Award will not be made until all required approvals have been obtained and the award otherwise conforms to FAR 14.103-2.

1.2. DETERMINATION OF RESPONSIBILITY

1.2.1. IAW FAR 14.408-2, Responsible Bidder – Reasonableness of Price, the Contracting Officer shall determine that a prospective contractor is responsible IAW Subpart 9.1.

1.2.1.1. IAW FAR 9.104-1, to be determined responsible, a prospective Contractor must –

1.2.1.1.1. Have adequate financial resources to perform the contract, or the ability to obtain them.

1.2.1.1.1.1. Bidders shall provide the Contracting Officer with the relevant corporate financial information contained in Attachment 9 – Pre-Award Informaiton of the IFB. Failure to provide the financial information required with the bid shall be the basis to determine the bidder as non-responsible and eliminated from the award process.

1.2.1.1.5. Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

1.3. PRICE AND PRICE RELATED FACTORS:

1.3.1. PRICING EVALUATION

1.3.1.1. IAW FAR 14.408-2, the Contracting Officer shall determine that the prices offered are fair and reasonable before awarding the contract.

1.3.1.2. At bid opening, the Contracting Officer or designated representative, shall sum the total of each line item in

Section B in order to obtain overall contract price. Pricing obtained from SF 33 Section B will be compared to Exhibit C pricing. Mistakes or omissions in Exhibit C or Section B will be conducted IAW FAR 14.407 by the Contracting Officer.

1.3.1.3. The price analysis techniques in 15.404-1(b) may be used as guidelines and the price analysis shall consider whether bids are materially unbalanced IAW 15.404-1. Unbalanced pricing of individual line items contained in Exhibit C, Pricing/Bid Schedule may eliminate the bidder from consideration for award and be determined a non-responsible bidder if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

1.3.1.3.1. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly over or understated as indicated by the application of cost or price analysis techniques.

1.3.1.3.2. All line item pricing shall be evaluated among all bids received and against the Government Estimate.

A bid line item unit price difference of greater than or less than 20% for individual prices when evaluated against the Government Estimate may be determined as an unacceptable risk to the Government unless evaluation shows that all bidders submitted pricing is relatively equal when compared to the Government Estimate. Below is an example of unbalance pricing. Bidders C and E submitted the lowest priced bids, but evaluation of unit pricing shows that individual unit pricing is unbalanced and is an unacceptable risk. Bidder C’s submitted pricing is unbalanced as it is artificially low and presents undue risk for performance failure. Bidder E’s pricing is unbalanced as it poses an unacceptable risk for the Government.

UNBALANCED PRICING EXAMPLE

Unit Price A Unit Price B Award Total Bid Price Comp CLIN Total Bid Price Comp CLIN Total

Bidder A $4.50 -5.46% $112.50 $6.97 -2.11% $334.56 $447.06

Bidder B $5.75 20.80% $143.75 $8.57 20.37% $411.36 $555.11

Bidder C $3.74 -21.43% $93.50 $5.58 -21.63% $267.84 $361.34

Bidder D $5.15 8.19% $128.75 $6.64 -6.74% $318.72 $447.47

Bidder E $5.98 25.63% $149.50 $5.58 -21.63% $267.84 $417.34

Gov Estimate $4.76 $119.00 $7.12 $341.76 $460.76

1.3.1.4. As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six (6) months of the offeror’s final option period price to the offeror’s total price.

Offerors are required only to price the base and ordering (option) periods. Offerors shall not submit a price for the potential six month extension of services period. The Government may choose to exercise the Extension of Services at the end of any performance period (base or option periods), utilizing the rates of that performance period.

1.3.2. PRICE RELATED FACTORS

1.3.2.1. IAW FAR 14.201-8, the following Price Related Factors shall be evaluated prior to award as applicable:

1.3.2.1.1. Changes made, or requested by the bidder, in any of the provisions of the invitation for bids, if the change does not constitute a ground for rejection under 14.404.

1.3.2.1.2. No federal, state or local taxes shall apply to this bid. If requested, a project exemption certificate will be provided to purchase materials (dumpsters) state tax exempt.
