(4) Pricing assumptions. Summarize all significant pricing assumptions, scope limitations, exceptions and/or qualifications of the Price Proposal.

(5) Period for Acceptance of Proposals. The offeror agrees to hold the prices in its offer firm for 180 calendar days from the offer due date.

(6) This solicitation does not commit the Government to pay any costs incurred in the preparation and submission of offeror's proposal(s) or in making any necessary studies for the preparation thereof, or for any visit the Contracting Officer may request for the purpose of clarification of the proposal or for preparation for negotiations.

Addendum to Evaluation - Commercial Product and Commercial Services

FAR 52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES -

ADDENDUM

1. Basis for Award

(a) This competitive solicitation for victim advocacy services will use FAR Part 12 - Acquisition of Commercial Items, FAR Part 13 - Simplified Acquisition Procedures, and FAR Part 15 - Contract by Negotiation under the authority at FAR 13.5 as supplemented by the DFARS and AFARS; therefore, the offer that is determined to be the most beneficial to the Government given appropriate consideration to the following three (3) evaluation factors will be awarded: Technical Approach, Past Performance and Price.

The Government will consider the technical approach, past performance, and price in determining the best value. Past Performance will be evaluated initially as "Acceptable" or "Unacceptable". All proposals that are evaluated as "Acceptable" for Past Performance, will then be evaluated on the Technical and Price factors.

The technical approach and past performance factors, when combined, are approximately equal to price.

Offerors are cautioned that the award may be made to other than the lowest price offeror or the most highly rated proposal. The perceived benefits associated with the technical approach and price will be considered in the trade-off to determine best value. All proposals must meet the acceptability standards of all factors. In arriving at the award decision, the government will conduct comparative evaluations of the proposals as allowed under the Simplified Acquisition Procedures (FAR 13).

Additionally, the Government may incorporate into the contract, in whole or in part, performance or capabilities proposed above workload estimates or other attributes of a proposal deemed beneficial to the Government.

To be eligible for award, proposals must be compliant with all terms and conditions; the Price factor must be determined to be fair and reasonable; the Past Performance factor must be rated "acceptable"; the Technical Approach factor must be rated "acceptable" or higher; and the awardee must have an acceptable SPRS Risk Score.

2. Compliance (Part I)

(a) The SF1449, and any amendments if applicable, must be signed and dated, and any exceptions and/or assumptions noted.

(b) The proposal's pricing must be valid for at least days after the proposal due date.180

(c) Exceptions / Assumptions (if applicable) - the proposal properly identified all exceptions or assumptions.

(d) All required provisions and clauses are satisfactorily completed.

(e) The Offeror must have an active registration in SAM.gov under North American Industry Classification System (NAICS) Service Classification code 624190 - Other Individual And Family

Services

(f) Offeror's Supplier Risk Score (SPRS) must be "Green", "Purple", "Blue", or "Black".

Proposals that do not conform to the requirements of the solicitation may be rejected at any time after evaluation begins without any further evaluation, deliberation, or notice.

3. Evaluation Approach

(a) The Government intends to make a single award without discussions resulting from the evaluation of proposals in accordance with this provision and addendum. However, the Government reserves the right to conduct discussions.

(b) All proposals shall be subject to evaluation by a team of Government personnel. Contents of written proposals and written responses to Evaluation Notices (ENs) (if applicable) will be evaluated IAW with the criteria set forth below. No assumptions will be made by Government evaluators regarding areas not defined in the Offeror's written proposal.

(c) Prior to award, the Government shall make an affirmative determination of responsibility by analyzing whether the apparent successful proposal complies with the requirements of FAR 9.1. An apparent awardee found not to be responsible will not receive an award. The Government may directly determine the responsibility of the apparent successful proposal subcontractor(s) with the requirements of

FAR 9.104-4.

4. Evaluation Criteria

Factor 1. Technical Approach

Table 2 - Technical Risk Rating

Adje ctiva l Rat ing

Description

Low

Proposal may contain weakness/weaknesses which have low potential to cause disruption of schedule, increased cost, or degradation of performance. Normal contractor emphasis and normal Government monitoring will likely be able to overcome any difficulties.

Mod erate

Proposal contains a significant weakness or combination of weaknesses which may have a moderate potential to cause disruption of schedule, increased cost, or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome any difficulties.

