About this file

This is a Questions and Answers document containing 102 questions and government responses related to solicitation W564KV25RA0002 for Family Advocacy Program (FAP) Victim Advocacy Program (VAP) and Emergency Placement Care (EPC) Support Services.

The questions seek clarification on key aspects including: staffing requirements and positions (particularly regarding the Contract Service Manager, Victim Advocate Trainer, and stateside positions), place of performance details for locations in Germany, Italy and Belgium, background check requirements, past performance criteria, training requirements, reporting timelines, and SOFA status considerations. Notable clarifications include that no stateside Victim Advocate position is required (contrary to previous listing), minimum staffing levels are outlined in PWS Attachment 2, and the Contract Service Manager must be located at IMCOM-E HQ in Wiesbaden. The government confirmed that subcontracting is prohibited for healthcare positions under Article 72 and interested companies must form joint ventures to ensure compliance with DOCPER/Troop Care regulations.

Services have been provided for VAP since 2020 through contract number W564KV‐20‐C‐0004.

2 If yes, would you kindly provide us with the Contract number?

Services have been provided for VAP since 2020 through contract number W564KV‐20‐C‐0004.

If no, would you kindly provide us with the latest Contract number that has performed this service or similar?

Services have been provided for VAP since 2020 through contract number W564KV‐20‐C‐0004.

4 Factor 2‐ Past Performance i Recency is the time period that past performance references must meet to be considered. A recent contract is a contract under which any performance, delivery, or corrective action has occurred within (3) three years prior to the solicitation release date, even if the contract award date is outside this (3) three year window.

Will the government consider revising this requirement to extend the recency period from three (3 years to five (5) years. Expanding the recency period would allow offerors to showcase a broader range of relevant past performance, potentially increasing competition and providing the government with a more diverse pool of qualified bidders

Solicitation was ammended to reflect recent performance recenty to within 10 years.

The Government anticipates that no less that the minimum staffing listed in this attachment is acceptable to ensure proper staffing is provided to meet the objectives of this PWS.

Can the government provide current staffing levels by base?

No, the governmet will not provide current staffing levels as the current contract is performance based without minimum staffing level.

6 PWS Attachment 6 ‐ Minimum Staffing The Government anticipates that no less that the minimum staffing listed in this attachment is acceptable to ensure proper staffing is provided to meet the objectives of this PWS.

9 SF 1449 Addendum to 52.212‐1, page 28, 2(b) references resumes. Are resumes of key personnel required with submission?

No, the intent of mentioning resumes in 2(b) was to state which docuemnts, if provided by the offeror, would not count towards the page limitation.

10 RFP Addendum to 52.212‐1, page 28,Part II Technical Offer “For Troop Care (TC) requirements, submit Troop Care Status Accreditation (TCSA) documentation for all proposed HCPs (for Germany and Italy only) IAW PWS 1.23.2 and submit documentation for proposed full time providers (based on total annual hours stated in the task order) IAWS PWS 1.23.3”.

All documents are due at the time of proposal submission.

11 RFP Addendum to 52.212‐1, page 35, Factor II “Relevant scope means contracts involving victim advocacy services to prevent domestic abuse through advocacy and training; as well as, providing response and advocacy to victims of domestic abuse and families in crisis.”

Will the Government revise this definition to consider other programs that are not VAP services but require comparable deliverables of similar complexity as being relevant to this program?

Relevancy section was updated to provide a broader explanation of relevant Victim Advocacy work such as involving advocacy and training services to prevent harmful behaviors such as domestic violence, sexual assault, child abuse, problematic sexual behavior in children, foster care, substance abuse or suicide; as well as, providing response and advocacy to families in crisis

Can the Government clarify if this is describing not only the reduction to task order price IAW FAR 52.246‐4 described under “penalty” but also an up to 30% invoice reduction described under “relapse”? Is the 30% monthly withholding a singular occurrence if remedied, or is this a permanen deduction for the life of the contract?

1. Table amnended to remove the term "task order"

2. it should be of the monthly price when defective price is provided.

3. section was also revised to replace 52.246‐4 for 52.212‐ 4(a).

13 PWS Attachment 6, page 49 identifies 16 total personnel including 13 Victim Advocate Local Hires, 1 Victim Advocate Stateside, 1 Victim Advocate Trainer, and 1 Contract Services Manager.

