GENERAL CONDITIONS 02/11/2021

1.1 OCCUPANCY OF PREMISES

The Buildings are located within an active Air National Guard Base. The project must not impact operations to adjacent facilities and infrastructure. Buildings will be occupied during performance of work under this Contract.

Before work is started, arrange with the Contracting Officer a sequence of procedure, means of access, space for storage of materials and equipment, and use of approaches, corridors, and stairways.

1.2 SECURITY

a. All project work and construction activity shall comply with all installation security regulations and policies. The Contractor is responsible for confirming and following all current security requirements available through the Security Office.

b. The Contractor shall be aware that if security is heightened and the Installation goes into shut-down, all work must come to a complete stop.

c. See Section 01 14 00 WORK RESTRICTIONS, Subpart GENERAL SECURITY REQUIREMENTS for additional information.

1.2.1 GENERAL BASE ACCESS, CAMP MURRAY, WA

1.2.1.1 Contractors shall use the Camp Murray Commercial Gate, located immediately off the Interstate 5 off ramp for Exit 122, Berkeley St. The Commercial Gate is open from 8:00 am to 4:30 pm. After these hours contractors shall use the Camp Murray Privately Owned Vehicle Gate near the intersection of Berkeley St and Portland Ave SW in Tillicum, WA.

1.2.1 Contractors will be required to show driver’s license, vehicle registration, and proof of insurance. Vehicle passes and additional information can be obtained at the Camp Murray Security Office, Bldg. 33 on Camp Murray (immediately inside the Commercial Gate).

1.2.2 SPECIAL SECURITY REQUIREMENTS, SECURE AREAS

1.2.2.1 The Site Security Manager (Government) shall develop a Construction Security Plan (CSP). Construction Surveillance Technicians will supplement site access controls, implement screening and inspection procedures, as well as monitor construction and personnel.

1.2.2.2 For secure area renovation projects, the Contractor shall provide barriers to segregate construction workers from operational activities and provide protection against unauthorized access and visual observation. Specific guidance shall be contained in the CSP

1.2.2.3 Periodic security inspections shall be conducted by the SSM or designee for the duration of the project to ensure compliance with construction design and security standards.

1.2.2.4 Construction and design of secure areas should be performed by U.S.

companies using U.S. citizens to reduce risk, but may be performed by U.S.

companies using U.S. persons (an individual who has been lawfully admitted for permanent residence as defined in 8 U.S.C. 1-101(a)(20) or who is a protected individual as defined by Title 8 U.S.C 1 324b(a)(3)). The AO shall ensure mitigations are implemented when using non-U.S. citizens. These mitigations shall be documented in the CSP.

1.2.2.5 All site control measures shall be documented in the CSP. Among the control measures that may be considered are the following:

1. Identity verification

2. Random searches at site entry and exit points

3. Signs at all entry points listing prohibited and restricted items (e.g.

cameras, firearms, explosives, drugs, etc.)

4. Physical security barriers to deny unauthorized access.

5. Vehicle inspections.

1.2.2.6 Cameras

In secure areas, the Contractor shall not allow cameras nor photographs to be taken without written permission of the Contracting Officer, or for other than the purpose of meeting the requirements of Subpart CONSTRUCTION DIGITAL PHOTOGRAPHS of this section. See Section 01 14 00 WORK RESTRICTIONS, Subpart GENERAL SECURITY REQUIREMENTS for additional information.

1.2.2.7 Cell Phones

The Contractor shall not allow cell phones in secure areas on the installation or any other area identified by the COR or installation security.

1.3 SUPERINTENDENCE BY THE CONTRACTOR

a. At all times during the construction phase of the contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent project superintendent who is satisfactory to the Contracting Officer and has the authority to act for the Contractor. The Project Superintendent is subject to removal by the Contracting Officer for non-compliance with requirements specified in the contract and for failure to manage the project to insure timely completion. Furthermore, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken.

b. The project superintendent shall maintain a physical presence at the site at all times while construction activities are ongoing and be responsible for all construction and related activities at the site, except as otherwise acceptable to the Contracting Officer.

c. Failure to comply with these requirements shall be deemed as cause for a non-compensatory stoppage and suspension of work until the deficiency is remedied.

1.3.1 Duties and Qualifications of Superintendent

Have at least one qualified superintendent, or competent alternate, capable of reading, writing, and conversing fluently in the English language, on the job-site at all times during the performance of contract work. In addition, the other key personnel identified in this section must also have fluent English communication skills.

