6. Delete and Replace the following Clauses
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4)such as agricultural products and petroleum products.
Component means an article, material, or supply incorporated directly into a construction material.
Construction material means an article, material, or supply brought to the construction site by the Contractor or subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site.
Materials purchased directly by the Government are supplies, not construction material.
Cost of components means--
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.
Designated country means any of the following countries:
(1) A World Trade Organization Government Procurement Agreement (WTO GPA) country (Armenia, Aruba, Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Israel, Italy, Japan, Korea (Republic of), Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Moldova, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Taiwan, Ukraine, or United Kingdom);
(2) A Free Trade Agreement (FTA) country (Australia, Bahrain, Canada, Chile, Colombia, Costa Rica, Dominican Republic, El Salvador, Guatemala, Honduras, Korea (Republic of), Mexico, Morocco, Nicaragua, Oman, Panama, Peru, or Singapore);
(3) A least developed country (Afghanistan, Angola, Bangladesh, Benin, Bhutan, Burkina Faso, Burundi, Cambodia, Central African Republic, Chad, Comoros, Democratic Republic of Congo, Djibouti, Equatorial Guinea, Eritrea, Ethiopia, Gambia, Guinea, Guinea-Bissau, Haiti, Kiribati, Laos, Lesotho, Liberia, Madagascar, Malawi, Mali, Mauritania, Mozambique, Nepal, Niger, Rwanda, Samoa, Sao Tome and Principe, Senegal, Sierra Leone, Solomon Islands, Somalia, South Sudan, Tanzania, Timor-Leste, Togo, Tuvalu, Uganda, Vanuatu, Yemen, or Zambia); or
(4) A Caribbean Basin country (Antigua and Barbuda, Aruba, Bahamas, Barbados, Belize, Bonaire, British Virgin Islands, Curacao, Dominica, Grenada, Guyana, Haiti, Jamaica, Montserrat, Saba, St. Kitts and Nevis, St. Lucia, St.
Vincent and the Grenadines, Sint Eustatius, Sint Maarten, or Trinidad and Tobago).
Designated country construction material means a construction material that is a WTO GPA country construction material, an FTA country construction material, a least developed country construction material, or a Caribbean Basin country construction material.
Domestic construction material means--
(1) An unmanufactured construction material mined or produced in the United States;
(2) A construction material manufactured in the United States, if--
(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or
(ii) The construction material is a COTS item.
Foreign construction material means a construction material other than a domestic construction material.
Least developed country construction material means a construction material that--
(1) Is wholly the growth, product, or manufacture of a least developed country; or
(2) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a least developed country into a new and different construction material distinct from the materials from which it was transformed.
“Free Trade Agreement country construction material” means a construction material that—
(1) Is wholly the growth, product, or manufacture of a Free Trade Agreement (FTA) country; or
(2) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a FTA country into a new and different construction material distinct from the materials from which it was transformed.
“Least developed country construction material” means a construction material that—
(1) Is wholly the growth, product, or manufacture of a least developed country; or
(2) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a least developed country into a new and different construction material distinct from the materials from which it was transformed.
United States means the 50 States, the District of Columbia, and outlying areas.
WTO GPA country construction material means a construction material that--
(1) Is wholly the growth, product, or manufacture of a WTO GPA country; or
(2) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a WTO GPA country into a new and different construction material distinct from the materials from which it was transformed.
(b) Construction materials.
(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). In addition, the Contracting Officer has determined that the WTO GPA and Free Trade Agreements (FTAs) apply to this acquisition. Therefore, the Buy American restrictions are waived for designated country construction materials.
(2) The Contractor shall use only domestic or designated country construction material in performing this contract, except as provided in paragraphs (b)(3) and (b)(4) of this clause.
(3) The requirement in paragraph (b)(2) of this clause does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:
[Contracting Officer to list applicable excepted materials or indicate ``none'']
(4) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(3) of this clause if the Government determines that--
(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the restrictions of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;
(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or
(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.
(c) Request for determination of inapplicability of the Buy American statute.
(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(4) of this clause shall include adequate information for Government evaluation of the request, including--
(A) A description of the foreign and domestic construction materials;
(B) Unit of measure;
(C) Quantity;
(D) Price;
(E) Time of delivery or availability;
(F) Location of the construction project;
(G) Name and address of the proposed supplier; and
(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.
