The following have been modified:

INSTRUCTIONS TO BIDDERS

BID OPENING

The bid opening will be held at the U.S. Army Corps of Engineers, Room 125, 502 8th Street, Huntington, WV 25701. For date and time of bid opening, see Block 13 on Standard Form 1442. Upon arrival, attendees must check in with the security desk to have the guards contact Leah Morgan at ext. 5548 to submit your bid and be escorted to Room 125 for the bid opening.

PRICE BASIS

Bidders are advised that only bids submitted on a firm-fixed price basis will be considered, and that bids submitted on any other than firm-fixed price basis will be rejected.

Bid price alterations, i.e., crossed-out or white-out changes on the bid will not be accepted unless the change(s) is/are initialed.

BID QUANTITIES

Bids for less than specified quantities of each item in the Schedule will not be considered. Failure to submit a unit price for each item where required in the bid schedule will be considered as a material deviation from the requirements of the solicitation, and the bid will be rejected. (FAR 14.404-2)

ARITHMETIC DISCREPANCIES

(a) For the purpose of initial evaluation of bids, the following will be utilized in resolving arithmetic discrepancies found on the face of the bidding schedule as submitted by the bidders:

(1) Obviously misplaced decimal points will be corrected;

(2) In case of discrepancy between unit price and extended price, the unit price will govern;

(3) Apparent errors in extension of unit prices will be corrected;

(4) Apparent errors in addition of job and extended price will be corrected; and

(b) For the purpose of bid evaluation, the Government will proceed on the assumption that the bidder intends their bid to be evaluated on the basis of unit prices, extensions, and totals arrived at by resolution of arithmetic discrepancies as provided above and bid will be so reflected on the abstract of bids.

DETERMINATION OF RESPONSIBILITY

To ensure award is made to a responsible bidder, a determination of responsibility will be conducted. The apparent low bidder will be contacted by the Contracting Officer and will be required to provide the requested responsibility information within 4 calendar days. As part of this responsibility determination, the Contracting Officer will utilize the guidance contained in FAR 9.104-1. To be determined responsible, a prospective contractor must:

a. Have adequate financial resources to perform the contract or the ability to obtain them.

b. Be able to comply with the required or proposed delivery or performance schedule.

c. Have a satisfactory performance record.

d. Have a satisfactory record of integrity and business ethics.

e. Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them.

f. Has the necessary production, construction, and technical equipment and facilities, or the ability to obtain them.

g. Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

DEFINITIVE RESPONSIBILITY CRITERIA

In addition to examining the criteria in FAR 9.104-1, the Contracting Officer will also examine whether the apparent low bidder can meet the requirements of the following two definitive responsibility criteria. After bid opening, but prior to award, the apparent low bidder will be required to furnish documentation showing that the prime contractor or subcontractor(s) has/have completed:

a. No more than a total of eight (8) projects showing experience with placing at least a cumulative total of 75,000 cubic yards of mass concrete with 1.5 inch (or greater) aggregate and setting up and operating a batch plant in support of the project(s). Note that the quantity of concrete is the cumulative total of all submitted projects.

b. Two (2) projects showing experience directionally drilling through concrete and rock on a 1:150 tolerance as measured against a specified center line with real time survey and directional correction capabilities.

Firms may use prime or subcontractor (to be used on this project) experience to demonstrate experience with the definitive responsibility criteria, but the work performed by each entity on projects demonstrating that entity’s experience with the definitive responsibility criteria shall be the same as the work to be performed by that entity under this procurement. In order for experience to qualify under either of these criteria, the documentation must show that the experience was direct and not by-standing. By-standing means that the entity participated in a construction project but did not directly execute the features of work identified above. Personnel experience may be submitted as documentation to meet criterion (b) only. Should an entity intend to satisfy criterion (b) with personnel experience alone, the documentation must show that the entity is able to provide the necessary equipment to support the personnel in that role.

The apparent low bidder will have ten (10) calendar days after the Government’s request to submit the documentation demonstrating that it meets the above definitive responsibility criteria, and will receive award of the contract if otherwise eligible and responsible. If the apparent low bidder cannot provide this documentation, or if the documentation it submits does not show that it meets these criteria, the apparent next low bidder will be requested to provide this documentation. If this apparent next low bidder timely provides the documentation within ten (10) calendar days after the Government’s request, it will receive award of the contract if otherwise eligible and responsible. This process will be followed until the apparent low bidder who meets the requirement can document that it meets the definitive responsibility criteria or the Government cancels the solicitation.

