About this file
This solicitation is for construction services for Marysville Ring Levee Phase 2B & 3. The work includes construction of soil-bentonite and soil-cement-bentonite cutoff walls over approximately 15,000 linear feet of existing and realigned levee to strengthen the levee by the addition of seepage cutoff walls. Two phases are solicited as one construction project to be constructed in a minimum of two construction seasons, with all work completed by December 2022. Segments A, B, and C are base contract items to be constructed starting in 2020, while Segments D and E are option items to begin no sooner than 2021 as the options are exercised. The work will be performed along the right bank of the Yuba River beginning at State Road 70 and extending east and north over Simpson Lane, continuing along State Highway 20 to the northern limits of the City of Marysville. Approximately 15,000 linear feet of cutoff walls will be constructed using open trench and deep mix methods.

1.6 WRITTEN GUARANTEES AND GUARANTOR'S LOCAL REPRESENTATIVE
Prior to completion of the contract, obtain and furnish to the Contracting Officer's representative written guarantees for all the equipment and/or appliances furnished under the contract. Furnish with each guarantee: The name, address, and telephone number of the guarantor's representative nearest to the location where the equipment and/or appliances are installed, who, upon request of the Using Service's representative, will honor the guarantee during the guaranty period and will provide the services prescribed by the terms of the guarantee.
1.7 PRICING OF CONTRACTOR-FURNISHED PROPERTY
At the request of the Contracting Officer, promptly furnish and must cause any subcontractors to furnish, in like manner, unit prices and descriptive data required by the Government for property record purposes of fixtures and equipment furnished and installed by the Contractor.
1.8 TEMPORARY ELECTRIC WIRING
1.8.1 Temporary Power and Lighting
Provide construction power facilities in accordance with the safety requirements of the NFPA 70 and EM 385-1-1. Enforce all the safety requirements of electrical extensions for the work of all subcontractors.
All work must be accomplished by skilled electrical tradesmen in a workmanlike manner, as approved by the Contracting Officer.
1.8.2 Construction Equipment
In addition to the requirements of EM 385-1-1, all temporary wiring conductors installed for operation of construction tools and equipment must be either Type TW or THW contained in metal raceways, or may be multiconductor cord. Temporary wiring must be secured above the ground or floor in a workmanlike manner and must not present an obstacle to persons or equipment. Open wiring may only be used outside of buildings, and then only in strict accordance with the provisions of the National Electrical Code.
1.8.3 Circuit Protection
In addition to the present requirements in EM 385-1-1 and NFPA 70, all 15 and 20-ampere receptacle outlets used for obtaining power during construction must have ground fault circuit interrupters (GFCI) for personnel protection. Final Submittal SECTION 01 00 00 Page 5 Oct 29, 2019 unit.
1.9 UTILITIES
If utilities not shown on the plans and not visible as to the date of this contract are encountered within the construction limits of the entire project, and such utilities will interfere with construction operations, immediately notify the Contracting Officer in writing to enable a determination by the Contracting Officer as to the necessity for removal or relocation.
It is anticipated that pole lines, signs, pipelines and private improvements that would interfere with or are to be replaced by new construction will be removed to new locations by the owners (or by the State of California or its agents) in advance of construction operations.
Notify the Contracting Officer at least 30 calendar days in advance of the date on which work will be started requiring the removal of such utilities or private improvements. Care must be taken to preserve and protect any such improvements from injury or damage during construction operations.
Assume full responsibility for reimbursing the owners for any damage to their properties, utilities, or improvements, or interference with their services caused through construction operations. Should such damage be found to have been caused without the Contractor's fault or negligence an equitable adjustment in the amount due under the contract will be made under the applicable CONTRACT CLAUSES, Section 00 73 00.
Coordinate all utility work and need for utility service disruptions with the utility companies and Contracting Officer a minimum of 30 days in advance of utility disruption date. Be prudent in contacting utility companies and the Contracting Officer as soon as possible to prevent possible delays to construction and/or unnecessary or unscheduled disruption of the utility service.
1.9.1 Coordination with AT&T and PG&E, Coordinate and cooperate with the Government and AT&T, and PG&E on relocation of existing overhead and underground utilities and removal of abandoned overhead and underground utilities by the utility companies within the limits of construction at locations where such existing utilities would make impossible the performance of Contractor's construction activities. Coordinate such that the utilities are relocated in time to allow for completion of levee improvements in accordance with the Time of Completion schedule. Coordinate with PG&E for temporary de-energizing and dropping of overhead power lines to accomodate construction activities. As necessary, work around utilities that have not been relocated.
If any individual utilities must be relocated more than once to enable Contractor's completion of construction activities, the second relocation and any subsequent relocation of the same line will be at the Contractor's expense.