The project superintendent must have a minimum of 10 years experience in construction with at least 5 of those years as a superintendent on projects similar in size and complexity. The individual must be familiar with the requirements of EM 385-1-1 and have experience in the areas of hazard identification and safety compliance. The individual must be capable of interpreting a critical path schedule and construction drawings. The qualification requirements for the alternate superintendent are the same as for the project superintendent. The Contracting Officer may request proof of the superintendent's qualifications at any point in the project if the performance of the superintendent is in question.

The project superintendent is primarily responsible for managing and coordinating day-to-day production and schedule adherence on the project.

The superintendent is required to attend quality control meetings. The superintendent or qualified alternative must be on-site at all times during the performance of this contract until the work is completed and accepted.

1.4 PROJECT/SITE CONDITIONS

1.4.1 Site Security

The Contractor shall report any vandalism, suspicious activities or devices to the Contracting Officer and Camp Murray Security Forces as soon as possible. The Contracting Officer will notify the Contractor of any heightened security measures and will expect vigilant monitoring of equipment, grounds and security fencing while working. At a heightened security posture, there may be work areas that are restricted. The Contracting Officer will notify the Contractor of these restricted areas, and work may be delayed or restricted or will be performed in these areas under the direct supervision of the Contracting Officer or other government assigned personnel.

1.5 WORK SEQUENCE AND SCHEDULING

1.5.1 Work Sequence

1.5.1.1 General

There are certain essential criteria relative to the preparation of a work sequence and time schedule which the Contractor will be required to implement and follow during the prosecution of the work. Minor variations in the sequence of the items of work as specified may be made by the Contractor, provided such variations do not conflict with critical elements of the schedule. Proposed minor variations shall be noted on the progress schedule. Variations shall be approved by the Contracting Officer prior to implementation. Note that event dependencies and nominal dates will change depending on the executed options.

1.5.1.2 Initial Project Schedule

The initial project schedule shall be in the form of a chart graphically indicating the sequence proposed to accomplish each work feature or operation pursuant to FAR Clause 52.236-15 "Schedules for Construction

Contracts". Show in the schedule the proposed sequence to perform the work and dates contemplated for starting and completing all schedule activities. The chart shall be prepared to show the starting and completion dates of all work features on a linear horizontal time scale beginning with date of Notice to Proceed and indicating calendar days to completion. The scheduling of the entire project is required. Provide a schedule that is a forward planning as well as a project monitoring tool.

The Contractor shall indicate on the chart the important work features or operations that are critical to the timely overall completion of the project. Key dates for such important work features and portions of work features are milestone dates and shall be so indicated on the chart.

Failure to develop the Project Schedule to an appropriate level of detail will result in its disapproval. The Contracting Officer will consider, but is not limited to, the following characteristics and requirements to determine appropriate level of detail:

1.5.1.2.4.9 Show Government and other agency activities that could impact progress. These activities include, but are not limited to: approvals, acceptance, design reviews, environmental permit approvals by State regulators, inspections, utility tie-in, Government Furnished Equipment (GFE), etc.

This schedule will be the medium through which the timeliness of the Contractor's construction effort is appraised. Anticipated adverse weather delay days shall be included in the schedule. Submit the Initial Project Schedule for approval within 30 calendar days after notice to proceed is issued.No payment will be made for work items not fully detailed in the Project Schedule. An Early Completion Schedule is an Initial Project Schedule (IPS) that indicates all scope of the required contract work will be completed before the contractually required completion date. No IPS indicating an Early Completion will be accepted without being fully resource-loaded (including crew sizes and manhours)

SECTION 01 11 00 Page 7 and the Government agreeing that the schedule is reasonable and achievable. The Government is under no obligation to accelerate work items it is responsible for to ensure that the early completion is met nor is it responsible to modify incremental funding (if applicable) for the project to meet the contractor's accelerated work.

1.11.3.2.1 Periodic Schedule Updates

An updated schedule showing actual progress shall be submitted monthly and with each pay request. Changes to the base-line schedule shall be outlined in a narrative describing the reason for the change.

1.5.1.3 Scheduling and Service Interruptions

All work shall be carefully scheduled to minimize interruption of any installation services. Contractor shall maintain continuity of communication systems operation throughout execution of the work. The Contractor shall make written request to the Contracting Officer for approval of all work requiring isolated utility shutdown 7 calendar days prior to commencement of such work. Isolated utility shutdowns shall be in accordance with this section's subpart "Planned Utility Outages and Interruptions".