High

Proposal contains a significant weakness or combination of weaknesses which is likely to have high potential to cause significant disruption of schedule, increased cost, or degradation of performance. Special contractor emphasis and close

Government monitoring will unlikely be able to overcome any difficulties.

Unac c e p table

Proposal contains a deficiency or a combination of significant weaknesses that causes an unacceptable level of risk of unsuccessful performance.

Evaluation Definitions:

Significant Strength: An aspect of a proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

Strength: An aspect of a proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance.

Significant Weakness: A flaw that appreciably increases the risk of unsuccessful contract performance.

Deficiency: A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

Uncertainty: Any aspect of a non-cost/price factor proposal for which the intent of the proposal is unclear (e.g., more than one way to interpret the proposal or inconsistencies in the proposal indicating that there may have been an error, omission or mistake).

FACTOR 1 -TECHNICAL APPROACH

The government will evaluate the proposal's technical approach used in addressing Element 1- Phase-in Plan, and Element 2 - Management and Staffing Plan as described in the addendum to 52.212-1 as each element applies to the PWS to determine an overall combined Technical/Risk rating for the Technical Approach factor.

FACTOR 1 - Technical Approach - This factor is divided into the following elements:

Element 1: Phase-In Plan

The Government will evaluate the required content as described in 52.212-1 addendum to determine the extent to which the phase-in plan is feasible and will result in successful execution of full contract performance at all locations within or before the end of the two (2) month phase-in period. The evaluation will take into consideration the proposal's approach in respect to:

- Employee Recruitment, Training, and Retention IAW 1.28 of all required personnel listed in PWS 1.10 IAW Specialized Work Experience PWS 1.27.1, and Attachment 6, Minimum Staffing Leve

- Provide a Contract Service Manager IAW PWS 1.10.1

- Background Check Reverification Requirements IAW PWS 1.6.2.3

- Identification of Contractor Employees IAW PWS 1.11

- Provide signed non-disclosure agreements IAW PWS 1.16

- Prepare to assume full responsibility of all areas of operation IAW Phase in/Phase out Period PWS 1.18

- For Troop Care (TC) requirements, submit Troop Care Status Accreditation (TCSA) documentation for all proposed HCPs (for Germany and Italy only) IAW PWS 1.23.2 and submit documentation for proposed full time providers (based on total annual hours stated in the task order) IAWS PWS 1.23.3

- Training and Certification, during the phase-in period to assure readiness prior to full performance under the contract IAW PWS 1.18

- Attend Post Award Meeting IAW PWS 1.29

- If the offeror is proposing to use subcontractor(s), a description of how services will be phased-in without SOFA logistical support.

Element 2: Management and Staffing Plan. The Government will evaluate the required content as described in 52.212-1 addendum to determine the extent to which the management and staffing plan is feasible and will result in successful performance of contract requirements in consideration of the following:

i. The measures taken to provide a quality program IAW PWS 1.5.1

ii. Development of work schedules, explanation of degree requirements, transfer policies, variety of catalogs and other materials with student-relevant information, listing of applicable fees IAW PWS 1.10.1, 1.27.1.1

iii. The approach to providing requested VAP services and required personnel throughout the identified places of performance IAW PWS 1.10, 1.27.1, 1.28, 5.1, 5.2, 5.3, 5.4, 5.5, 5.6, 5.7, 5.8, and Attachment 2.

iv. The proposal's approach to managing the program and operating under the Status of Forces Agreements (SOFA), to include seeking approval from an individual country's authorities such as Germany, Italy, and Belgium IAW PWS 1.22.

v. If the offeror is proposing to use subcontractor(s), a description of how services will be performed without SOFA logistical support and any incentives to be used to address attrition rates as a result of higher tax burdens to employees due to lack of SOFA logistical support.

FACTOR 2 - PAST PERFORMANCE

a. The Government will evaluate in the proposal, the record of past performance to ascertain the probability of successfully performing the required efforts of the PWS.

b. The Government will focus its inquiries on the offeror's (and major subcontractor's) record of performance as it relates to the solicitation requirements, including cost, schedule, performance and management of subcontractors. For the purposes of this evaluation factor, major subcontractors are defined as members of an offeror's overall team who are expected to perform 20% percent or more of the proposed effort. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, offerors will be reminded to include the most recent and relevant efforts in their proposal. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned a "neutral confidence rating" and its proposal will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State, Local, or foreign government or commercial contracts meeting the recency and relevancy criteria discussed further below.

c. If the offeror is a joint venture, the Government may consider relevant past performance information of the joint venture or individual joint venture members.

d. The past performance factor considers each proposal's demonstrated recent and relevant record of performance. The recency and relevance of the information, source of the information, context of the data, and general trends in contractor's performance will be considered. Relevant past performance will typically be a good predictor of future success and influence on the past performance acceptability assessment than not relevant past performance. A significant achievement, problem, problem resolution or lack of relevant data in any element can become an important consideration in the assessment process.

