(ii) Volume II – PAST PERFORMANCE
(a) The Government may contact organizations for which an offeror and subcontractors have previously performed work that is relative to this requirement in order to obtain performance information.
(b) The information requested below is required of the offeror and subcontractors for the past performance evaluation, however, offerors may submit additional information at their discretion if they consider such information necessary to establish a record of relevant performance.
(1) A list of the three most relevant active or ended contracts, in the last five years, by name, contract number, brief description, type, and total original, and present or final contract value. References with Government contracts are preferred, but not required.
(2) Customer’s name, address and telephone number of both the lead contractual and technical personnel. (Please verify that the telephone numbers provided are current and correct.)
(3) Date of contract, place(s) of performance and delivery dates or periods of performance.
(4) Relationship of this work to the work that will be performed under this contract; i.e., how is it specifically comparable. There should be discernable links between this discussion and the PWS to be performed.
(5) Magnitude of work directly accomplished by the company on the relevant contract in relation to the total effort.
(6) Method of acquisition: Competitive or noncompetitive
(7) Nature of award: Initial or follow-on
(8) Any major problems and how they were overcome. List any major deviations or waivers to requirements that were granted by the customer.
(9) Whether delivery was on time and, if not, why; adherence to program schedules; incentive performance (e.g. schedule and technical) history, if applicable.
(10) List any Government contracts terminated (partial or complete) within the past three years and basis for terminations (convenience or default). Include the contract number, name, address, and telephone number of the terminating officer. Include contracts that were “de-scoped” by the customer because of performance or cost problems.
(c) The Government may obtain additional information for use in the evaluation of past performance from any source, including sources outside of the Government. The Government may obtain whatever information it deems most relevant to the required effort by telephonic and/or written inquiry. Although the Government has the ability to seek information from any source, this does not place any duty upon the Government to locate past performance information. The burden of providing all such information is always upon the offeror in question.
(d) The ability of the Government to seek past performance information from any source is not limited by any restrictions upon offerors in the solicitation regarding the number or nature of contracts to be submitted for review. For example, if the solicitation limits each offeror to submitting three relevant contracts performed during the past five years, the Government may nevertheless independently locate and evaluate five contracts performed by the offeror in the past six years.
(e) The Government will seek to engage in an even-handed and fair evaluation process; however, the Government has absolutely no obligation to engage in “equal” comparisons of past performance of all offerors. For example, if the Government receives information from outside sources regarding the past performance of two additional contracts of an offeror, the Government is not then obligated to search for the past performance of two additional contracts for every other offeror.
(f) An offeror without a record of relevant past performance, or for whom information on past performance is not available, may not be evaluated favorably or unfavorably in past performance.
(g) The offeror shall complete Appendix 2, Past Performance Questionnaire, to identify up to three contracts (completed or ongoing) that the offeror performed within the past five years that best shows your ability to perform the requirements of the contemplated contract. (h) The offeror shall include in its written proposal, a list of those to whom the questionnaire was sent including name of individual; current and verified phone number; organization; and contract number. The questionnaire shall be returned to the Contracting Officer no later than the time and date indicated in block 8 of this solicitation’s cover page (SF 1449). It is the offeror’s responsibility to ensure that its references deliver the questionnaires to the government by the required time and date.
(i) Consent Letters. Past performance information concerning subcontractors cannot be disclosed to a private party without the subcontractor’s consent. Since the Offeror is a private party, the Government will need that consent before disclosing subcontractor past performance information to the Offeror during exchanges, Reference Appendix 3, Subcontracting Consent Letter for the Release of Past and Present Performance Information to the Prime Contractor. In an effort to assist the Government in assessing your past performance relevancy, request the sample consent letter be completed by the major subcontractors identified in your proposal. The completed consent letter shall be submitted as part of the Past Performance Information Volume, but will not be considered in the page count of this Volume. Should the Offeror not submit a completed Consent Letter for subcontractors, the Government will only discuss past performance information directly with the prospective subcontractor that is being reviewed. If there is a problem with the proposed subcontractor’s past performance, the Offeror can be notified of a problem, but no details may be discussed without the subcontractor’s permission. For each identified effort for a commercial customer, if applicable, the Offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the Offeror’s performance, reference Appendix 4, Client Authorization Letter.

The Government will use the following rating and descriptions outlined in the table below for evaluating Factor 1 – Technical Capability.