(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.
(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).
(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.
(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(4)(i) of this clause.
(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.
(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:
Foreign and Domestic Construction Materials Price Comparison Construction material description Unit of measure Quantity Price (dollars) \1\ Item 1:
Foreign construction material Domestic construction material Item 2:
Foreign construction material Domestic construction material \1\ Include all delivery costs to the construction site and any applicable duty (whether or not a duty-free entry certificate is issued).
List name, address, telephone number, and contact for suppliers surveyed. Attach copy of response; if oral, attach summary.
Include other applicable supporting information.

REQUESTS FOR INFORMATION with RESPONSES Solicitation No. W912BU-18-R-0026
17 General General
In order to provide the USACE with the most competitive pricing possible, would the USACE consider allowing for Volume 2 Price Proposals to be submitted electronically via email and/or waive the requirement to provide CDs with the Volume 2 Price Proposal at time of bid? It is typical for major subcontractors to hold their pricing until the last few hours prior to the bid date and time and if we are required to submit hard copies accompanied with CDs, we will not be able to include the subcontractor pricing which comes in just prior to the bid date and time.
Prepare proposal per the solicitation.
18 General General
Would the USACE reconsider not allowing the past performance of subcontractor teaming partners? It is unlikely that any of the General Contractors who may have applicable prime past performance will be self-performing the critical work and instead will be subcontracting all critical work. As such, if a General Contractor can provide a letter of commitment from a qualified subcontractor, will that subcontractor past performance be considered for evaluation? It would seem that allowing subcontractor teaming partner performance would be preferential to the USACE as then the USACE could verify that the subcontractors who will be self-performing the work are qualified.
Prepare proposal per the solicitation.
19 General General
If a contractor receives a rating of Not-Relevant for all past performance projects submitted in the proposal, would it still be possible to be awarded the project based on favorable reviews of price and all other factors in the technical proposal?
If all past performance is determined to be "Not-Relevant", this would be considered a "deficiency" as defined in Section 00 22 00 and therefore unawardable.

Section 1.3 - states that installers be approved by a competing installer (Geopier Foundation Company, Inc) with a vested interest in who is allowed as an alternate installer. This requirement, among other requirements in the specification, make it proprietary in nature. Please provide a non-proprietary specification written without regard or preference to an individual installer or a parent or affiliated company.
Revised Specification section
31.62.13.28 issued by amendment.
21 Structural SB111 SB111, Hangar piers are designated along CL 1 at A, B, C, D and E. Pier designations are not given for columns along .9 line. Please provide.
Refer to revised S- 502 and S-503 issued by amendment.
22 Structural 09 97 13.27
Section 09 90 00, 1.10.1.2 notes that all exposed columns, girders, beams, joists and metal deck are to be painted. Section 3.2 of 09 97 13.27 notes all primary and secondary steel framing inside the aircraft maintenance bay is to follow the 3-coat high performance painting system spelled out in section 2.3. Section 2.3 also notes that the 3 coat system must be applied in the field. Drawing S-001, Note S-18.A says the structural steel is to follow the three coat painting system in Division 09, but is silent on open web joists and metal deck. 05 12 00, 2.7.2 only calls for a zinc rich shop primer on the structural steel, with all connections and erection abrasions field primed per
3.5.1. 05 21 00, 2.5 calls for shop priming the joists. 05 30 13, 2.3.4.2 references a primer for metal decks. There is substantial cost to some of the items referenced above, and we want to be perfectly clear on what the Gov'ts requirements are for painting in the Hangar Bay. Industry standard would be to have manufacturer's provide a shop applied white primer to the steel, metal joists, and metal deck. There is a very large price increase to install a 3-coat high performance system on each one of those items. Please confirm if the structural steel needs the 3-coat system in 09 97
13.27 or just the shop primer in 05 12 00. Please confirm if the open web joists need the 3-coat system in 09 97 13.27 or just the shop primer in 05 21 00. Please confirm if the metal decking needs the 3-coat system in 09 97 13.27 or just the shop primer in 05 30 13. If any of the components need the 3-coat high performance system, please confirm if the coating can be shop applied by a SSPC QP 3 shop (as this often provides better quality than shop prepping per 2.3 and then trying to field apply the 3 coats of finish paint 60-90' in the air, all while trying to administer the requirements of 3.4 and
3.8 at the top of the hangar bay). Field connections and any areas affected by erection would be touched up using SSPC SP-1 and SP-2 procedures.
