JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. CONTRACTING AGENCY: U.S. Army Corps of Engineers (USACE), Alaska District, Contracting Division, Post Office Box 6898, Joint Base Elmendorf-Richardson (JBER), Alaska 99506-0898.
2. DESCRIPTION OF ACTION: This is a Limited Sources Justification for Other than Full and Open Competition to include a sole source name brand specification for the Delta Heating, Ventilation, Air Conditioning Direct Digital Control (HVAC DDC) Delta System for F-35 Aircraft Maintenance Unit (AMU) Administrative Facility, Eielson AFB, Alaska (EIE432).
Market research included a notice of intent for sole source item posted on the Federal Business Opportunities website (www.fbo.gov) and an internet search for the HVAC DDC Delta System.
3. DESCRIPTION OF SUPPLIES/SERVICES: This Limited Sources Justification is for the inclusion of a brand name specification for F-35 Aircraft Maintenance Unit (AMU) Administrative Facility at Eielson AFB, Alaska (EIE432). Eielson AFB has standardized the systems on the installation, requiring that all new construction specify installation of only the Delta HVAC DDC System. The use of the Delta HVAC DDC System is critical to the Government reliability mission and reduces redundant costs of multiple systems on Eielson by Plant Operations through utilizing using same DDC controller; thus minimizing multiple system integration. The estimated cost of the sole source name brand specification is for HVAC DDC Delta Controls for the AMU Administrative Facility. Approval authority is the Procuring Contracting Officer.
4. AUTHORITY CITED: This justification cites the statutory authority, 10 U.S.C. 2304(c)(1) or 41 U.S.C. 3304(a)(1)., as implemented by FAR 6.302-1(c), Application for brand name descriptions.. This justification applies the use of a brand name description.
5. REASON FOR AUTHORITY CITED:
a. Background: The Government’s mission on each military base or station is based on reliability and redundancy. To meet this mission, the Eielson AFB, as an installation has converted and is converting to a Delta Controls DDC system for monitoring and controling the HVAC sytems in all facilities on the installation. The DDC systems in each facility must have the capability to communicate with all systems on Eielson. Automation of building devices requires effective communication between the devices and the building control panels and/or workstations. The only system that will communicate within the Eielson AFB in controlling the HVAC within facilities is the Delta HVAC DDC System. Uutilization of the HVAC DDC Delta Controls will minimize cost expenditures; as it reduces duplication of multiple system repair parts.
b. Justification: The HVAC DDC devices and the controller must communicate with the existing installation-wide Delta Controls system. Installation of another manufacturer’s HVAC DDC product would not meet this requirement. Additionally, installation of another system would require substantial duplication of cost, that the Government would not expect to recover. These costs would include:
- Additional training for Eielson AFB technicians to learn a different system
- Requirement for stocking duplicate spare parts for different controls system
- Duplicate effort for installing software upgrades
- Modification of existing/future service contracts to include a different controls system
c. Impact: Failure to incorporate the requirement for compatibility with the existing Eielson AFB Delta HVAC DDC system will result in substantial duplication of cost to the Government that is not expected to be recovered through competition and would also impact mission capabilities as staff would be required to manually control the HVAC system in this building.
d. Alternatives: None. Specification of the Delta HVAC DDC System is essential to the Government’s requirements, precluding consideration of a product manufactured by another company.
6. EFFORTS TO OBTAIN COMPETITION: There will be competition between firms that sell the required name brand Delta HVAC DDC System. Based on market research there is more than one distributor/vendor for this system.
7. ACTIONS TO INCREASE COMPETITION: To ascertain whether existing manufacturers or new manufacturers entering the market have developed products or programming which will be compatible, interchangeable and competitive with the items identified in this document and currently in use, a sources sought notice was published in Federal Business Opportunities on 30 August 2018 using NAICS 236220 – Commercial and Institutional Building Construction.
The notices contained the Government’s intent to acquire the materials/systems included in this justification on a sole source basis for the F-35 Aircraft Maintenance Unit (AMU) Administrative Facility at Eielson AFB. One response was received in response to the Sources Sought which was evaluated on whether it was a comparable item to the Delta HVAC DDC System. The government technical representative determined the sources sough response/cut sheets were not similar/compatible products.
8. MARKET SURVEY: Market research through a notice of intent to sole source/sources sought was conducted to determine if there are other manufacturers who can fully meet the Government’s requirements. One response was received in response to the Sources Sought for the the Delta HVAC DDC System which closed on 14 September 2018.
9. INTERESTED SOURCE: In accordance with FAR 5.102(a)(6), “When an acquisition contains brand name specifications, the contracting officer shall include with the solicitation the justification or documentation required by 6.302-1(c), 13.106-1(b), or 13.501, redacted as necessary (see 6.305)”.
10. OTHER FACTORS:
a. Procurement History: The installation master plans have selected master/supervisory systems to comply with Air Force Installation Standardization Programs and minimize risks to life safety in emergency situations. These construction materials are required in RFP W911KB19R0008 for F-35 Aircraft Maintenance Unit (AMU) Administrative Facility, Eielson AFB, Alaska (EIE432).
b. Acquisition Data Availability: Not applicable.
c. Unusual and Compelling Urgency: Not applicable.