Are the Victim Advocate Trainer and Contract Services Manager also Stateside? Where is the place of performance for stateside employee(s)?

No, there is no DAVA or CSM stateside. PWS was revised to delete "stateside".

SOL #: W564KV25RA0002‐0003 Page 3 of 7 QUESTIONS AND ANSWERS

Incumbent Employees. If there is an incumbent, is there an incumbent contractor employee whom the awardee should consider for “right of first refusal” (i.e. Non‐displacement of Qualified Workers Under Service Contracts)?

The Government is not aware of any employee that would have "right of first refusal"

42 Quality Control Plan Does the Government want a management structure physically located in Europe?

No, just CSM at IMCOM‐E, currently Wiesbaden as specified in PWS 1.5.4.1 Place of Performance.

43 PWS PWS 1.5.4.1

Place of Performance: Contractor shall provide victim advocacy services at and around surrounding areas (50‐mile radius) near Army installations OCONUS (located in Germany, Italy and Belgium) as indicated in Attachment 2. The Contractor shall ensure the Contract Service Manager is located at Wiesbaden, Germany unless an alternate location in Germany is approved by the COR. The Government reserves the unilateral right to change where work is performed under this contract as necessary

Q1: Will the change of work location possibly encompass new military installations/communities that are not currently listed in this PWS or outside the current 50‐mile radius?

No, the change of work location will only encompass listed locations in PWS Attachment 2.

44 PWS PWS 1.5.4.1

Place of Performance: Contractor shall provide victim advocacy services at and around surrounding areas (50‐mile radius) near Army installations OCONUS (located in Germany, Italy and Belgium) as indicated in Attachment 2. The Contractor shall ensure the Contract Service Manager is located at Wiesbaden, Germany unless an alternate location in Germany is approved by the COR. The Government reserves the unilateral right to change where work is performed under this contract as necessary

Q2; If the answer to Question #1 (#43 in this list) is “Yes”, how much time will the contracting company be given to execute the move and how does the government expect to reimburse the contractor for additional costs?

The answer to the previous question (#43) was no.

45 PWS PWS 1.5.4.1

Place of Performance: Contractor shall provide victim advocacy services at and around surrounding areas (50‐mile radius) near Army installations OCONUS (located in Germany, Italy and Belgium) as indicated in Attachment 2. The Contractor shall ensure the Contract Service Manager is located at Wiesbaden, Germany unless an alternate location in Germany is approved by the COR. The Government reserves the unilateral right to change where work is performed under this contract as necessary.

Q3: Past experience regarding SOFA status for individuals employed in Belgium revealed that the Belgian government only allows for 100 individuals total (at any given time) to have approved SOFA status. Is the one position assigned to BENELUX already approved? If not, it is extremely possible that the individual will never be given SOFA status and the company will have to factor that into their cost proposal.

Yes, the one position assigned to BENELUX has been approved for SOFA.

46 PWS Attachment 2: Places of Performance: IMCOM‐E Headquarters: Victim Advocates (2); PSB‐CY PM: 1; PSBY‐CY Trainer 1. Q4: Are these 4 positions to be located in Sembach or Wiesbaden?

IAW revised PWS Attachment 2, only 3 positions are required for IMCOM‐E Headquarters, which is located in Wiesbaden. One position is required at USAG Wiesbaden as indicated in PWS Attachement 2.

Please note that IMCOM‐E and USAG Wiesbaden are separate locations within the same city.

47 PWS 1.5.4.1.1 Contractor Travel Any transportation in the area of contractor’s operation, will be required at the contractor’s expense to meet the requirements in the PWS.

Historical estimations are that 2,400 miles will be required using vehicle transportation; however, any overages of this estimated mileage will not constitute the contractor’s right for an equitable adjustment.

Is the Estimate for 2,400 miles total for the contract or for each Victim Advocate?

Per revised PWS 1.5.4.1.1 " Historical estimations are that 2,400 miles will be required using vehicle transportation on an annual basis."

