B-01 PRICE MATRIX
(a) The RFAAP price matrix is applicable to Government direct buys procured under the contract resulting from this solicitation, as well as third party orders that are received in support of systems contracts that utilize RFAAP components. Prices in support of third party orders shall not exceed the prices established in the RFAAP price matrix as a result of this competition, or if future unevaluated options are exercised and negotiated. This requirement is also applicable to any future products not currently on the matrix that are subsequently negotiated and added.
(b) All proposed prices shall be entered into the price matrix at Attachment 0019. If the Offeror is requesting indemnification, the appropriate matrix within Attachment 0019 shall be submitted as well.
(c) Unit prices under this acquisition shall not contain more than two (2) decimal places.
(d) Evaluation quantities and weights are included in the price matrix. The evaluation quantities and weights are estimates based on planning quantities at this time and are not obligatory under this contract; they are not binding and shall not be relied upon for execution purposes. Not meeting, or exceeding, the evaluation quantities should be expected and will not constitute revision of the price matrices or grounds for a request for equitable adjustment. If the Government's requirements do not result in orders meeting or exceeding the evaluation quantities, it shall not constitute the basis for a request for equitable adjustment or claim. All orders placed against this contract are subject to availability of funds.
(e) In the event unevaluated option periods are executed in the future, the RFAAP contractor agrees to utilize a mutually agreeable pricing curve, in lieu of range pricing, to establish prices for production items. Information regarding implementation of pricing curves in DoD acquisitions can be found at the following website:
https://www.acq.osd.mil/dpap/cpic/cp/contract_pricing_reference_guides.html
(f) Pursuant to FAR 52.215-23, Limitation on Pass-Through Charges, the Government will not pay excessive pass-through charges on the procurement cost of utilities under the RFAAP contract. The Contracting Officer will determine if additional excessive pass-through charges exist based on an analysis of the value the Contractor adds to its subcontracts.
(g) Economic Price Adjustment: All matrix unit prices are subject to an economic price adjustment in accordance with Narrative I-02, Economic Price Adjustment - Natural Gas and Narrative I-04, Economic Price Adjustment - Escalation.
(h) Non-Competitive Contract Actions: No profit or fee will be allowed on the actual purchase of utilities under non-competitive contract actions awarded under the contract resulting from this solicitation.
(i) FFP Delivery Orders (DO) and DO modifications will be utilized to place requirements for nitrocellulose, propellants energetic materials and components based on the quantities and the ordering period within which the DO is placed.
(j) Production Base Support (PBS) efforts (inclusive of Modernization projects) will be negotiated and awarded via separately priced
Fixed Price or Cost Reimbursable plus Fee (Incentive or Fixed) DOs or DO modifications. The successful awardee will not be permitted to charge costs associated with execution of the PWS scopes to Production Base Support efforts as direct costs or indirect allocations.
(k) New Facilities Under On-going Modernization Initiatives: The Government intends to share the most current information available regarding scope, schedule, status, and various other items for the modernization projects being executed by the incumbent operator that will be completed subsequent to award of the contract resulting from this solicitation. The transition of these new facilities to the successful Offeror will not constitute change conditions to this contract. Additionally, the Government will provide its best estimate of project completion dates, but actual completion dates may vary from these estimates. Delays in project completion will not constitute change conditions to this contract. Any variance in the actual date facilities are transitioned to production to those provided in support of this solicitation will not be grounds for a change condition, request for equitable adjustment, or claim.
(l) The Government may require modernization analysis, interface, engineering support, and the procurement of components and raw materials. Such efforts will be negotiated and awarded via separately priced Fixed Price or Cost Reimbursable plus Fee (Incentive or
Fixed) delivery orders or delivery order modifications.
(m) The contractor shall promptly propose fair and reasonable prices for components and/or propellants and nitrocellulose for third party contracts in support of any Government contract.
(n) All products presented for acceptance to the Government under the resultant contract shall be fully compliant with the TDPs provided with the solicitation. Any cost impact due to Government approved configuration change(s) during contract execution will be limited exclusively to the costs directly attributable to the change(s), require substantiation, and be negotiated in accordance with the
Changes Clause (52.243-1, Changes-Fixed Price).