1.5.2 Organization at the Site

1.5.2.1 General

The Contractor shall employ ample personnel and sufficient equipment to accomplish the work of this contract in the least amount of time, within the prosecution period specified in SPECIAL CONTRACT REQUIREMENTS, Clause

COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK (APR 1984) FAR 52.211-10.

1.5.2.2 Rate of Progress

Should the Contractor fail to maintain a satisfactory rate of progress in accordance with the Contractor's approved progress schedule, the Contracting Officer may require that additional personnel and equipment be placed on the work and weekend and overtime work be performed, in order that the work be brought up to schedule and maintained, and at no additional cost to the Government.

1.6 CONTRACTOR'S USE OF FACILITIES AND HAULING ROUTES

See Section 01 14 00 WORK RESTRICTIONS, Subpart CONTRACTOR ACCESS AND USE OF PREMISES for information supplemental to this subpart.

The Contractor shall be responsible for the following:

(1) Determining the trucking and hauling routes and associated restrictions to and from the work, to include the coordination for the use of such routes with local, State, and Federal authorities.

(2) Complying with all local, State, and Federal regulations and restrictions when using any facilities or hauling routes.

1.7 CONTRACTOR USE OF PREMISES

1.7.1 Protection and Safety

a. Protection to Contractor personnel or their equipment cannot be provided by the Government at the worksite nor at the travel routes to/from the worksite.

b. The Contractor shall protect all workmen, civilian and military personnel and the general public from injury. The Contractor shall coordinate and schedule all work with the Contracting Officer.

c. The Contractor shall conduct all work so as to cause the least interference possible with the normal activities of the installation.

1.7.2 Installation Regulations

Ensure that Contractor personnel employed on Camp Murray Air National Guard, Washington become familiar with and obey base regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Do not enter any restricted areas unless required to do so and until cleared for such entry. The Contractor's equipment shall be conspicuously marked for identification.

1.7.3 Subcontractors and Personnel Contacts

Furnish a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.

1.7.4 Access to the Site and Storage/Staging Areas

Access to the project site is available for construction traffic. The Contractor is responsible for maintaining access necessary for its equipment, material, and plant to and from the work area.

Access to temporary facilities and storage/staging areas shall be as specified in Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS and as shown on the contract drawings. Also see Section 01 14 00 WORK RESTRICTIONS, Subpart SITE ACCESS.

1.7.5 Temporary Facilities and Utilities, and Storage Areas

The Contractor shall conform to Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS regarding temporary facilities, temporary utilities, and storage areas. Confine all operations (including storage of materials) on Government premises to areas authorized or approved by the Contracting Officer. The Contractor shall hold and save the Government, its officers and agents, free and harmless from liability of any nature occasioned by the Contractor's performance.

1.7.6 Work Limits

Work shall be restricted to the areas shown on the contract drawings and to storage areas as indicated in Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS. Travel through any other parts of the installation or into any other buildings of Camp Murray, Washington by Contractor personnel will not be permitted unless under escort by a Government employee.

1.7.7 Work By Other Contractors

During the performance period of this contract, no other work is anticipated to occur by other contractors.

1.7.8 Emergency Contacts

The Contractor shall provide a list of emergency contacts to be used in the event of an emergency. The list shall include the contact names, SECTION 01 11 00 Page 9 addresses, and telephone numbers. As changes occur and additional information becomes available, correct and change the information contained in previous lists.

1.7.9 Damaged Property

Work shall proceed in a manner which will minimize disturbance or risk of damage to structures and surrounding lands. The Contractor shall repair such items damaged in the course of carrying out the work at no additional cost to the Government. All repairs shall match similar existing items in all aspects. All replacements shall be in kind.

1.7.10 Contractor's Receipt of Supplies

The Contractor shall be responsible for all arrangements for the receipt of materials and supplies at the job site. Government personnel are not permitted to receive or sign for items delivered to the site. See Subpart TRANSPORTATION, HANDLING AND STORAGE of this section.

1.7.11 Daily Clean Up

The Contractor shall at all times, keep the premises free from accumulation of waste materials or rubbish caused by work under this contract. At the end of each work day and upon the completion of all work, the Contractor shall leave interior and exterior property in neat and clean condition.

1.7.12 Government Sanitary Facilities

Toilet facilities are not available on site for the Contractor's use. The Contractor shall provide portable toilets for its personnel and subcontractors as specified in Section 01 50 00 TEMPORARY CONSTRUCTION

FACILITIES AND CONTROLS.

