Solicitation No. W91151-22-B-0009, Paving IDIQ Request for Information (Additional RFIs based of the Initial RFI Responses and Technical Exhibit Revisions)
1. Section 01 45 01.00 20 (Quality Control) requires a rather large QC crew considering there are three contractors sharing the workload. Can the government reduce the number of QCS to one?
NO.
2. Specification 01 45 01.00 20 states that the Quality Control Manager and Quality Control Specialist shall have completed the USACE Contractor Quality Management course within the last five years. Due to the Pandemic, the course had not been held within the past couple of years. Courses have now resumed with limited availability and USACE has offered temporary extensions on expired certificates to 22-Nov-2022. Please confirm DPW will recognize the dates provided in the Memorandum dated May 24, 2022 for, both, renewals and new certifications (see below).
DPW RECOGNIZES DATES PROVIDED IN BELOW. HOWEVER, MEMORANDUM
EXTENSION DATE IS 25 JAN 2023. AFTER DATE, THERE IS NO LONGER AN EXTENSION
PERIOD RECOGNIZED.
3. Specification 01 45 01.00 20 states that the Quality Control Manager shall possess ACI Concrete Field-Testing Technician Grade I or equal. Due to the pandemic, certification testing, such as certification with ACI, were put on hold and personnel were not able to recertify due to the non-scheduling of the certification and performance exams.
Now that most organizations resumed certification scheduling, it has been difficult to get personnel registered due to the limited availability of seats. Will the Government accept an individual with expired ACI certification until they are able to find a testing session with availability?
4. Specification 01 45 01.00 20 states the 4-Key personnel shall possess 30-hour OSHA 29 CFR 1910 safety course.
The OSHA 30-hour 29 CR 1910 course is for General Industry and the OSHA 30-hour 29 CFR 1926 is for Construction. Is it acceptable for the 4-key personnel to possess the 30-hour OSHA 29 CFR 1926 for Construction in lieu of the 30-hour 29 CFR 1910 for General Industry, being as it is more applicable?
YES.
5. Specification 01 45 01.00 20 states the Superintendent shall possess EM 385-1-1 training, the EM 385-1-1 does not describe what the learning objections of this training. Please clarify what type of training this is. Recommends the Government accept the 30-hour OSHA training and the annual eight (8) hours of documented formal, on-line, or self-study safety and health related coursework as stated in the EM 385-1-1.
40 HOUR EM 385 -1-1 SSHO TRAINING AND ANNUAL EIGHT (8) HOUR TRAINING.
INFORMATION CAN BE FOUND ON OSHA 360 WEBSITE.
6. Will Contractor Yards be made available to all participants of the MATOC?
NO. LOTS WILL BE AVAILABLE AS THEY BECOME AVAILABLE.
7. Bid Schedule: Traffic Control appears to be missing from the Bid Schedule. Where does the Government pay for this work? This item significantly varies from site to site.
THE BID SCHEDULE IS NOT INTENDED TO CAPTURE EVERY PRICED FUNCTION OF A
PROJECT. THE INTENT IS FOR OFFERORS TO PROVIDE AN ALL-ENCOMPASSING PRICE
FOR THE TYPE OF WORK LISTED. THOSE FUNCTIONS AN OFFEROR DEEMS
NECESSARY TO COMPLETE A TASK LISTED ON THE BID SCHEDULE SHOULD BE PART
OF THEIR PRICE FOR THE BID SCHEDULE TASK. THIS INCLUDES MANDATORY AND
OPTIONAL FUNCTIONS AS DETERMINED BY THE OFFEROR.
8. Bid Schedule: Mobilization appears to be missing from the Bid Schedule. Being as there are multiple participants to the MATOC, all participants may not always have active projects in the area. Where does the Government pay for mobilizations?
OFFERORS SHALL ADD INTO THEIR BID SCHEDULE PRICING ANY FUNCTIONS THEY
DETERMINE NECESSARY TO COMPLETE TASKS LISTED IN THE BID SCHEDULE.
FUNCTIONS THAT ARE NOT SEPARATELY PRICED IN THE BID SCHEDULE BUT ARE
NECESSARY FOR BID SCHEDULE TASK COMPLETION SHOULD BE CONSIDERED BY
OFFERORS AS THEY CREATE THEIR BID SCHEDULE PRICING.
9. Solicitation: Task Order Procedures state Award will be made considering only price. Will current workload and performance not be considered before awarding individual task orders?
THE GOVERNMENT SHALL CONDUCT A RESPONSIBILITY DETERMINATION PRIOR TO
THE AWARD OF ANY CONTRACT OR TASK ORDER. PART OF THIS DETERMINATION IS
VERIFICATION A CONTRACTOR IS ABLE TO COMPLY WITH TERMS AND CONDITIONS
OF THE AWARD AND HAS A SATISFACTORY PERFORMANCE RECORD.
10. Solicitation: Instructions to Offerors 1.1. Basis of Award states the IDIQ is being awarded to 2-4 bidders, considering only price. Can any consideration be made to the historical performance of bidders, so the Government has Contractors in the pool that have vast experience working with DPW? Only going with price could defeat the purpose of what Government appears to be doing with the IDIQ/MATOC.
THE SOLICITATION WAS ISSUED AS AN INVITATION FOR BID. APPARENT AWARDEES
ARE SELECTED BASED ON PRICE. AWARDS SHALL BE MADE TO THE RESPONSIBLE
BIDDERS WHO PROVIDE BIDS RESPONSIVE TO THE TERMS OF THE INVITATION FOR
BIDS AND ARE MOST ADVANTAGEOUS TO THE GOVERNMENT, CONSIDERING ONLY
PRICE AND THE PRICE RELATED FACTORS INCLUDED IN THE INVITATION.
11. IDIQ RFI Response #138 suggests Amendment #2 does not state The Government will use the bid schedule to determine maximum pricing. Page 2 of Amendment 2, second paragraph down, states “The Government shall use Technical Exhibit D – Bid Schedule (Informational) to serve as the maximum allowed price for the bidder to develop their final pricing position for each year task order issued”
a. Is the government using the line item pricing in Technical Exhibit D for maximum price or not?
b. If it is NOT being utilized for maximum pricing and is truly an aid for Contractors to develop their bid, why are we turning it in? What is it being used for?
TECHNICAL EXHIBIT D SHALL BE USED TO ENSURE AN AWARDED CONTRACTOR’S
TASK ORDER PROPOSAL PRICING DOES NOT EXCEED PREVIOUSLY SUBMITTED
LEVELS. AWARDED CONTRACTORS MAY PROPOSE FOR TASK ORDERS AT AN
AMOUNT BELOW THE LEVELS IN TECHNICAL EXHIBIT D BUT MAY NOT EXCEED
THOSE PRICES.
12. Several Government IDIQ RFI responses do not answer the questions of what line items are being utilized for payment of certain features of work. Per Amendment 2, our Tech. Exhibit D dictates the most we can charge for Line Items – this means we need to ensure each line item price given to the government includes the current amount of work.
c. Please re-answer the following RFI’s: 35, 37, 39, 46, 47, 48, 49, 50, 51, 65.

EXPECTED TO DO THEIR DUE DILIGENCE TO DETERMINE THE QUANTITY TO BE