An adverse finding in any element or a lack of relevant data in regards to a performance issue may result in an overall past performance unacceptable assessment rating. The Government may also consider past performance that occurs after the RFP closing date and prior to award provided the contract meets the relevancy and currency requirements discussed below.

e. There are three aspects to the past performance evaluation: recency, relevancy, and quality. To be considered, past performance references must meet the recency and relevancy standards below.

i. Recency is the time period that past performance references must meet to be considered. A recent contract is a contract under which any performance, delivery, or corrective action has occurred within

(10) ten years prior to the solicitation release date, even if the contract award date is outside this (3) three-year window.

ii. Relevancy: The Government will evaluate the relevancy of past performance in terms of scope, magnitude, and complexity as follows:

1. Relevant scope means contracts involving advocacy and training services to prevent harmful behaviors such as domestic violence, sexual assault, child abuse, problematic sexual behavior in children, foster care, substance abuse or suicide; as well as, providing response and advocacy to families in crisis.

2. Relevant magnitude means contracts with an estimated annual value equal to or greater than $800,000.00. Contracts with an annual value less than the aforementioned value are not relevant and will not be considered. However, the Government may consider the aggregate annual value of multiple contracts performed by the same entity during similar time periods to determine whether the $800,000.00 threshold has been met.

3. Relevant complexity means contracts providing Victim Advocacy Services for the United States Government outside the continental United States (OCONUS) to include 24/7 victim response simultaneously to at least 5 separate installations.

Victim Advocacy for this requirement is considered to involve advocacy and training services to prevent harmful behaviors such as domestic violence, sexual assault, child abuse, problematic sexual behavior in children, foster care, substance abuse or suicide; as well as, providing response and advocacy to families in crisis.

f. There are two levels of relevancy as described in the table below:

Table 3 - Past Performance Relevancy Rating Method

Adjectival

Rating

Description

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Not Relevant

Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

g. Quality of Performance. The third aspect of the past performance evaluation is to establish the overall quality of the offeror's past performance. A separate quality assessment is not assigned.

h. Past Performance Acceptability Assessment: Using the table below, the Government will assess the acceptable confidence it has in the expectation that an offeror will perform the required effort based on the Offeror's demonstrated record of recent and relevant performance.

Note: In the case of an offeror without a record of recent and relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror will not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

Table 4 - Past Performance Acceptable/Unacceptable Ratings

Adjectiv al

Rating

Description

Accepta ble

Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown (see note above).

Unaccep table

Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Factor 3 - PRICE

Total Evaluated Price (TEP). The Government will evaluate offers for award by calculating a TEP for each offeror. The TEP will be calculated by adding the total price for all CLINs (phase-in, base period, and all option periods), the six-month option period allowed under 52.217-8 Option to Extend Services;

and if offered, GFP related charges. To account for the option period(s) possible under Clause 52.217-8, the Government will take the price for all CLINs of the last option year, prorate it to a six-month value, and add it to the sum of all CLINs. All unit prices that comprise the TEP are contractually binding.

Evaluation of options shall not obligate the Government to exercise the options. The offeror's proposed price must be determined fair and reasonable before receiving an award. An omitted price may result in offer elimination.

The price proposal will be evaluated for completeness, reasonableness, and balance.

1. Completeness: The Government will review the pricing submission for completeness and compliance with FAR 52.212-1 and its addendum. Incomplete price submissions may not be evaluated, and the proposal may be eliminated from the competition.

2. Reasonableness: The offerors price proposal will be evaluated based on the results of a price analysis, using the proposal analysis techniques and procedures as defined in FAR 15.404-1(b) and DFARS 215.404-1 to ensure a fair and reasonable price.

3. Balance: The Government will analyze the proposed prices for unbalanced pricing in accordance with FAR 15.404-1(g). An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.

Note 1: The Government will NOT evaluate the realism of offered prices.

Note 2: Offers submitted in response to this solicitation shall be in dollars. Offers received in other than dollars will be rejected.