1.7.13 Unit Training Assemblies (UTA)

One weekend per month is a military Unit Training Assembly for the Air National Guard. On these weekends, there is a surge of off base personnel that come to work and train on the base. The Contractor shall ensure that prior to these weekends the project sites are cleaned, unused materials consolidated, open trenches filled or covered, maximum parking places are available, traffic routes open, etc. The dates for the UT s will be discussed at the Pre Construction Conference.

1.8 ON-SITE PERMITS

1.8.1 Utility Outages

See Section 01 14 00 WORK RESTRICTIONS, Subpart "Utility Cutovers and Interruptions".

1.8.2 Utilities Not Shown

If the Contractor encounters, within the construction limits of the project, utilities not shown on the drawings and not visible as to the date of this contract and such utilities will interfere with construction operations, the Contractor shall immediately notify the Contracting Officer and the Camp Murray Civil Engineering Office (Building 106) in writing to enable a determination by the Contracting Officer as to the necessity for removal or relocation. If such utilities are removed or relocated as directed by the Contracting Officer, the Contractor shall be

SECTION 01 11 00 Page 10 entitled to equitable adjustment for any additional pertinent work or delay.

1.8.3 Welding; Hot Work Permits

Permits to perform welding work shall be requested 14 days prior to the work and shall be posted at a conspicuous location in the construction area. See Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS, Subpart HOT WORK for additional requirements.

1.9 QUALITY ASSURANCE

a. All items of work not addressed in the contract documents shall be completed in strict accordance with the manufacturers’ specifications.

b. The Government is not obligated to inspect the Contractor’s work, or to protect the Contractor from the consequences of its work. Government inspections are a general examination of the Contractor’s conduct and workmanship and are solely for the purpose of the Government.

Government-designated Quality Assurance Representatives (QARs) do not have the authority to accept work, nor is a Government inspection to be construed as conclusive.

c. Government agents including QARs and project engineers are not authorized to change the contract without the written approval of the Contracting Officer; this lack of authority extends to all situations in which the action of these agents could be construed as constituting a change.

d. The quality of workmanship is subject to audit by Government or Government-designated QARs at any time during the contract. The Contractor shall cooperate fully and provide all information necessary for this audit.

e. The Contractor shall submit all requests for changes in writing to the Contracting Officer. Do not proceed with changes without possession of written authorization of the Contracting Officer.

f. The Contractor shall not conceal any work unless the Contracting Officer has approved all items of work which are to be concealed. The Contractor shall notify the Contracting Officer of its intention to conceal work at least 24 hours in advance of concealment.

1.10 GENERAL SAFETY REQUIREMENTS

1.10.1 General

a. The Contractor shall take all necessary precautions in observing safety regulations in accordance with Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS and EM 385-1-1, and shall assume the responsibility to guard against causing of fires and/or explosions and to protect Government property. The Contractor shall perform the work in a manner consistent with security and with fire safety regulations especially with regard to exits and exit way access. Temporary closures shall not compromise life safety, security or fire safety.

1.10.2 The Prime Contractor's Superintendent

The Prime Contractor's superintendent shall take an active role in enforcing the safety requirements by participation in safety conferences, hazard analysis (see below), tool box meetings, walk-through inspections, correction of violations, etc., and including that of the subcontractor's work.

1.10.3 Violations

If recurring violations and/or gross violation indicate that the safety performance is unsatisfactory, corrective action shall be taken as directed, and at the discretion of the Contracting Officer the retention or some part thereof will be withheld from the progress payment until corrective action has been completed.

1.10.4 Elevated Work Areas

Workers in elevated work areas in excess of six feet above an adjoining surface require special safety attention. In addition to the provisions of EM 385-1-1, the following safety measures are required to be submitted to the Contracting Officer. Prior to commencement of work in elevated work areas, the Contractor shall submit drawings depicting all provisions of his positive protection system including, but not limited to, all details of guard rails.

1.10.4.1 Protection

Positive protection for workmen engaged in work that is at a height of six feet or greater shall be provided by safety nets, tie-off's, hydraulic man lifts, scaffolds, or other required means. Decking crews must be tied-off or work over nets or platforms not over six feet below the work area.

Walking on beams and/or girders and the climbing of columns is prohibited without positive protection.

1.10.4.2 Guard Rails

Perimeter guard rails shall be installed at floor, roof, or wall openings more than six feet above an adjoining surface and on roof perimeters.