Structural steel shall be coated with the 3 coat system specified in 09 97
13.27. Open web
joists are to be shop primed per specification 05 21 00 and metal decking shop primed per spec section 05 30 13.
23 Contracting Contract Clauses
The solicitation contains FAR 52.225-9/10, Buy American - Construction Materials. We regularly see FAR 52.225-11/12, Buy American - Construction Materials Under Trade Agreements allowed on similar procurements, including recent solicitations at Dover AFB. Please confirm that FAR 52.225-11/12 can be incorporated into this solicitation.
Revised per amendment.
24 Contracting 00 73 46
The Davis-Bacon wage decision included in the specifications is DE10, which is for Heavy Civil work. Please confirm if this wage table should be DE07, which is for Building work in Kent County, DE?
Revised wage rates issued by amendment.
25 Contracting Warranty
Specification 07 41 13, 1.8.3 calls for a 5 year contractor warranty; but the attachment in the back of the spec is asking for a 20 year no penal sum warranty on the metal roof from the Contractor and Manf. It is industry standard to get a 20 year manufacturer's warranty on the roof, but not from the Contractor as well. If the Contractor has to co-sign, they will ask their bonding company to procure the warranty, and most bonding companies will only co-sign up to 5 years, at an added expense to the project. Please confirm the Contractor is only responsible for a 5 year warranty per 1.8.3 (and the Gov't will still get a 20 year warranty from the MFR per 1.8.1 and 1.8.2)
Revised per amended specification section 07 41 13.
26 General General We request a bid date extension of two weeks. We need more time soliciting, finding, and convincing small businesses to bid the project.
Refer to amendment for current proposal due date.
27 General General
We request a RFI due date extension of two weeks. Subcontractors will not look at project and get into the details until about 10 days before the bid date. Extending the RFI due date will help in limiting the amount of change orders during the construction of the project.
Refer to amendment for current proposal due date.
28 Civil N/A Please provide clarification regarding where excess dirt and topsoil should be hauled and stockpiled on base.
Per Section 31 00 00 paragraph 3.19 excess soil shall be disposed of on the project iste at location determined by the Contracting Officer.
29 Civil N/A Please confirm that waste such as asphalt and concrete are to be hauled off base.
Confirmed. Refer to Section 01 11 05 para 1.7 and Section 01 74 19 in the original solicitation.

Are pressure reducing valves acceptable on the sprinkler systems to alleviate the excess pressure so that standard fittings and sprinkler heads can be used if the water supply is adequate?
Pressure reducing valves are permitted on the sprinkler system.
41 Fire Protection C-512
Due to the fact that the feed from the water storage tanks runs underground (minimum of 4’0” cover), a portion of the water supply will not be able to be used.
Example, If the pipe is buried 4’0” below grade the bottom 4’ of water depth will not be used. If the pipe is buried 5’ below grade, the bottom 5’ of water depth will not be usable, etc. The fire pumps are not suction pumps and must have positive head to achieve flow. Once the level in the tank reaches a level above grade equal to what the pipe is buried below grade the pumps will not be receiving positive head and will not be able to supply water any longer. Please confirm the sizing of the water storage tanks as shown on Drawing C-512 has taken this fact into consideration.
Prepare proposal in accordance with the solicitation.

Section 2.3 and 3.7 are calling for a 3-coat thin film flooring system with a total thickness between 13 and 20 mils (primer and two top coats). Drawing IN001 calls for EF1 to be Stonhard Stontec TRF, which is a 5 mm flooring system (3 mm Urethane mortar coating, undercoat, and urethane sealer). This is similar to the product listed in Table II of 09 67 23.15, under Stonhard. Stontec TRF is 197 mils (5 mm), which is almost 10x thicker than the thin coat system in 09 67 23.15, and is usually specified for existing floors with uneven surfaces (the thick coating allows for leveling the rough/uneven surfaces). On brand new construction, it is common to use the thin-coat system as specified in 09 67 23.15. Please confirm the 13 - 20 mil system specified in sections 2.3 and 3.7 is allowed in lieu of the Stontec TRF (as long as it meets the requirements of Tables Ib, Ic, and Id).