All Contractor costs for this coordination activity shall be incidental to and included in the applicable unit prices or lump sum prices contained in the Bid Schedule. Contractor will not be paid any additional costs or allowed a time of completion extension for this coordination activity. The Contractor shall measure the height of all overhead utilities within 10 days of the Notice to proceed and report all utilities that conflict with
Final Submittal SECTION 01 00 00 Page 6 Oct 29, 2019 the work to the Contracting Officer. In addition, the Contractor shall initiate coordination with the applicable agencies and utility companies no later than 90 days prior to construction reaching a utility.
1.10 GENERAL SAFETY REQUIREMENTS
1.10.1 General
For information regarding specific Safety Requirements see Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS. Refer to EM 385-1-1, (see Contract Clauses, Section 00 73 00, ACCIDENT PREVENTION) and the Occupational Safety and Health Act (OSHA) Standards for Construction 29 CFR 1926; General Industry Standards 29 CFR 1910; and the National Fire Protection Association Codes are applicable to this contract. In case of conflict the most stringent requirement of the standards is applicable.
1.10.2 The Prime Contractor's Superintendent
The Prime Contractor's superintendent must take an active role in enforcing the safety requirements by participation in safety conferences, hazard analysis as identified in Section 01 35 26, tool box meetings, walk-through inspections, correction of violations, etc., and including that of the subcontractor's work.
1.10.3 Violations
If recurring violations and/or gross violation indicate that the safety performance is unsatisfactory, corrective action must be taken as directed, and at the discretion of the Contracting Officer the retention or some part thereof will be withheld from the progress payment until corrective action has been completed.
1.10.4 Fire Prevention
Cutting or welding will be permitted only in areas that are or have been made fire safe. Where possible, all combustibles must be located at least 35 feet horizontally from the work site. Where such location is impracticable, combustibles must be protected with fire blankets and/or protective welding screens to prevent slag from running out of the work area. Edges of covers at the floor must be tight to prevent sparks from going under them. This precaution is also important at overlaps where several covers are used to protect a large pile. Do not allow any welding/cutting or open flame operations in facilities that are protected by a wet pipe fire sprinkler or an automatic detection system, if the system is out of service. First priority of work will be to return the suppression/detection system to operational condition. Return the fire detection and/or suppression system back to an operational status (if possible) during periods that the facility is unoccupied, and at the end of the work day. Post a fire guard for a 24 hour period (or certify to the Fire Department that the facility is safe) after welding, cutting, and open flame operations in a facility when: (a) fire detection and suppression system can not be returned to service; (b) fire detection or suppression systems do not exist. Other fire prevention precautions must be in accordance with the latest National Fire Codes.
1.10.4.1 Inspections
All construction sites are subject to fire and safety inspections without notice. Any violation of fire and safety standards may result in a work
Final Submittal SECTION 01 00 00 Page 7 Oct 29, 2019 stoppage at the expense of the Contractor.
1.10.5 Recordkeeping/Reporting Requirements
On all contract operations, record and report all accident exposure and experience incident work. (This includes exposure and experience of the prime contractor and sub-contractor(s)). As a minimum these records must include exposure work-hours and a log of occupational injuries and illnesses. (OSHA Form 300 or state equivalent as prescribed by 29 CFR 1904 ) Refer to EM 385-1-1, 01.D.04.
1.10.6 Accident Reporting
In addition to the requirements for reporting accidents in accordance with EM 385-1-1, Section 1, submit at the 50 percent point and 100 percent of project completion, a written summary of worker's compensation claims filed by workers on the project. The report will include all subcontractors.
The main report covering the Prime Contractor claims will be certified as "correct and true" by the Contractor's compensation insurance carrier. The same certification will be required for subcontractor reports.
1.11 PLANNED UTILITY OUTAGES AND STREET CLOSURES
All utility outages and street closures must be of as short a duration as possible and must be scheduled as far in advance as possible with the Contracting Officer, in no case less than 14 days before the outage or closure. Obtain from the Contracting Officer in writing a statement or schedule giving the permissible times of outages or closures for particular installations and the maximum time allowed for each. Strictly observe such schedules and the contractor will be held responsible for any violations.
1.12 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
This provision specifies the procedure for the determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.
MONTHLY ANTICIPATED ADVERSE WEATHER DELAY

(07) (06) (05) (04) (01) (00) (00) (00) (01) (02) (05) (07)
Upon execution of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day.
Refer to ER 415-1-15.
1.13 SPECIAL CONSTRUCTION PROCEDURES
1.13.1 Recreation/Community Mitigation
The following measures would be implemented to reduce the short term effects on Recreation and the Community:
a. Prior to construction, cooperate with the Contracting Officer in providing public outreach through mailings, posting signs, coordination with interested groups, and meetings to provide information regarding changes to recreation use and access.
b. Prior to construction, cooperate with the Contracting Officer as necessary in the coordination with local bike groups and alternative bike routes.
c. Before and during construction, place warning and restriction signs at construction areas and levee access points to notify users of ongoing construction and limits of use.
d. If there are trucks or equipment needing time to maneuver or access construction areas, or if directed by the Contracting Officer, station flaggers to slow or stop approaching vehicles, bicyclists, and pedestrians to avoid conflicts with construction vehicles or equipments and to maintain public safety.
e. Although, there would be short-term disruptions to recreation in the project area during construction, reduce the disruptions to a less-than-significant level with implementation of the mitigation measures.