Rails shall be designed to protect all phases of elevated work. Rails shall be designed by a licensed engineer to provide adequate stability under any anticipated impact loading. As a minimum, the rails shall consist of a top rail at a height of 42 inches, a mid rail and a toe board. Use of tie-offs, hydraulic man lifts, scaffolds, or other means of roof edge protection methods may be utilized on small structures such as family housing, prefabricated metal buildings, etc.

1.10.5 Fire Protection During Construction

The Contractor is alerted to the requirements of Contract Clause "CLEANING UP" and to the requirements of UFC 3-600-01, EM 385-1-1, and NFPA 241 for fire protection during building construction and demolition operations.

This item must be covered in the submittal required under Contract Clause

"ACCIDENT PREVENTION".

1.10.6 Fire Extinguishers

Provide and maintain extinguishers in construction areas and temporary storage areas in accordance with EM 385-1-1 and NFPA 10

1.10.7 Hot Work

Where hot work of any nature, to include but not limited to, torch cutting, welding, brazing, laser cutting, soldering, etc., is to be performed on Camp Murray ANG, the Contractor shall apply for and obtain a Hot Work Permit as specified in Section 01 35 26 GOVERNMENTAL SAFETY

REQUIREMENTS.

1.10.8 Flammable and Combustible Liquids

Store, dispense and use liquids in accordance with EM 385-1-1.

1.10.9 Means of Egress

1.10.9.1 Site and Building Access: Maintain free and unobstructed access to facility emergency services and for fire, police and other emergency response forces.

1.10.9.2 Means of Egress: Do not block exits for occupied buildings, including paths from exits to roads. Minimize disruptions and coordinate with the Contracting Officer.

1.10.9.3 Egress Routes for Construction Workers: Maintain free and unobstructed egress. Inspect daily. Report the findings and corrective actions, weekly to the Contracting Officer.

1.10.10 Inspections

All construction sites are subject to fire and safety inspections without notice. Any violation of fire and safety standards may result in a work stoppage at the expense of the Contractor.

1.11 CONSTRUCTION DIGITAL PHOTOGRAPHS

Take construction digital photographs as follows:

a) Prior to the start of work

b) Prior to concealing work (installing ceiling tiles, sheathing walls, etc.)

c) Weekly general progress photos, depicting all aspects of the work

d) Weekly progress photos taken from static locations showing the changes each week

e) Completion of work

Provide and submit photographs in .jpg digital format of at least five megapixels, in color. Ensure the internal clock of the digital camera is set to the correct time and date such that the file metadata is accurate.

Submit photographs on CD not less than every two weeks, with a corresponding index of photograph filenames and captions in .xlsx format.

Submit a consolidated DVD with the Operations and Maintenance manual.

The quantity of photographs shall be as approved by the Contracting Officer depending upon the work completed each particular week, 20 minimum. The Contractor shall take enough photos to ensure the Contracting Officer completely understands the work being completed, to accurately identify concealed work, and to accurately record existing conditions prior to the start of work. Photographs provided are for unrestricted use by the Government.

1.12 IDENTIFICATION OF EQUIPMENT AND TOOLS

Affix to Contractor- or Subcontractor-owned machinery, motor vehicles, equipment, and tools, clearly legible identification showing the Contractor's or Subcontractor's name, and where space permits, address and telephone number, so as to distinguish them from Government-owned items, and can be returned to the rightful owner if inadvertently left on Government property.

1.13 TRANSPORTATION, HANDLING AND STORAGE

The Contractor shall coordinate with suppliers and shippers to ensure that incoming materials are properly identified with the contractor's name, contract number and project title. The Contractor shall designate an authorized individual to be available to receive shipment. The Government will not provide storage other than that available at the project site.

A. Arrange for timely transportation, delivery, receiving and storage of material, tools and equipment necessary for execution of the project.

B. If construction material or equipment is to be delivered by the U.S. Postal Service, the delivery address shall be:

D. Arrange to have construction material and equipment delivered directly to the project site by noting appropriate building number on the address. Do not address packages to the general Base mailing address, which would cause packages to be delivered to the Base mail room or supply depot, unless the use of such address is authorized by the Contracting Officer in advance. The Government shall not be held liable for loss or damage to material or delays to the project for Contractor's shipments being delivered to the Government's supply depot or mail room.

