3. Price Factor: Offeror shall submit pricing in each of the CLIN tables in Section B above. Award is based on Price Only as stated in Section M below.

A. Ceiling prices for the base contract CLIN, referenced in each table in Section B above, apply to each proposed price.

B. Proposed pricing shall include shipment (i.e., FOB destination) with arrival at the final destination by the specified date (ref: Section F, above).

SECTION M: EVALUATION FACTORS FOR AWARD

1. The proposal evaluation and discussion procedures in FAR Subpart 15.3 (“Source Selection”) do not apply to this acquisition. The Government will follow FAR Subpart 16.505(b) (“Orders under multiple‐award contracts”) procedures.

2. The Government intends to award two delivery orders, resulting from proposals received in response to this document. The Government intends to award the 480m and 600m Wet Gap LOCBs to the offeror with the lowest evaluated price for those bridges. The Government intends to award the 400m Wet Gap LOCB to the other contractor, contingent upon the Contracting Officer’s determination that the proposed price is Fair and Reasonable. The Government may choose not to award a contract where the Contracting Officer concludes that the proposed price cannot be determined Fair and Reasonable. The Government may waive informalities and minor irregularities in the submitted responses.

3. Exchanges with Offerors after proposal submission.

A. The Government intends to evaluate responses and award the delivery order(s) without discussions/ clarifications with offerors. Therefore, the offeror’s initial response shall contain its best price.

B. The Government reserves the right to conduct clarifications with all offerors not otherwise rejected. These clarifications would allow for the Government to request and obtain additional information needed to enhance the understanding of, or reasonably interpret the proposal to facilitate the evaluation process. The following are examples, but not an all‐inclusive list, of clarification information that may be requested: additional other‐than certified cost or pricing data or technical information to support and confirm the proposed price, typographical errors, clarification of ambiguities or potential issues of concern, and an offeror's response to the intent of its proposal where an inconsistency exists. Any such clarifying information will not be considered proposal revisions. The Government may have clarifications with one or both offerors.

4. Award decision: The Government will only evaluate prices proposed by each offeror as described in Section 7 below: (1) Award will be made to the low price proposal for the 480m and 600m bridges; and, (2) award will be made to the other offeror for the 400m bridge, subject to the Contracting Officer determining the price Fair and Reasonable.

5. To be eligible for award:

A. The offeror shall be determined responsible.

B. After receipt of proposals, but prior to the evaluation process, the Government will perform a compliance review of the offeror’s proposal to determine the extent of compliance to the delivery order proposal request instructions, and whether the proposal meets any of the conditions listed in paragraph 6, Reasons for Rejection, below. The proposal must be in full compliance with the terms and conditions of this Delivery Order Proposal Request and the offeror’s base IDIQ contract (e.g., a proposal cannot exceed the base contract ceiling price).

6. Reasons for Rejection: The Government may reject any proposal if in the Government's best interest, which may eliminate the offeror from competition. Examples include, but are not limited to, the following proposal conditions:

A. When the Government cannot conduct an evaluation, because the proposal fails to provide information required in Section L, omitting significant material needed to conduct an evaluation.

B. The offeror’s proposal offers a supply and/or service that does not meet all stated material requirements of the solicitation.

C. The offeror's proposal takes exception(s) to the solicitation terms and conditions.

D. When the proposal is unbalanced as to cost or price. An unbalanced offer is one, with prices for one or more contract line item that is significantly over or understated. For this action, unbalanced pricing may exist if the proposed price for any of the three bridges is relatively high or low, considering the differences inherent to the different lengths.

E. When the proposal is late. Late proposals will be rejected and will not be evaluated. It is the responsibility of the offeror to ensure that its proposal is received in a timely manner. Offerors are responsible for submitting proposals, and any modification, or revisions, so as to reach the Government office designated in the solicitation by the time specified on page 1 of this document. Any proposal, modification, or revision received after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made;

the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt; or there is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or, It is the only proposal received. Proposals may be withdrawn by written notice received at any time before award.

7. Evaluation of Price:

A. The Government will evaluate the price using one or more of the price analysis techniques and procedures identified in FAR 15.404‐1. A price analysis will include consideration of the reasonableness, which is when a price does not exceed what a prudent person in the conduct of competitive business would incur.

B. If the Government enters into exchanges with offerors after receipt of proposals, then the Government reserves the right to request additional or more detailed information to support its evaluation of reasonableness. Therefore, in addition to the data in Section L, paragraph C.3, the Contracting Officer may require other than certified cost or pricing data pursuant to FAR 15.403‐ 3(c).