48 PWS 1.22 Government Support ‐ SOFA SOFA Status and Individual Logistic Support is not guaranteed and contingent upon Host Nation Governmental Approval. If SOFA is not approved by the Host Nation Government for any contracted employee performing under this contract, this does not constitute the contractor’s right for an equitable adjustment; all taxes/costs related to the employment of the contracted employee are at the contractor’s expense.

Q1: This paragraph is confusing and can be interpreted many ways. It is extremely unusual for similar positions in a specific country not to be given the same status. This paragraph could be understood as that the government believes the Host Nation government will review each position separately. Is SOFA status and logistical support approved under Article 72 or Article 73 for the contract as a whole?

PWS 1.22, SOFA was revised to clarify that SOFA approval is not guaranteed as is on a case by case basis. Even if the positions listed in the contract as a whole could qualify under articles 72. More information about the SOFA process can be found at http://www.eur.army.mil/g1/content/CPD/docper.html.

Historically, most (not all) individuals hired to provide services under this requirement, have been approved for SOFA support. SOFA support will not be granted to individuals with voluntary experience; it must be "paid experience". Also, SOFA support will not be granted for individuals working for subcontractors.

49 PWS 1.22 Government Support ‐ SOFA SOFA Status and Individual Logistic Support is not guaranteed and contingent upon Host Nation Governmental Approval. If SOFA is not approved by the Host Nation Government for any contracted employee performing under this contract, this does not constitute the contractor’s right for an equitable adjustment; all taxes/costs related to the employment of the contracted employee are at the contractor’s expense.

Q2: If it is approved as a whole, this paragraph is now interpreted that each individual must be reviewed and may be denied SOFA status/logistical support. Is that the intent of the paragraph?

PWS 1.22, SOFA was revised to clarify that SOFA approval is not guaranteed as is on a case by case basis. Even if the positions listed in the contract as a whole could qualify under articles 72. More information about the SOFA process can be found at http://www.eur.army.mil/g1/content/CPD/docper.html.

Historically, most (not all) individuals hired to provide services under this requirement, have been approved for SOFA support.

50 PWS 1.22 Government Support ‐ SOFA SOFA Status and Individual Logistic Support is not guaranteed and contingent upon Host Nation Governmental Approval. If SOFA is not approved by the Host Nation Government for any contracted employee performing under this contract, this does not constitute the contractor’s right for an equitable adjustment; all taxes/costs related to the employment of the contracted employee are at the contractor’s expense.

Q3: If SOFA status/logistic support is not yet approved for the contract as a whole, it is impossible for the contracting company to estimate additional costs without knowing who and who will not be given individual SOFA status/logistical support. Will the government reconsider and allow for a Request for Equitable Adjustment?

No, requirement remains unchanged.

51 PWS 1.22 Government Support ‐ SOFA SOFA Status and Individual Logistic Support is not guaranteed and contingent upon Host Nation Governmental Approval. If SOFA is not approved by the Host Nation Government for any contracted employee performing under this contract, this does not constitute the contractor’s right for an equitable adjustment; all taxes/costs related to the employment of the contracted employee are at the contractor’s expense.

Q4: If SOFA status is granted, and organizational/logistical support provided, is DODDS tuition included? If so, this must be specifically delineated with Not to Exceed (NTE) amounts in the solicitation.

DODDS tuition is not included.

52 F Section 1.23.1 HCPs utilized under contract are subject to the current and ongoing requirements specified in Article 72, NATO SOFA Supplementary Agreement

(SA).

Is the Government aware of the fact that subcontracting is prohibited for Healthcare positions under Article 72 and that interested companies must form a Joint Venture to ensure compliance with DOCPER/Troop Care regulations?

A contractor using a subcontractor may perform the services if they choose, however, they will be subject to the full impact of host nation laws, regulations, taxation, and no logistical support. (Please see AE Reg 715‐9 Contractor Personnel in Germany‐ Technical Expert, Troop Care, and Analytical Support Personnel)

53 PWS Section 1.27.1 Specialized Work Experience Does the Victim Advocacy Trainer position require specific additional work experience or qualifications?

Victim Advocacy Trainer is not a required position. PWS was revised to delete this term.

SOL #: W564KV25RA0002‐0003 Page 4 of 7 QUESTIONS AND ANSWERS

54 PWS Section 1.28.2 Backfill/Absences: 1.28.2 The contractor shall provide adequate coverage at all performance locations IAW Attachment 2 and consistent with the requirements within the PWS.