E. Arrange deliveries of products in accordance with the construction schedule to avoid delays on one hand and excessively long period of storage on site on the other.

F. Unload, transport and store products arriving on site in a manner to avoid damage, and at a location directed by the Contracting Officer.

G. CQC Manager shall inspect immediately upon receipt to ascertain correctness of the type and quantities of shipped items and to discover factory and transit damages. Return incorrect or damaged products and replace with new correct and undamaged goods.

H. Store related component parts in a manner that will permit easy and sequential access as they are needed for installation or assembly.

I. Retain record of shipment, such as bills of lading or delivery

SECTION 01 11 00 Page 14 tickets, and submit to the Contracting Officer if so requested.

J. Provide necessary protective material such as blankets, tarps, plastic sheets and sleepers to store delivered products well protected from elements and from accidental damages.

K. Replace any product damaged during unloading, on-site transportation, and storage with identical undamaged products at no additional cost to the Government.

L. Provide appropriate storage space for material, tools and equipment delivered to the site and not incorporated into the work.

M. Existing building space may be used for storage only if permitted by the Contracting Officer with concurrence of the building manager.

N. Where no space is available in a convenient existing building space, provide temporary storage structure(s) and place at a location as directed by the Contracting Officer.

O. If open outdoor storage is appropriate for the type of material, tools or equipment, provide adequate covering to protect the stored item from weather damages. Provide ventilation to avoid condensation damage.

P. Maintain storage space at temperature and humidity ranges appropriate for the item(s) stored.

Q. Store loose granular materials on solid surfaces such as pavement, or provide plywood or sheet material to prevent mixing with foreign matter.

R. Take measures to prevent ground surface water from damaging stored material.

S. Unit Training Assemblies (UTA). One weekend per month is a military Unit Training Assembly for the Air National Guard. On these weekends, there is a surge of off base personnel that come to work and train on the base. The Contractor shall ensure that prior to these weekends the project sites are cleaned, unused materials consolidated, open trenches filled or covered, maximum parking places are available, traffic routes open, etc. The dates for the UTAs will be discussed at the Pre Construction Conference.

1.14 PROTECTION

A. Storage of supplies, materials and equipment on the project site shall be accomplished in such a manner so as to prevent mechanical and climatic damage and loss due to vandalism or theft. Equipment temporarily removed in the performance of work and stored on the job site shall be stored and protected, and shall be replaced in a condition compatible with its original state. Security for equipment and material removed from the job site for temporary storage until reuse shall be the responsibility of the contractor. Take special care to protect Government property. Return areas damaged as a result of construction under this contract to their original condition. In addition to FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements, perform the following:

1. Remove or alter existing work or facilities in such a manner as to prevent injury or damage to any portion of the existing work or

2. Repair or replace portions of existing work altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.

3. Preserve the natural resources in accordance with the approved environmental protection plan.

4. Protect newly installed products to prevent damage from subsequent operations.

5. Protect existing items to remain from damage and soiling due to work under this contract.

6. Provide coverings, corner guards, barriers and other appropriate measures or devices to effect protection required above. Remove protective measures and devices when no longer needed and prior to completion of work.

1.15 VERIFICATION OF DIMENSIONS AND EXISTING CONDITIONS

A. The contractor shall be responsible for the coordination and proper relation of all aspects of the work. Contractor is responsible to verify existing conditions, dimensions and elevations before any preparatory work such as building layout or shop drawings are started.

B. Report to the Contracting Officer, immediately upon discovery, any variance between the actual condition and the information given in the Contract Documents.

C. Do not proceed with work until potential problems caused by the variance are resolved and approved by the Contracting Officer.

D. Remove and replace, if directed by the Contracting Officer, any work carried out by the Contractor prior to such resolution and without specific directive or approval of the Contracting Officer.

E. Where exact locations are not given for the positioning of equipment and devices, placement shall be coordinated with the Government and they shall be positioned to permit easy access for maintenance and for removal and replacement of component parts.

1.16 ENVIRONMENTAL PROTECTION

To provide for control of all environmental pollution arising from construction activities, the Contractor and its subcontractors, in the performance of this contract, shall comply with Section 01 57 20 ENVIRONMENTAL PROTECTION, and all applicable federal, state, and local laws and regulations concerning environmental protection pollution control and abatement.

1.17 WARRANTY MANAGEMENT

See Section 01 78 00 CLOSEOUT SUBMITTALS, Subpart WARRANTY MANAGEMENT.