Technical Acceptable/Unacceptable Ratings
Rating

Unacceptable
Proposal does not clearly meet the minimum requirements of the solicitation. Proposal fails to include, and adequately address, any of the information required in the Technical Capability Volume. Proposal is incomplete, does not address all the elements within the evaluation factors and/or is missing information.
D. PAST PERFORMANCE EVALATION. The past performance evaluation is an assessment of the offeror' s probability of meeting the minimum past performance solicitation requirements. This assessment will be based on the offeror' s record of relevant and recent past performance information that pertain to the services outlined in the solicitation requirements. The past performance evaluation will be against the following factor:
Factor 2 – Past Performance
(a) The Government will evaluate the offer for including a list of the three most relevant active or ended contracts, in the last five years, by name, contract number, brief description, type, and total original, and present or final contract value.
(b) The Government will evaluate the offer for including the customer’s name, address and telephone number of both the lead contractual and technical personnel.
(c) The Government will evaluate the offer for including the date of contract, place(s) of performance and delivery dates or periods of performance.
(d) The Government will evaluate the offer for describing the relationship of this work to the work that will be performed under this contract; i.e., how is it specifically comparable. There should be discernable links between this discussion and the PWS to be performed.
(e) The Government will evaluate the offer for describing the magnitude of work directly accomplished by the company on the relevant contract in relation to the total effort.
(f) The Government will evaluate the offer for describing the method of acquisition: Competitive or noncompetitive.
(g) The Government will evaluate the offer for describing the nature of award: Initial or follow- on.
(h) The Government will evaluate the offer for describing any major problems and how they were overcome, and for listing any major deviations or waivers to requirements that were granted by the customer.
(i) The Government will evaluate the offer for describing whether delivery was on time and, if not, why; adherence to program schedules; incentive performance (e.g. schedule and technical) history, if applicable.
(j) The Government will evaluate the offer for listing any Government contracts terminated (partial or complete) within the past three years and basis for terminations (convenience or default). The Government will evaluate the offer for including the contract number, name, address, and telephone number of the terminating officer. The Government will evaluate the offer for including contracts that were “de-scoped” by the customer because of performance or cost problems.
(k) If an Offeror has no relevant experience or past performance history, the Government will evaluate the offer for affirmatively stating so. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” will be considered “acceptable.”
The Government will use the following rating and descriptions outlined in the table below for evaluating Evaluation Factor 2 – Past Performance:
Past Performance Evaluation Ratings
Rating
Description
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Factor 3 – Price. Price will not be assigned an adjectival rating. Price will be evaluated for completeness and price reasonableness. A determination will be made on whether each price offer is complete, and whether the proposed prices are reasonable. Incomplete or unreasonably priced offers will not be considered for award. The Government will evaluate the price offer for:
(a) Being complete and accounting for all resources necessary to meet the requirements of this contract.
(b) Including pricing for all proposal elements sorted by PWS section. Submitting a complete Appendix 5, PWS Pricing Worksheet in sufficient detail to facilitate the evaluator’s understanding and ability to mathematically verify the prices proposed.
(c) Including a narrative portion that explains in detail all elements of price projections, and pricing and estimating techniques. Submitting a complete Appendix 6, Pricing Narrative.
(d) Including the same level of pricing information for any and all proposed subcontractors.
Completeness. An accurate reflection of all aspects of the offer. Offeror compliance with the price preparation instructions in the addendum to FAR 52.212-1; and offeror compliance with all other applicable instructions in the solicitation.
Price Reasonableness. Price reasonableness will be determined based on competition and/or the results of a price analysis using the techniques detailed in FAR 15.404-1(b).
Total Evaluated Price. In addition to the evaluation of options, the contract total evaluated price shall consist of the sum of the proposed prices for all Firm-Fixed Price CLINs for Detainee Library Services (CLINs 0001, 0002, 0005,1001, 1004, 2001, 2004, 3001, 3004, and 4001, 4004) and Contract Manpower Reporting (CLINs 0003, 1002, 2002, 3002, and 4002) will be evaluated to determine if the Offeror’s proposed price is fair, reasonable, and balanced utilizing price analysis techniques in accordance with the guidelines in FAR 15.404-1(b).
For the purpose of the award of this Contract, the Government intends to evaluate the option to extend services, provided under FAR 52.217-8, as follows:
(a) The evaluation will consider the possibility that the option can be exercised at any time during any contract performance period, and can be exercised in increments of one to six months, but for no more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be at the same rates as those in effect under the contract when the option is exercised.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