What is considered “adequate coverage” as stated in the paragraph? PWS Section 5.2.1 defines response and follow up

55 PWS Section 1.28.2 Backfill/Absences: 1.28.2 The contractor shall provide adequate coverage at all performance locations IAW Attachment 2 and consistent with the requirements within the PWS.

Is there a percentage fill‐rate or other metric to measure this against? If so, will the government add it to the Technical Exhibit B Deliverables?

Contractor is expected to comply in providing all required minimum staffing IAW Attachments 2 and 6.

56 PWS Section 3.2

Government Property. Depending on availability, a Government vehicle may be provided. When Government vehicle is available, local procedure for dispatching the vehicle shall be followed. If a Government vehicle is not available, then the Contractor shall provide privately owned vehicle (POV) as stated in Part 4 of the PWS. The Contractor shall not use POV’s for the transportation of clients served within the PWS. If a Government vehicle is not available, then the contractor will not transport client

Are local national hires allowed to drive government vehicles? Language removed from PWS.

57 PWS Section 4.4 Vehicles and Equipment: The contractor shall provide transportation as stated in PWS section 1.12 to fulfill PWS tasks and duties via contracto arranged vehicles. The Contractor shall not use POV’s for the transportation of clients served within the PWS. If a Government vehicle is not available, then the contractor will not transport clients

Nothing is listed at PWS 1.12 – can the Government please clarify?

Paragraph clarified. Reference to paragraph 1.12 was deleted from paragraph 4.4.

58 PWS Attachment 1, pg 42‐43 Can the Government clarify what “workload data for the VA” refers to? How is this different from the “historical caseload from current contract?”

Workload Data column is VA case load. Column referencing "Historical" is meant to list Certified EPC Home Screenings.

Column title for "Historical" has been revised for clarity.

59 PWS Attachment 6 Minimum Staffing Level for VAP

60 RFP Past Performance

Is the Government open to revisiting the past performance requirements for this effort? The current criteria—requiring all three elements (scope, magnitude, and complexity) to be met for each past performance submission—significantly restricts competition. This is particularly challenging given the limited availability of contracts specifically related to OCONUS Victim Advocacy Services.

Please see revised criteria under 52.212‐2.

Will the Government consider adding FAR 52.222‐46‐ Evaluation of Compensation for Professiona Employees to the Solicitation to ensure professional employees are properly and fairly compensated by all Offerors?

No. Per FAR 22.1003‐1, the Service Contract Act only applies to service contracts performed in the United States.

The Contract Clauses, DFARS Clauses Incorporated by Reference

(Pg. 8) includes clause 252.204‐7012: "Safeguarding Covered Defense Information and Cyber Incident Reporting (DEVIATION 2024‐O0013 REVISION 1)". Government will identify during performance CUI material.

However, the contractor is expected to comply with CUI requirements under this clause if CUI information such as Personal Identifiable Information (PII) is provided to the contractor for necessary service performance.

63 PWS Section 1.5.4.1.1 Contractor Travel (Pg. 4) of the Performance Work Statement states: "Historical estimations are that 2,400 miles will be required using vehicle transportation..."

This represents the historical estimation of total miles required per Victim Advocate to meet PWS requirements for the contract on an annual basis. PWS section was revised to clarify that this is an annual estimation.

64 PWS Section 3.2 Equipment

(Pg. 22) of the Performance Work Statement states: "Depending on availability, a Government vehicle may be provided. Commercial Products and Commercial Services, Part III: FACTOR 2 ‐ Past Performance, (2) Past Performance Reference Narrative (Pg. 29) states:

"For relevancy consideration, the offeror may request the Government to consider the aggregate value of multiple recent contracts performed by the same entity within a 12‐month time period." Solicitation Section Addendum to 52.212‐1: Instructions to Offerors‐ Commercial Products and Commercial Services, FACTOR 2‐ Past Performance, ii‐ Relevancy, 2. (Pg. 35) states: "Contracts with an annual value less than the aforementioned value ($800,000.00) are not relevant and will not be considered. However, the Government may consider the aggregate annual value of multiple contracts performed by the same entity during similar time periods to determine whether the $800,000.00 threshold has been met."