SECTION 00 70 00 - CONDITIONS OF THE CONTRACT

The following have been modified:

52.236-4 PHYSICAL DATA (APR 1984)

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by surveys, core borings, etc., and previous construction at the site. Records consisting of drive sampling and core boring data gathered to determine the characteristics of the materials at the site have been compiled by the Government. Locations of borings and associated graphic logs are shown on the drawings.

Corresponding typed logs are included in Section 00 01 15 BORING LOGS. Subsurface exploration samples that were not consumed during testing, Borehole Image Processing Surveys, and foundation reports are available for examination by prospective bidders. Prospective bidders are encouraged to contact the Government to arrange for examination of all available data. Because of its nature and quantity, this material must be examined at the Huntington District Warehouse located at #9 27th Street, Huntington, WV 25702. The Contractor shall contact the Contracting Officer to make arrangements to view the core and referenced information.

(b) Weather conditions. The Contractor shall make his own investigations as to weather conditions at the site. The Charleston, WV, Weather Forecast Office is responsible for forecasts for the town of Hinton. The Blacksburg, VA, Weather Forecast Office is responsible for forecast for the town of Bellepoint and Bluestone Dam. The NOAA Weather Radio is transmitted on station WXM72 out of Hinton, WV.

(c) Transportation facilities. West Virginia State Routes 20 and 3 provide access to the project site.

(d) Location of Project. Bluestone Lake is located within Hinton, Summers County, West Virginia.

(e) Contractor's Responsibility. The Contractor will be held responsible for any and all damages attributable to the actions of the Contractor or its subcontractors outside the limits of construction, shown on the drawings or designated by the Contracting Officer. This shall include damage to existing roads, drainage structures, electrical or telephone facilities, pavement, and other structures and facilities. All such damage shall be repaired to the satisfaction of the proper municipal or state authorities by the Contractor and at his expense.

(f) Jurisdictions. All hauling over roads to and from the project will be subject to the approval of the proper municipal or state authorities; and the Contractor shall make the necessary arrangements, at its expense, with such authorities for the use of such roads, and shall comply with their requirements in connection with such use.

(g) Field Information. Contractors who desire an escort at the site or who require field information should contact:

Resident Engineer, HC78 Box 6C, Hinton, WV 25951, Telephone 304-466-6950.

(h) Floods. Attention is invited to the fact that the site of the work is subject to flooding at any time.

(i) Working Area and Times. The dam is operational 24 hours a day, 7 days a week. Government Operations personnel's normal work hours are Monday through Friday from 7:30 a.m. to 4:00 p.m. The Contractor's activity shall not impact the operations of the dam for the duration of the contract. The Contractor shall have access to the inside of the dam during the specified normal work hours. Access to the interior of the dam outside normal work hours will require specific arrangements to be made with the Contracting Officer and Operations personnel.

(j) Work Site Clean-up. No separate payment will be made for clean-up of the construction site following flood events.

(k) A video of lessons learned from a full scale anchor study conducted in 2002 entitled "Field Anchor Study Video Documentation and Directional Drilling Report" will be made available for viewing for the Contractor’s information. Also, a survey of potential directional drilling and borehole measurement technology was conducted by Fuller Mossbarger Scott & May, dated February 2005, which will also be made available for review. Prospective bidders are encouraged to contact the Government to arrange for examination of all available data. This material may be examined at the Huntington District Warehouse located at #9 27th Street, Huntington, WV 25702. The Contractor shall contact the Contracting Officer to make arrangements to view the core and referenced information.

“The Contractor shall adhere to the following Construction Restrictions.

(a) The Contractor shall perform the work in accordance with Section 01 00 00 CONTRACT CONSIDERATION, Paragraph CONSTRUCTION SEQUENCE.

(b) All components of the flow diversion system shall be installed, operational and approved by the Contracting Officer prior to stopping flow through dam sluice gates 1 through 8 for construction activities on the right side of the stilling basin. The Contractor can request right side flow stoppage when the diverter system is installed and other requirements of the specifications for dewatering of the basin have been met. Unless alternate limits are proposed by the Contractor and approved by the Contracting Officer, work requiring penstocks to be free of water such as manhole cover removal, debris removal, and siphon pipe installation must occur during the time interval between 1 December and 1 April when the lake is at a winter pool of Elevation 1406.