1.13.2 Partnering
The Government intends to encourage the foundation of a cohesive partnership with the Contractor and its subcontractors. This partnership will be structured to draw on the strengths of each organization to identify and achieve reciprocal goals. The objectives are effective and efficient contract performance and are intended to achieve completion within budget, on schedule and in accordance with plans and specifications. To implement this partnership initiative, arrange, within 60 calendar days of Notice To Proceed, a one-day partnership development seminar/team building workshop that will cover at a minimum the following elements: Commitment, Trust, Communication, Roles & Responsibilities, Timely Responsiveness, Mutual Goals, Conflict Management, Dispute Resolution and project specific issues. Arrange for a meeting location to accommodate at least 40 people (i.e. made up of the Contractor's key on-site personnel, key subcontractors and key Government personnel) and hire a Facilitator to conduct the workshop. A Team Charter, along with a Workshop Report, must be developed and distributed to each participant at
Final Submittal SECTION 01 00 00 Page 9 Oct 29, 2019 the conclusion of the workshop.
1.13.3 Temporary Fence
Erect and maintain a temporary site fence. The fence must be at least a 6'-0" high chain link fence installed on metal posts. A vision inhibitor consisting of slats or other approved means, must be installed. The fence must be capable of withstanding wind loads of 60 m.p.h. without damage.
All materials and installation are subject to approval of the Contracting Officer's Representative. The fence must encompass the entire project site. The fence location and design must be submitted for approval. The submittal must provide detailed drawings and computations signed by a registered engineer. The layout will include the proposed location of access gates. Gates are to be locked at all times when the Contractor is not on site. For purposes of safety, provide tagged keys to the Marysville Fire Department. Clean the fence perimeter daily, both within the fence and outside of the fence to prevent any accumulation of trash and debris adjacent to the fence. The fence will be removed upon a written notice by the Contracting Officer.
1.13.4 Archaelogical Concerns
a. Survey the Limits of Work as shown on the drawings and monitor excavation activities at those locations to determine whether or not archaeological deposits are present. Deliver a survey/monitoring report to the Contracting Officer

1.13.7 Construction Sequencing
Two phases of the Marysville Ring Levee program, namely Phase 2B & Phase 3 are solicited as one construction project, to be constructed in three construction seasons. Phase 3 has been divided up into multiple Segments (A through E) and Phase 2B labeled as Segment D. Segments A, B, and C are base contract line items and Segments D and E are bid option items. Upon award of this contract, the base segments must be constructed in sequential order, beginning with Segment A. Segments B and C must not begin physical work sooner than year 2021, unless otherwise notified by the Contracting Officer. The bid options must be constructed as they are exercised.
Segments D and E must not begin physical work sooner than year 2021 and the options are exercised, unless otherwise notified by the Contracting Officer.
The phases will require coordination with other ongoing efforts for levee improvements. Notably, Phase 2C is immediately west of State Road 70 and is set to proceed prior to Phase 2B. Coordinate as necessary to ensure safe construction operations and maintain site access.
Phase 2B and Phase 3 share limits of work and will require overlap of cutoff walls. Overlap at the phase interface near Simpson Lane will require overlap between open trench and deep mixing method walls as shown on the plans. Likewise, Phase 3 has two additional transitions between open trench and deep mixing method that will require overlap.
It is anticipated that the open trench wall will be constructed prior to construction of the deep mixing method wall. However, the contractor may submit to construct the two phases and wall types in a preferred sequence pending government approval of the work plan related submittals included in sections 31 56 14 SOIL-BENTONITE (SB) CUTOFF WALL and 31 83 13 CUTOFF WALL

No additional compensation or extension to the Contract performance period will be given as a result of 5 mandatory work stoppages.
(1) In the event that the Contractor's work force is required to evacuate any part of the working area during working hours established by the Contractor for this contract, the Government will then make an adjustment under the clause entitled, FAR 52.242-14 SUSPENSION OF WORK, see Section 00 73 00. The Government's liability will be considered to be limited to reimbursement for loss of time of Contractor's employees and equipment which otherwise would have been employed on the job.
The completion time for any part of the work will not be extended if the total number of working hours of work stoppage does not exceed 0.8 times the number of calendar days in the period between the date of notice to proceed and the specified completion date.
In the event the Contractor is required to evacuate the area in excess of the time specified above, the completion times will be adjusted.