The Contracting Officer will conduct a preconstruction conference with key Contractor personnel. The purpose of the conference is to review contract requirements and to establish a working relationship between the Contractor's Staff and the U.S. Army Corps of Engineers personnel who will be closely associated with the project. During the conference, the Contracting Officer will inform the Contractor concerning Job Safety, Quality Control, Labor Relations, and Environmental Protection. The Contractor's Superintendent, Quality Control Representative, and Site Safety and Health Officer (SSHO) shall attend this conference.

WORK RESTRICTIONS

PART 1 GENERAL

1.1 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

1.2 CONTRACTOR ACCESS AND USE OF PREMISES

1.2.1 Activity Regulations

1.2.1.1 Subcontractors and Personnel Contacts

Provide a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.

1.2.1.2 Identification Badges and Installation Access

Comply with FAR 52.204-9 Personal Identity Verification of Contractor Personnel and the requirements described herein.

Application for and use of badges will be as directed. Obtain access to the installation by participating in the Defense Biometric Identification System. Contractor employees and representatives performing work under this Contract are required to be either United States citizens or documented legal residents and are authorized by the Government to work in the United States. All Contractor employees shall obtain the required contractor identification. Each employee shall wear the Government issued identification over the front of the outer clothing. Failure to obtain security and base access passes shall not be a cause for contract performance time extension. The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government: (1) When no longer needed for contract performance; (2) Upon completion of the Contractor employee's employment; (3) Upon contract completion or termination. The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.

Immediately report instances of lost or stolen badges to the the issuing office and to the Contracting Officer.

For the purposes of Contracting services, it is implied that any and all parties agree to a Criminal History Background Check once entered into any

SECTION 01 14 00 Page 2 contract. Any documents that are provided and found fraudulent to include, but not limited to driver's licenses, contracting licenses, etc., will result in an arrest and potential termination for default from the contract. All Contractors are subject to search in order to obtain entry onto the installation and while working on the installation. Any refusal to submit to a search of their person or vehicle will be deemed as a violent act of aggression against the installation and will be cause for dismissal from the installation and revocation of future privileges and installation access. The Government will not be held liable for any delays or breach of contract caused by refusal of the Security Forces to allow entry.

Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (AFI 31-101 and AFI 10-245), applicable installation, facility and area commander installation/facility access and local security policies and procedures.

a. Personnel will be issued appropriate identification badges when the Contractor submits, in writing, on a form prescribed by the Contacting Officer, a request for issuance of badges. Employees shall complete questionnaires and other forms as required for security.

Allow 10 business days for background checks and processing. The list shall contain the following information:

1. Prime contractor and subcontractor contact information

2. Name, Social Security Number, and Date of Birth of employee

3. Copy of disclaimer/authorization/release signed by employee

4. Color image of Driver's License (if to operate a motor vehicle on base) or other acceptable identification as indicated in DTM 09-012. If the Driver's License is not Real ID compliant, include another acceptable identification as indicated in DTM 09-012.

5. AT level I Awareness Training Certificate

Badge applications for subcontractors for which a SF1413 has not been submitted will not be processed. Contractors can call Base Pass & ID at 603-430-2605 during regular office hours to determine if an employee is approved for base access.In the event an employee is denied base access, the reason for the denial will not be provided. Badges may be issued for a period of up to one year, however, background checks will be repeated at least every six months. Employees who do not have a valid, current base access badge, or have a current badge but are not on the project list, will not be allowed to enter the base. Employees who have been approved, but need to report to Base Pass & ID to pick up their badge, must do so during Base Pass & ID office hours, and must be accompanied by a badged contract employee directly to Base Pass & ID.

b. Denial or revocation of any official base authorized access pass may be made if the individual:

1. Is listed in the National Terrorist Watch List.

2. Is not a U.S. Citizen and is illegally present in the U.S. or whose U.S. Citizenship, Immigration status, or Social Security

Number cannot be verified.

3. Is subject to an outstanding criminal warrant of any type.

4. Whose business/contractor pass application contains false or fraudulent information, or any of the offenses listed below.

5. Is a registered sex offender regardless of the date of the criminal offense.

6. Has a felony conviction within the last 10 years.

7. Has obtained any Conviction that includes the following types of criminal offenses:

a) Offenses of the sexual nature.

b) Offenses of Violence.

c) Offenses related to gang activity, supremacist, or extremist behavior.

d) Crimes resulting from the possession, use, manufacture, introduction, or distribution of any illegal drug listed in the Comprehensive Drug Abuse Prevention & Control Act of 1970, schedules I through V.

e) Offenses in which weapon instrumentality (e.g., firearm, knife or other bladed instrument, club, brass knuckles) was used either as a means of violence, or a threat of violence.