(c) Restrictions for construction of the right side of the stilling basin:

o All existing anchors of the right training wall shall be de-tensioned prior to dewatering of and

o Downstream cofferdam cells, transition, and granular cofferdam shall be constructed before the following can occur:

(1) Dewatering of and working in the stilling basin upstream of the stilling basin weir (the exception to this restriction is if the Contractor chooses to install cover plates at the downstream end of the stilling weir sluices in accordance with these plan and specifications)

(2) Notching of the stilling basin weir

(3) Dewatering downstream of the stilling basin weir o When the right side of the stilling basin is dewatered, the Contractor shall monitor the water level elevation on the outside of the right training wall. Should this water level elevation exceed Elevation 1381.0, the Contractor shall evacuate the right side of the stilling basin.

o At no time shall soil be placed against or retained by the right training wall.

(d) Restrictions for construction of the left side of the stilling basin:

o The first two anchors to be stressed in each of left training wall monoliths M94 through M100 shall be installed, tensioned and locked-off prior to dewatering of and working in the left side of the stilling basin upstream of the stilling basin weir.

o Downstream granular cofferdam and basin end wall shall be constructed before the following can occur:

(1) Dewatering of and working in the stilling basin upstream of the stilling basin weir (the exception to this restriction is if the Contractor chooses to install cover plates at the downstream end of the stilling weir sluices in accordance with these plan and specifications)

(2) Notching of the stilling basin weir

(3) Dewatering downstream of the stilling basin weir

Page 17 of 64 Pages o When the left side of the stilling basin is dewatered, the Contractor shall monitor the water level elevation on the outside of the left training wall. Should this water level elevation exceed Elevation 1381.0, the Contractor shall evacuate the left side of the stilling basin.

o For the left training wall, in addition to installing the required anchors prior to dewatering, the Contractor may choose to perform other work associated with this wall prior to dewatering. The Contractor shall be allowed to perform the other work while the left side of the basin is operational provided the following are met:

(1) At no time shall concrete demolition of the left training wall exceed the limits provided in the plans.

(2) At no time shall the soil elevation on the outside of the left training wall upstream of the stilling weir be lower than Elevation 1394.0.

(3) At no time shall the soil elevation on the outside of the left training wall be higher than the original wall height unless all anchors are installed, tensioned and locked-off in the wall including all anchors through the outside face and all anchors through the wall raise.

o The Contractor shall be responsible for the stability of the wall raise of the left training wall during construction and shall provide a work plan ensuring its stability for approval prior to initiating work on raising the left training wall.

(e) For construction of the right side of the stilling basin upstream of the stilling basin weir, the upstream transition of the cofferdam shall be anchored and the most upstream toe block of the cofferdam shall be constructed and anchored prior to initiating demolition of the existing apron and construction of the apron overlay and M34T2 base to Elevation 1368.0. For construction of the right side of the stilling basin upstream of the stilling basin weir, the apron overlay shall be constructed and anchored, M34T2 shall be constructed to Elevation 1368.0, and all toe blocks of the cofferdam shall be constructed and anchored prior to initiating concrete demolition of the existing apron below elevation 1363.0 (elevation 1358.0 at M34T2) and excavation of rock in the stilling basin. For construction of the left side of the stilling

Page 18 of 64 Pages basin upstream of the stilling basin weir, the apron overlay shall be constructed and anchored prior to initiating concrete demolition of the existing apron below elevation 1363.0 and excavation of rock in the stilling basin.

(f) The Contractor shall construct any necessary platforms for and install anchors in spillway monoliths M24 and M33 when the right side of the stilling basin is dewatered. The Contractor shall construct any necessary platforms for and install anchors in spillway monoliths M37 and M38 when the left side of the stilling basin is dewatered.

(g) No rock excavation will be performed within the basin until all planned and supplementary exploratory borings have been completed and final founding elevations and locations of line drilled faces have been confirmed for the side of the basin where work is being performed.

(h) Curtain grouting for the spillway monoliths will be completed prior to the placement of concrete for any new monoliths within the stilling basin.

(i) The Contractor shall perform drain reaming and cleaning as required in Section 31 32 25

REAMING AND CLEANING OF EXISTING INSPECTION

GALLERY DRAINS twice during the contract. The initial drain reaming and cleaning shall occur prior to the placement of concrete for any new monoliths within the stilling basin. The final drain reaming/cleaning shall be performed within the last year of construction and after all dam anchors have been installed.

(j) Anchor liftoff testing shall be completed no later than 31 December 2023.

(k) Contractor shall construct M34T1 prior to constructing M34T2 above Elevation 1368.0. The Contractor shall construct M77T1 prior to removing baffles in the stilling weir apron and constructing M77T2.

