Please clarify

Offeror shall provide a narrative overview of their company’s prior contractual experience performing tasks. It is up to the company to determine how they will show experience in those areas.

Section 00 21 16, A.2.c.(i).2 “Relevant Corporate Experience”, states: “Seed Project technical Proposal”, states: “Offerors shall provide evidence of the following MA State Licenses/Certificates that are required to perform the seed project: Sheet Metal Installer’s Certification, Electrician, Plumber’s & Gas Fitter, and Confined Space Certification. Failure to possess all certifications will result in an unacceptable” technical factor rating and elimination from the award competition.”Requiring the submission of this information during the proposal submission stage of this solicitation is overly burdensome as selection of subcontractors sometimes occurs shortly before submission of the proposal.

Compiling this information into the proposal at the late stage is an unreasonable expectation. Please consider removing this requirement.

An extension has been granted and this requirement remains the above section requires evidence of Confined Space Certification, based on the scope of work represented in the “Seed Project Attachment 1 – Construction Drawings” there would not be any confined space work involved in the project. Please confirm this requirement.

Section 00 21 16, D.2.a, under FACTOR II: PAST PERFORMANCE, states:

Section 00 21 16, A.2.c.ii, under, VOLUME II – Past Performance Factor 2, states: “The Offeror will submit with its proposal the applicable subcontractor, teaming partner, and/or joint venture partner letter(s) of consent allowing the Government to disclose the past performance to the Offeror during negotiations.”. If the past performance information submitted is for projects completed by the Offeror only what letters of consent would be required, Please clarify this requirement.

If performed by the Offeror no letters of concent would be needed.

As Natick is a Federal installation please confirm that the General Contractor will not be required to possess the Construction Supervisor License (CSL).

Construction Supervisor License (CSL) is not required. Evidence that a contractor has obtained this license can be provided.

Section 00 21 16, A.2.c.iv.1.(d), “Company Points of Contact (POCs)”, states in part to provide: “…Unique Entity Identification (UEI) number and TIN for prime and subcontractors.”. Providing the UEI and TIN for the prime is not an issue but providing this information for all of the subcontractors during the proposal submission stage of this solicitation is overly burdensome as selection of subcontractors sometimes occurs shortly before submission of the proposal.

Compiling this information into the proposal at the late stage is an unreasonable expectation. Please consider removing this requirement.

This requirement will remain.

Section 00 21 16, A.2.c.iv.2, “Section 2 – Solicitation Documents”, states to provide: “Contract Administrative Data”, please clarify, what is this “Contract Administrative Data”?

Please clarify, what is the criteria for “principal program personnel”?

This is the Offeror's determination as to what makes the personnel qualified to perform the effort as outlined.

The “Attachment 3 - Seed Project SOW” document, in 1.3., states that “[t]he Contractor shall be responsible for performing all work as outlined in … all associated contract documents including Project drawings/specifications [emphasis added], dated 14 May 2025”. However, no project specifications dated 14 May 2025 have been provided, and, in fact, no specifications whatsoever have been provided and have been requested in a separate RFI. It is believed that project specifications do exist, per the emphasized wording above, AND due to the same document containing the statement “Specifications are provided via separate documents [emphasis added].” We, respectfully, request confirmation that the specifications have been developed, and if so, place an additional request that the specifications be provided by the Government.

Technical specifications are located in the performance work statement.

The “Attachment 3 - Seed Project SOW” document, in 1.3., states that “[t]he Contractor shall be responsible for performing all work as outlined in … all associated contract documents including Project drawings/specifications [emphasis added], dated 14 May 2025”. However, no drawings with that date have been provided as of today’s date (10 June 2025). We, respectfully, request that the Government please provide the referenced drawings.

Drawings are dated May 8, 2025.

The “Attachment 3 - Seed Project SOW” document, in 5.4.1, communicates, that for the fire protection scope, o erors are to “[s]ee fire protection drawings [emphasis added].” However, upon inspection of the only attachment provided with drawings, “Seed Project SOW Attachment 1 - Construction Drawings b.45 Seed Project (1)”, only has a single fire protection sheet (FP-100). We, respectfully, request that the Government please provide the additional fire protection sheets related to the seed project.

Fire Protection drawing is a single sheet.

The “Attachment 3 - Seed Project SOW” document, in 5.5.1, communicates, that for the fire alarm scope, o erors are to “[s]ee fire alarm drawings [emphasis added].” However, upon inspection of the only attachment provided with drawings, “Seed Project SOW Attachment 1 - Construction Drawings b.45 Seed Project (1)”, only has a single fire alarm sheet (FA-101). We, respectfully, request that the Government please provide the additional fire alarm sheets related to the seed project.

Fire Alarm drawing is a single sheet.

The “Attachment 3 - Seed Project SOW” document, in 5.6.1, communicates, that for the telecommunications scope, o erors are to “[s]ee telecommunications.” The reference is unclear as to what the Government is referencing. If, the Government intends to this as a reference, to be consistent with the other scopes, to telecommunications drawings, upon inspection of the only attachment provided with drawings, “Seed Project SOW Attachment 1 - Construction Drawings b.45 Seed Project (1)”, only has a single telecommunications sheet (TN-101). We, respectfully, request that the Government please provide the additional telecommunications sheets related to the seed project.

Telecommunications drawing is a single sheet.

It appears that there have been no IFC drawings provided for the seed project.

The only document provided with the solicitation, including Amendments 0001, 0002, and 0003, that contains drawings of any kind, “Seed Project SOW Attachment 1 - Construction Drawings B.45 Seed Project (1)”, does not contain any drawings that are signed and stamped by either an architect or an engineer.

We, respectfully, request that the Government please provide the S & S IFC planset for the seed project.