8. Whose military active duty was terminated by the receipt of a dishonorable discharge or bad conduct discharge.

9. Has been issued a barment order and is currently banned from military installations.

10. Has exhibited characteristics, traits or other indications that cause concern for the health, safety or welfare of personnel and/or residents aboard the base; or that cause concern for the physical security or environment of the base.

c. Deliveries:

1. Personnel requiring one-time access to deliver or retrieve materials or equipment for the project are not required to be badged. Upon presentation of a bill of lading and proper identification, a rapid background check will be conducted on delivery personnel. These personnel are subject to the same disqualifying factors as other employees.

1.2.1.3 Electronic Security Systems Equipment

Electronic Security Systems equipment such as processing control units, workstations, field panels, sensors, card readers, cable installation, and system programing, testing and training must be performed by U.S. citizens who have been subjected to a trustworthiness determination

1.2.1.4 Installation Access

Obtain access to Air Force installations through participation in the Defense Biometrics Identification System (DBIDS). Requirements for Contractor employee registration, and transition for employees currently under Air Force Commercial Access Control System (NCACS). No fees are associated with obtaining a DBIDS credential.

Participation in the DBIDS is not mandatory, and Contractor personnel may apply for One-Day Passes at the Base Visitor Control Office to access an installation.

1.2.1.4.1 Registration for DBIDS

Procedure includes:

a. Present a letter or official award document (i.e. DD Form 1155 or SF 1442) from the Contracting Officer, that provides the purpose for access, to the base Visitor Control Center representative.

b. Present valid identification, such as a passport or Real ID Act-compliant state driver's license.

c. Provide completed SEC FORM 5512/1 to the base Visitor Control Center representative to obtain a background check.

d. Upon successful completion of the background check, the Government will complete the DBIDS enrollment process, which includes Contractor employee photo, finger prints, base restriction and several other assessments.

e. Upon successful completion of the enrollment process, the Contractor employee will be issued a DBIDS credential, and will be allowed to proceed to worksite.

1.2.1.4.2 DBIDS Eligibility Requirements

Throughout the length of the contract, the Contractor employee must continue to meet background screen standards. Periodic background screenings are conducted to verify continued DBIDS participation and installation access privileges. DBIDS access privileges will be immediately suspended or revoked if at any time a Contractor employee becomes ineligible.

An adjudication process may be initiated when a background screen failure results in disqualification from participation in the DBIDS, and Contractor employee does not agree with the reason for disqualification.

The Government is the final authority.

1.2.1.4.3 DBIDS Notification Requirements

a. Immediately report instances of lost or stolen badges to the Contracting Officer.

b. Immediately collect DBIDS credentials and notify the Contracting Officer in writing under the following circumstances:

(1) An employee has departed the company without having properly returned or surrendered their DBIDS credentials.

(2) There is a reasonable basis to conclude that an employee, or former employee, might pose a risk, compromise, or threat to the safety or security of the Installation or anyone therein.

1.2.1.4.4 One-Day Passes

Personnel applying for One-Day passes at the Base Visitor Control Office are subject to daily mandatory vehicle inspection, and will have limited access to the installation. The Government is not responsible for any cost or lost time associated with obtaining daily passes or added vehicle inspections incurred by non-participants in the DBIDS.

1.2.1.5 Employee List

The Contractor must provide to the Contracting officer, in writing, the names of two designated representatives authorized to request personnel and vehicle passes for employees and subcontractor's employees prior to commencement of work under this contract.

1.2.1.6 Personnel Entry Approval

Failure to obtain entry approval will not affect the contract price or time of completion.

1.2.1.7 No Smoking Policy

Smoking is prohibited within and outside of all buildings on installation, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.

1.2.2 Working Hours

Regular working hours must consist of an 9 hour period established by the Contracting Officer, between 7 a.m. and 4 p.m., Monday through Friday, excluding Government holidays. Normal working hours will be reviewed at the Pre-construction Conference.The Washington Air National Guard is on a 4-day, 10-hour schedule, Tuesday thru Friday; however, contractors may be able to work with a five-day presence after prior coordination.

1.2.3 Work Outside Regular Hours

Work outside regular working hours requires Contracting Officer approval.

Make application 15 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title.
