option period which the extension is used within.
When preparing your quote, the ordering period pricing means that the Government can unilaterally issue a Task Order at any time during the ordering period and pricing is valid for the entirety of the Task Order (typically up to 12 months) to potentially include an up to six-month additional unilateral option using the FAR clause 52.217-8. For example, during the final ordering period an order can be issued on the last day of that ordering period for a full 12-month period of performance, additionally the Government can potentially unilaterally exercise the FAR Clause 52.217-8 (up to 6 months) at the end of that Task Order for the same price proposed for the last ordering period, meaning the price proposed for the final ordering period could be valid for up to an additional 18 months past the final ordering period.
Paragraph (c) - Period for Acceptance of Offers - is tailored to read: The Quoter agrees to hold the prices in its offer firm for ninety (90) calendar days from the date specified in this solicitation for receipt of offers. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Quoter within the time for acceptance specified above, shall result in a binding contract without further action by either party. Before the quote's specified expiration time, the Government may accept a quote (or part of an quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
-Paragraph (g) Contract Award The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror's initial offer should contain the Offeror's best terms price and technical stand point. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received. This procurement is being conducted using the procedures in accordance with RFO part 12, Acquisition of Commercial Products and Commercial Services. As such, the Government has broad discretion to fashion suitable evaluation procedures, inclusive of determining whether to permit Quoters to revise their Quotes and/or address any material failures in such submissions if determined to be in the best interest of the government.
The completion and submission to the Government of the above items listed in this Provision will constitute the offer. The quote shall communicate the Quoter's unconditional assent to the terms and conditions in this solicitation, including any attachments and documents incorporated by reference. The Quoter's failure or refusal to agree to any of the terms and conditions of this solicitation or the Quoter's imposition of additional conditions or any material omission in its offer may constitute a deficiency which will make the offer unacceptable to the Government.
This request does not commit the Government to pay any costs incurred in the preparation and submission of your quote or in making any necessary studies for the preparation thereof, or for any visit the Contracting Officer may request for the purpose of clarification of the quote or for revisions provided in response to communications.
