The offeror’s narrative must also address compliance with the Buy American Act and Berry Amendment provisions.
2.4. Volume 4: Contract Price Volume/Factor 4
a. The price volume shall contain the Offeror’s proposed prices which, if accepted by the Government, would become the firm fixed prices of the resulting contract between the Offeror and the Government.
b. Pricing Schedule. The Offeror shall enter its proposed prices into Attachment 0032 (See Section J), which is a spreadsheet and which is available from the contracting officer in electronic form.
c. Quantity Discounts. The Offeror is encouraged to propose terms under which larger order quantities receive discounted unit prices. Offerors proposing such terms shall enter their proposed quantity break points and corresponding unit prices in the appropriate worksheets of Attachment 0032. Offerors are cautioned that the Government does not desire unbalanced pricing.
(Unbalanced pricing and its associated risks are discussed at FAR 15.404-1(g)) The Offeror’s Price Factor rating shall be based in part on the Offeror’s quantity discounting terms. Offerors proposing quantity discounts shall do so with the understanding that the Government’s method for calculating total order price shall be: (total quantity ordered) x (unit price corresponding to total quantity ordered) = (total order price).
d. Best Estimated Quantities. In order to assist the Offeror’s preparation of its proposal, the
Government has provided its best estimated quantities (BEQ) for each CLIN in Attachment 0033 (see Section J). The Offeror is cautioned that the BEQs are strictly informational and shall not limit the Government’s right to order more or less than any BEQ, subject to Clause 52.216-19 -- Order Limitations (See Section I).
e. Total Evaluated Price. The Government shall apply the Offeror’s pricing and quantity discounting terms proposed in Attachment 0032 to the BEQs provided in Attachment 0033 to calculate a Total Evaluated Price (TEP). The Government shall evaluate the TEP for price reasonableness, in accordance with Section M of this solicitation. The Offeror’s Price Factor rating shall be based in part on the Offeror’s TEP.
2.5. Volume 5: Small Business Utilization Plan/Factor 5
a. The offeror shall submit a Small Business Participation Commitment Document (SBPCD) in order to identify the extent to which U.S. small businesses will participate in the performance of the proposed acquisition relative to the Government's small business objectives. Relative to the first objective in paragraph a., the following instructions are provided:
b. Large businesses may achieve their proposed small business participation commitments through subcontracting to small businesses. Small businesses may achieve their proposed small business participation commitments through their own performance/participation as a prime and also through a joint venture, teaming arrangement, and subcontracting to other small businesses. The following minimum quantitative requirements (MQR) in terms of Small Business Participation apply to this proposed acquisition: Small Business: {65%} of the total contract value; Small Disadvantaged Business (SDB):
{0%} of the total contract value; Woman-Owned Small Business (WOSB): {0%} of the total contract value; Historically Underutilized Business Zone (HUBZone) Small Business: {0%} of the total contract value; Veteran Owned Small Business (VOSB): {0%} of the total contract value; Service Disabled Veteran Owned Small Business (SDVOSB): {0%} of the total contract value. Note: Non-U.S. Based subcontracts are NOT exempt from the total contract value for the purpose of the SBPCD calculations. It is the Government’s expectation that the offeror will meet or exceed their proposed small business participation commitments during contract performance; good faith effort does not apply. Failure to meet or exceed proposed small business participation commitments will be reported in CPARS and may also result in contract default procedures. Offerors should thereby note that this is distinctly different than the Small Business Subcontracting Plan required for large businesses only.
c. Small Business Subcontracting Plan: In addition to the Small Business Participation Commitment Document, large business offerors must also submit a Small Business Subcontracting Plan meeting the requirements of FAR 52.219-9 and DFARS 252.219-7003 (or DFARS 252.219-7004 if the offeror has a comprehensive subcontracting plan). A Small Business Subcontracting Plan shall detail small business subcontracting goals that the offeror strives to meet during contract performance. Such goals must be equal to or greater than the commitments proposed in the Small Business Participation Commitment Document and must be challenging, realistic and attainable. It is the Government’s expectation that the goals proposed will be sought with good faith effort. Failure to meet or exceed proposed Small Business Subcontracting goals without sufficient justification in terms of the good faith efforts applied may result in the offeror paying liquidated damages to the Government IAW FAR 52.219-16 “Liquidated Damages – Subcontracting Plan”. Small businesses specifically identified in the Small Business Participation Commitment Document shall also be listed in any Small Business Subcontracting Plan submitted pursuant to DFARS 215.304(c)(i)(C). It is important to note that Small Business Subcontracting Plans are not evaluated as part of the source selection. Rather, they are reviewed only if the offeror’s proposal is selected as the apparent successful offeror representing the best value to the Government upon conclusion of source selection. Failure to submit and negotiate an acceptable Small Business Subcontracting Plan may result in the offeror’s ineligibility for award.
2.6. Volume 6: Administrative
The Offeror’s proposal shall include:
a. SF33: Offeror shall complete blocks 12 through 18 and signed by an authorized representative of the Offeror.

c. Section F: Offeror shall complete the "Time of Delivery (JUN 1997)" within FAR 52.211-8.
d. Section G: Offeror shall complete Sections G.4 and G.5.

L.5 DISCUSSIONS:
In accordance with FAR 15.306, the Government may conduct exchanges with Offerors after receipt of proposals, prior to award if award is made without discussions, or leading to the establishment of the competitive range.
Therefore, the Offeror’s initial proposal shall contain the Offerors best terms.
The Government reserves the right to award a contract based on initial submission without oral presentation, exchanges and/or discussions.
In the event the Government has not rendered a competitive range determination, the Government may conduct exchanges with Offerors to enhance the Government's understanding of proposals; allow reasonable interpretation of the proposal; or facilitate the Government's evaluation process. Such communications shall not be used to cure proposal deficiencies or material omissions, materially alter the technical or cost elements of the proposal, and/or otherwise revise the proposal. Such communications may be considered in rating proposals for the purpose of establishing the competitive range. Furthermore, such communications do not and shall not permit Offeror's to modify, revise, or otherwise change any element of their proposal.
In the event the Government does not award without discussions, the Government will render a competitive range determination and conduct discussions with only those Offerors remaining in the competitive range. In accordance with FAR 15.306(c), the competitive range will consist only of those offers that are the most highly rated offers, however, in accordance with FAR Part 15.306(c)(2) the number of proposals in the competitive range may be limited for purposes of efficiency. Therefore, the Offeror's initial proposal shall contain the Offeror's best terms.
In the event a competitive range has been rendered, Offerors shall be prepared to enter into discussions. For those Offerors in the competitive range, the Government will submit Discussion Items, which shall be answered by the Offerors. The Government may also utilize a competitive range to enter into price negotiations with the most highly rated Offerors.
Additional competitive range determinations may be made as needed during exchanges. A request for Final Proposal Revisions (FPRs), as described below, will be used to conclude exchanges. The Contracting Officer will request a FPR if needed from those Offerors remaining in the competitive range. The Contracting Officer will establish a common due date and time for the submission of FPRs.
If FPRs are requested, the Offeror's FPR will be evaluated in accordance with the evaluation criteria stated in Section M in the solicitation. Unexplained or inadequately explained departures from the previous submission may significantly impact the evaluation of the Offeror's proposal. The information in the FPR should be presented in a clear, coherent and concise manner. Vague or terse statements such as "will comply", "noted and understood", etc.
are not acceptable.
