Section 00 72 00 - General Conditions
The following clauses were modified:
52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation 2026-O0038) Feb 2026 hereby reads as follows:
Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. Past Performance and Experience
(a) Submission of References: The quoter must provide three (3) to five (5) references for projects of similar scope, size, and complexity completed within the past seven (7) years for a government agency or private client.
(b) Evaluation of Subcontractor Past Performance: If the quoter plans to subcontract the primary technical work under this contract (specifically, the CCTV inspection and or Cured-In- Place Pipe (CIPP) lining systems), the quoter may submit past performance and experience references for the proposed subcontractor(s). To be considered, any subcontractor references must be accompanied by a signed Subcontracting Agreement or Letter of Commitment executed by authorized binding officials from both the prime contractor and the proposed subcontractor. If this is not provided, the subcontractor's past performance will not be considered, and the quoter will be evaluated solely on their own past performance record.
(c) Technical Relevance: The quoter must demonstrate experience and successful performance in CCTV inspection, pipeline condition assessment, and rehabilitation using Cured-In-Place Pipe (CIPP) lining systems. Projects submitted must represent work performed as a prime contractor or as a joint venture partner with equivalent technical responsibility, or as a subcontractor performing these specific critical technical requirements. Each project reference must include:
Project title, location, and contracting agency or client name Description of the work performed, including pipe diameters, lengths, and materials inspected or rehabilitated Type of CIPP system installed (e.g., steam-cured, UV-cured) and CCTV inspection technologies used Contract award amount, final cost, completion date, and total linear footage inspected /rehabilitated Names of major subcontractors or team members (if applicable) A brief narrative describing project relevance to this solicitation's requirements Points of contact (client and independent verifier) with name, title, telephone number, and email address (if available)
(d) Past performance evaluation will consider all projects listed in the proposal completed within seven (7) years of the quote due date. Projects should demonstrate similarity in magnitude and technical complexity (CCTV inspection and CIPP relining of small- to medium-diameter pipe systems). Greater emphasis will be placed on overall quality trends across the evaluated entity's project history, including (prime contractor or bound subcontractor) workmanship, schedule adherence, rework minimization, and warranty performance. The Government reserves the right to supplement evaluation with CPARS data and Contracting Officer records of prior experience with the offeror.
Evaluation Ratings:
Exceptional: Demonstrated highly successful completion of two (2) similar projects with strong technical relevance and exemplary client feedback (via reference or CPARS) by the prime contractor or the proposed, bound subcontractor.
Satisfactory: Demonstrated successful completion of at least one (1) similar project with overall favorable client feedback and no significant performance issues by the prime contractor or the proposed, bound subcontractor.
Unsatisfactory: Did not demonstrate successful completion of comparable CCTV or CIPP projects (by either the prime contractor or the proposed, bound subcontractor) or has unfavorable performance records.
2. Price
Quote must be inclusive of all costs that might be incurred during this agreement such as, but not limited to, mobilization, labor, materials, equipment rental fees, licenses and insurance. The Contractor must provide prices for all line items on the pricing sheet.
Past performance is more important than price.
(c) . A written notice of award or acceptance of an offer furnished to the successful Notice of award Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