(l) Any structure used for dewatering, including but not limited to, the Government furnished cofferdam, the Contractor constructed cofferdam, the left training wall, the right training wall, the stilling weir, the divider wall, the basin end wall, and the granular cofferdam, shall have to meet the following requirements prior to mobilizing personnel or equipment into the dewatered area:

(1) All instrumentation shall be installed in the structure.

(2) The ADAS must be fully functional to monitor life safety.

(3) The work area must be dewatered for 14 calendar days to establish baseline readings for the instrumentation prior to mobilizing personnel or equipment. The 14 calendar days is in addition to the time estimates for ADAS installation and automation provided in Section 13 05 00 INSTRUMENTATION, Paragraph AUTOMATED

DATA ACQUISTION SYSTEM (ADAS) UNDER SEPARATE

CONTRACT.”

“The Contractor shall submit for approval by the Contracting Officer a plan designed and stamped by a professional engineer registered in the state of West Virginia, for a mooring system for all floating plant placed in the stilling basin. Tether lines shall be maintained on the floating plant to provide stability and to prevent uncontrolled movements that would threaten the safety of personnel and could damage equipment. The Government shall require the Contractor to evacuate personnel and floating plant from the stilling basin if crest flow is predicted, see Paragraphs STILLING BASIN FLOATING PLANT

EVACUATION DELAY, below. The Contractor shall evacuate personnel and floating plant prior to exceeding the Contractor mooring system design. This evacuation and delay shall occur at no cost to the Government.”

SECTION 01 00 00 – CONTRACT CONSIDERATIONS

10. Pages 4 and 5, Para. 1.4.4. Delete this paragraph in its entirety and replace with the following:

“Except as indicated for the left training wall in Section 00 80 00 SPECIAL CONTRACT REQUIREMENTS, Paragraph CONSTRUCTION RESTRICTIONS, the right side of the stilling basin including the divider wall and right overtopping protection shall be constructed before beginning construction on the left side of the basin. The Contractor may choose to perform work on the left training wall prior to completion of the right side of the stilling basin in accordance with Section 00 80 00 SPECIAL CONTRACT REQUIREMENTS, Paragraph CONSTRUCTION RESTRICTIONS. For the right side of the stilling basin, the Contractor shall receive final acceptance of the right side basin from the Contracting Officer prior to initiating construction of the left side. The right side will be considered acceptable when the divider wall is complete, is connected to the existing inspection gallery, all sumps pumps are installed and functional, both watertight doors are installed and functional, and the divider wall has passed the water leakage test. For the water leakage test, the Contractor shall fill the space between divider wall and cofferdam to Elevation 1391.0 for a continuous period of 7 days. If the combined leakage into the gallery of the divider wall and the dry side of the divider wall exceeds more than 10 gallons per minute or if the leakage in any joint exceeds 3 gallons per minute, the divider wall will not be accepted. In addition, all work within the cofferdam is to be complete except placement of scour protection material between main basin right and penstock left training walls and construction of the M24 sump collector.

However, work to place scour protection material and construct the sump collector

Page 22 of 64 Pages shall be conducted in the dry. Acceptance will not include electrical, mechanical, or instrumentation equipment in the interior of the divider wall gallery; this equipment will remain the responsibility of the Contractor until final acceptance of the stilling basin.

The Contractor shall repair any damage to equipment within the divider wall gallery caused by construction activities prior to final acceptance at no cost to the Government.

The new maintenance building and all appurtenant features to include security fencing, utilities, area lighting, etc., shall be constructed prior to initiating demolition of the existing maintenance building and appurtenant features, as shown on the drawings. The Contractor cannot demolish existing Maintenance Building until 30 calendar days after acceptance of the new Maintenance Building.”

“Operations will exercise the sluice gates twice a year. During this testing, it is anticipated that water from the sluice gates will be discharged into the main basin, approximately 450 cubic feet of water per sluice with a minimum discharge rate of 150-1000 gallons per minute per sluice. The Contractor can anticipate one day per event for exercising the sluice gates. No personnel will be allowed in the basin during this event. “A flow diverter system shall be developed by the Contractor in accordance with the contract drawings. The purpose of this system is to divert water from the lake, through the penstocks and penstock gates, to the penstock stilling basin, returning it to the river on the right side (east) near the mouth of Packs Branch. The intent of this system is to lessen the impact of flow alteration in the river as a result of construction on the right side of the main dam stilling basin. Unless alternate limits are proposed by the Contractor and approved by the Contracting Officer, this system must be installed and operating prior to stopping flow from the right side stilling basin for construction. Past this point, the system shall remain in operation at all times when dam sluice gates 1 through 8 are closed and no flow is present on the right side of the cofferdam. It is the Contractor's responsibility to ensure the system remains operational until such time flow can be reestablished from dam sluice gates 1 through 8. The Contractor is also responsible for removal of the flow diversion system when no longer needed and restoration to pre-construction condition of any areas impacted by installation of the flow diversion system. Submit designs, materials, equipment, installation and operations plans to the Contracting Officer

