The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

(b) Evaluation Factors:

Factor 1 – Technical

1. Project Manager will have demonstrated experience managing personnel and handling government contracts, interpreting requirements, managing varied complex projects from inception through completion, risk management planning, and working with Federal, Army, State and local laws and regulations relating to environmental services as defined in the PWS.

2. Experience with state regulations and regulators within Arizona.

3. Demonstrated field activities experience, engineering support services experience, and experience in developing studies, analyzing impacts, and conducting investigations in the southwestern United States.

4. Demonstrated experience with projects that required regulatory interface, stakeholder interface, and performance-based milestones.

5. Examples of projects that were completed on time and within budget and that meet the project objectives.

6. Demonstrated experience to complete professional technical reports on time and with a quality that meets the government’s standards.

Factor 2 – Cost/Price

Factor 3 – Past Performance

Offerors shall furnish information for at least two (2) contracts that have been completed within the last three (3) years for similar services.

Include the following information for each contract:

1. Name and location of contracting activity; 2. Contract Number; 3. Contract Type; 4. Total contract value; and

5. Contracting officer name and telephone and/or e-mail address.

The Past Performance evaluation will assess the offeror’s ability to successfully accomplish the proposed effort based on the offeror’s Past Performance. The Government may use information available from past government contracts and any information found using sources such as the Contractor Performance Assessment Reporting

System (CPARS). The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the offeror.

Technical Factor is more important than Cost/Price and Past Performance. Cost/Price and Past Performance are equal in importance.

(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