Drawings issued are not stamped and signed. Fire protection drawings will require design and stamp.

With the issuance of the solicitation, the document “Seed Project SOW Attachment 3 - Accident Prevention Plan TOC” was provided and is referenced in the solicitation document’s list of attachments (Section 00 72 00). The purpose of the attachment is unclear. It can be assumed that the Government intended the document to be a reflection of how it expects the seed project’s awardee to structure its Accident Prevention Plan. However, this is merely an assumption. We, respectfully, request clarification from the Government as to its intent in providing the attachment to bidders.

The government intended the document to be a reflection of how it expects the seed project’s awardee to structure its Accident Prevention Plan.

However, the solicitation references that 52.236-13, Accident Prevention, including Alternate I, is incorporated (by reference). According to 52.236- 13 (c), “If this contract is for construction or dismantling, demolition or removal of improvements [emphasis added] with any Department of Defense agency [emphasis added] or component, the Contractor shall comply [emphasis added] with all pertinent provisions of the latest version of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in e ect on the date of the solicitation [emphasis added].” First, the seed project includes construction and demolition scopes for a Department of the Army command building. Second, the “DATE ISSUED” of W911QY25R0003 was 14-May-2025, as communicated in block 3 (page 1) of its SF 1442. The latest revision of the USACE “Safety and Health Requirements Manual”, EM 385-1-1, in e ect on that date, and currently, is the 15 March 2024 major revision of the manual. Among the major changes that particular revision incorporated were the changing of the EM’s title to “Safety and Occupational Health Requirements” (not strictly in line with the clause), the structure of its contents from “Sections” to “Chapters”, the removal of appendices, and the overall restructuring of a project’s APP.

Therefore, the changes made to that latest version are applicable, and the “Seed Project SOW Attachment 3 - Accident Prevention Plan TOC” document is outdated (reflective of 30 November 2014 version) and out of compliance with the “latest version.”

Attachment 3 Accident Prevention Plan TOC has been provided as a reference document. Please see the updated attached EM 385-1-1 Safety and Occupational Health (SOH) Requirements. In accordance with 52.236-13 the Accident Prevention Plan shall be compliant with the latest version of 385-1-1.

We, respectfully, request that the Government provide an accurate and compliant APP TOC document, if what was intended with the attachment was for it to be the structure of the seed project’s APP.

The government intended the document to be a reflection of how it expects the seed project’s awardee to structure its Accident Prevention Plan.

On page 69 of 93 of the solicitation document, 8.2 references a “Master Safety plan” for the MATOC. We, respectfully, request that the Government provide what the Master Safety Plan is required to include, and what references, standards, regulations, or instructions govern its development and specify it as a requirement.

Please see question 147 for answers.

Page 69 of 93 of the solicitation also states in 8.2 that before “mobilization of a Task Order [sic] the Contractor shall furnish, as a submittal, his safety plan applicable to the project.” However, it is unclear whether this is a separate plan from the Accident Prevention Plan. It is confusing given the “Submittal Register” document (“Seed Project SOW Attachment 5 - Submittal Register”) provided with the solicitation does not identify a “safety plan” under the Division 01 – General Requirements as being required but does list the “Accident Prevention Plan (APP)” as a required “submittal.” We, respectfully, request that the Government provide clarification on whether it is using the two distinguishably di erent terms interchangeably, and the Government only expects a MATOC contractor to provide an APP prior to mobilizing on a project.

See attached submittal register.

In 9. Safety Assurance, and specifically, in 9.1 (page 70) of the solicitation document, the paragraph states that the “Safety Manual is available at the following web site [sic]: http://www.usace.army.mil/inet/usace-docs/eng-manuals/em385-1-1/toc.htm”. It is unclear what “The Safety Manual” is and what its relevance is to the MATOC. Also, the link is faulty. It leads to a USACE webpage that signals a “404 error page” that communicates an “Error Page Not Found” message. We, respectfully request that the Government provide background information as to what “The Safety Manual” is and how it is relevant to this MATOC and provide a legitimate, operational link to the manual, if relevant to the e ort.

This document has been provided.

On page 70 of 93 of the solicitation document, in 9.3, it identifies “temporary storage areas in accordance with EM 3To 85-1-1” (referencing the provision and maintenance of “extinguishers”). We, respectfully, request clarification from the Government if the distorted reference is intended to communicate EM 385- 1-1.

Government reference is intended to communicate EM 385-1-1. The revised document has been included.

Solicitation attachment document “Seed Project SOW Attachment 5 - Submittal Register” seems to indicate that it represents a “Submittal Register” for the seed project. However, it 1) does not indicate, in any way, what authority the “submittals” are to be provided to (i.e., U.S. Army Garrison DPW, DOR, G, etc.), 2) does not provide reference to specific sections of the relevant specifications, 3) cannot be compared or verified against specifications, and 4) indicates it is merely a checklist (see following for context). On page 3 of the attachment, the following note ends the document: “*This checklist [emphasis added] is provided for the Contractor’s convenience [emphasis added].

Contractor shall provide submittals as required by the documents [emphasis added] and to execute the design intent of the drawings.”It is understood that a Submittal Register is a requirement for Department of the Army construction projects. Furthermore, it is understood that the Submittal Register is traditionally in an ENG Form format, which is also incorporated into the project specifications, not typically referred to as a “checklist.” Due to the requirement, it is also not provided for “convenience” to the contractor, as it is utilized by both the Government and the contractor as an e iciency and documentation tool. The reference in the note that the “Contractor shall provide submittals as required by the documents” seems to reference the project specifications, but at the very least, includes more than just the subject attachment, as documents is plural. We, respectfully, request that the Government provide a legitimate, compliant submittal Register, developed by the DOR, as part of the design.

See attached submittal register.