Construction of the flow diverter system will require removal of debris from within the penstocks; this material shall be disposed of in accordance with these specifications. Note that some portions of work associated with the flow diverter system must be completed with the lake elevation at winter pool (El. 1406) between 1 December and 1 April unless permitted otherwise by the Contracting Officer. Some portions of the penstocks are coated with paint containing lead; the Contractor shall take any steps necessary to comply with applicable Federal, State, local, laws and regulations and these specifications.”

SECTION 01 60 00.00 40 – MATERIAL AND EQUIPMENT

17. Page 8, Para. 3.9.1. Delete this paragraph in its entirety and replace with the following:

“An existing cofferdam to dewater the right half of Bluestone stilling basin is Government furnished for use by the Contractor. Upon award, the Government furnished cofferdam becomes the property of the Contractor. The cofferdam consists of five circular cells, four arcs, two transitions, a platform suitable for use only as a pedestrian walkway from the left training wall to the cofferdam, and is provided "AS IS." No warranty is provided for the cofferdam.

Dimensions and details of the cofferdam can be found in the For Information Only drawings, and no warranty shall be attached thereto or be implied by such drawings or other related documents. Upon completion of use of the Government furnished cofferdam, the Contractor shall remove the cofferdam in accordance with the drawings and specifications. Concrete and aggregate removed may be disposed of on-site in accordance with the drawings and specifications.

All other items shall be removed from the site.

The Contractor shall inspect the cofferdam, verify the condition of the cofferdam and acknowledge receipt, in writing, to the Contracting Officer prior to using the cofferdam.”

18. Page 9, Para. 3.9.3. Under the heading “Material Inventory – For Information Only” add the following to the end of the inventory list:

“3000 square feet of grating has been removed from the inventory.”

19. Page 10, Para. 3.10.2. Delete this paragraph in its entirety and replace with the following:

“The Contractor will be reimbursed in an amount not to exceed $3,000,000.00, for costs, provided that prior written approval for the cost was received from the Contracting Officer, if any, necessary to bring the Government furnished cofferdam up to current engineering standards only once from the time of acceptance until acceptance of right side of the stilling basin by the Contracting Officer. Any additional costs will be the Contractor's expense. Any amount not expended to bring the Government furnished cofferdam up to current engineering standards only once from the time of acceptance by the Contractor until 6 months after dewatering and inspection of the right side of the stilling basin shall revert to the Government. The purpose of the reimbursable cost is to bring the cofferdam up to current engineering standards once, if necessary, not to maintain current engineering standards.”

SECTION 01 78 00 – CLOSEOUT SUBMITTALS

20. Page 2, Para. 1.1. Under the heading “SD-02 Shop Drawings”, delete the paragraph in its entirety and replace with the following:

"As-Built" Drawings; G|DC Working “As-Built" Drawings; G|DC

Drawings showing final "as-built" conditions of the project. The manually prepared drawings shall consist of the approved marked working "as-built" prints and two color copies. Working “as-builts” shall be submitted in accordance with the specifications and final “as-builts” shall be submitted after all work is complete.”

21. Page 3, Para. 1.2.1.1. Delete the paragraph in its

“The Contractor shall revise digital PDF versions of working "as-built" drawings by red-line process to show the "as-built" conditions during the prosecution of the project. These working "as-built" marked drawings shall be kept current on a weekly basis, submitted to the Government every six months, and at least one set shall be available on the jobsite at all times. Changes from the contract drawings, which are made in the work or additional information which might

Page 26 of 64 Pages be uncovered in the course of construction, shall be accurately and neatly recorded as they occur by means of details and notes.

Final "as-built" drawings shall be prepared, in a digital PDF format, after all construction activities have been completed.

The working "as-built" marked drawings and final "as-built" drawings will be jointly reviewed for accuracy and completeness by the Contracting Officer and the Contractor prior to submission of each monthly pay estimate. If the Contractor fails to maintain the working and final "as-built" drawings as specified herein, the Contracting Officer will deduct from the monthly progress payment an amount representing the estimated cost of maintaining the "as-built" drawings.
