SPECIAL PROVISIONS

Miscellaneous Paving Construction Contract

Fort Hood, Texas

Performance of Work Under the Contract:

a. Task Orders: Work under this contract shall be by issuance of individual task orders. The task order will indicate an Individual Job Order (IJO) Project Number, a specific scope of work and a lump sum total, supported by a bid schedule of items ordered.

b. Daily Activity Report:

Contracting Officer’s representative may request a consolidated activity report of all the active task orders from the contractor (s) at any time. The document shall be provided to the COR the following morning after requested by 8 a m. The format and content of this daily activity report shall be approved by the Contracting Officer prior to its use.

c. Bi-weekly Status Meetings: A bi-weekly status meeting will be conducted every other Wednesday, time and location to be determined. The Contract Manager, superintendents and Quality Control Manager will attend. This status meeting will provide the Government with current progress on all active task orders. A consolidated “work plan” will be maintained and updated one working day prior to each bi- weekly meeting. The Work Plan shall be formatted to identify each project by task order number on a Gannt-type progress chart to show the level of progress of each project, and critical phases (or inspection points) by date of occurrence.

d. Re-allocation of Work Priority: The Government reserves the right to re-prioritize the Contractor’s workload in the event of an emergency. Such actions will be accomplished by way of a written task order modification.

e. Government Delays in Performance: Should the Government delay work on a task order because of an unforeseen contingency, the Contractor shall determine the percentage of work completed (in accordance with the approved progress schedule and associated work plan), and supply the information to the Contracting Officer. The Government will make every effort to minimize any delay in the continuance of the work; however, if such delays become significant, the Contractor’s performance schedule will be adjusted by the number of days of delay. No work stoppages will be authorized under this contract.

Contractor Yards:

a. A prime contractor requiring an area for storage of materials and equipment shall submit a request in writing to the Contracting Officer. A contractor yard will be issued only to the prime contractor. Subcontractors will not be issued a yard. The prime contractor shall be responsible for providing an area within the assigned contractor's yard to subcontractors requiring storage areas. The size and location of a contractor's yard will be determined based upon the type of contract and work to be performed.

b. The Contractor shall confine all operations, including storage materials, on Government premises to specific areas authorized or approved by the Contracting Officer.

c. Building structures, fences, portable buildings, and utilities shall not be erected without prior approval from the Contracting Officer. Utility costs for contractor yards shall be paid by the Contractor at local prevailing rates. The Contractor shall sign a utility sales agreement with the utility sales officer at the Environmental Management Office, Building 4468. The Contractor shall provide and maintain utility meters for electricity and water usage.

d. All of the above erected items shall be removed at the completion of the contract. Final contract payment will not be made until the contractor’s yard is cleaned and returned to its original condition. If the prime contractor fails to return the site to its original condition, the Government will return the contractor's yard to its original condition and will withhold the cost for such work from final contract payment.

e. A legible sign containing the same information and appearance as the project sign shall be posted at the contractor's yard.

f. If the Contractor has additional valid contracts, as the prime contractor, with the Directorate of Public Works that require a yard, the original yard may be reassigned to the Contractor contingent upon the Contracting Officer's approval and placement of a valid sign. Being a subcontractor on another contract does not authorize the reassignment of a yard.

g. The Contractor's yard shall be maintained in accordance with Contract Specifications Section 01042:

ENVIRONMENTAL PROTECTION and appropriate FAR clauses. Contractor yards will be periodically inspected by representatives from Post Safety, Directorate of Emergency Services (Fire and Emergency Services), Environmental Management Office, and the Contracting Officer's Representative to ensure compliance with contract specifications. Contractors not maintaining yards in compliance with the contract specifications will be requested to vacate their assigned yard area.

h. Only materials and equipment used in the performance of this contract shall be stored at the contractor yard.

Site Cleanup:

In addition to requirements stated in FAR Clause 52.236-12, the contractor shall perform a weekly cleanup of each active work site. The contractor shall remove all accumulated construction debris (scrap material, spoils, and salvage materials) and dispose of these materials in accordance with approved disposal methods described in the contract specifications, and the clauses at Section 00800, Clause 52.000-4061, entitled Disposal of Waste Material, and Clause 52.000-4063, Recyclable and Serviceable Material. Cleanup includes general upkeep of the work sites (mowing, trimming, and weed control), the objective of which is to maintain each work site to present a neat and orderly appearance. Vegetation shall not exceed 8" in height.

Automated Data Processing Support Requirements:

a. The Contractor is responsible for obtaining, maintaining, and operating an automation system capable of electronic communication and information exchange functions with the Government. The equipment must be adequate to support Microsoft Office Suite 2003, and Intergraph/Bentley Products- Microstation Version VIII (or latest version). The Government is presently utilizing the Microsoft Outlook electronic mail operating system.

b. Digitized as-built drawings and backup information are to be transferred by way of CDRW.

c. Printer capability, as a minimum, must support both letter quality text and graphics with a 300 dpi resolution. Capabilities must support all required reports, forms, and diagrams as specified in the contract or as specified by the Contracting Officer. The Contractor is responsible for providing its own plotter for doing 3-size and larger plot requirements.

Record Drawings (DA Form 2877, AND DD Form1354):

a. During the execution of each task order and to facilitate updating of record drawings, the Contractor shall maintain a detailed record (vector graphics files (CADD)) of all changes and corrections from layouts shown on the provided drawings; or, as appropriate, the Contractor shall produce drawings of all work as completed. The Contractor will be required to complete a DD Form 1354 (Transfer and Acceptance of Military Real Property). Appendix B of AR 420-17 provide instructions for the completion of these forms.

The Contractor shall enter all such changes and corrections to the contract and/or record drawings promptly. Each sheet of the corrected set shall be stamped with the markings; “RECORD DRAWINGS AS BUILT.” At the time of completion of each project under this contract, and prior to final payment for task orders requiring as-built drawings, the Contractor shall provide an updated record drawing in electronic format on a CD or in an otherwise acceptable format prescribed by the Government.

a. The Final as-built drawings shall indicate, in addition to all changes and corrections, the actual location of all subsurface utility lines which were affected by or encountered during the work on the task order. The as-built drawings shall show, by offset dimensions to two permanently fixed surface features, the end of each run and the location of each change in direction. Valves, splice boxes, material types, and similar appurtenances shall be located by dimensions along the utility run from a reference point. The average depth below the surface of each run and type of material shall also be recorded. All information available about installed appurtenances shall be recorded and keyed to the installed location on the drawings. The final as-built and record drawings, and completed DD 1354 and DA 2877 shall be submitted to the COR for review and approval.

Contract Specifications:

An index for the Contract Specifications is shown under Specification Table of Contents (Attachment B). Some line items have specific specifications as denoted in the index. Other line item specifications are combined and covered in one specification. If no specification exists for a line item, the Government considers the description as self explanatory enough to not need a specification (e.g. Saw Cut Concrete 2” thick).

b. All milled asphalt will be re-laid with asphalt within 14 calendar days; all compacted road base must be surfaced with asphalt within 14 calendar days after compaction.
