FAR Part 6 Justification and Approval for Other than

Full and Open Competition

1. Contracting Activity: 194th MSG/MSC

2. Description of Action: 194th CE requests a Brand name only requirement with Monaco Enterprises Inc. or “Monaco”. The Government projects award for 2022 and fiscal year 2022, SRM funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

3. Description of Supplies/Services: Monaco MAAP-X Fire Alarm Panels, Monaco transceivers (BT-X series), and all associated devices. A system of addressable UFC-compliant components with mass notification capability. All monitoring, supervision, signaling, and reporting functions are incorporated into an integrated system.

4. Authority Cited:

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited:

a. The Washington Air National Guard at Camp Murray requires interconnection with Joint Base Lewis-McChord as the responding emergency services. JBLM has the Monaco D21 Emergency Management System, and existing fire alarm equipment on Camp Murray is also Monaco brand.

i. As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

ii. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.

b. ANG ETL 15-01-03 specifies standardization of components within the Air

National Guard for Fire Detection/Mass Notification Systems.

i. Para 6.4 states “The fire alarm system shall provide radio based, fiber optic or landline based, remote system reporting to the base central system, and a secondary central receiver. Provide radio based transmission systems for all new base-wide systems. Retrofit installations shall use system equipment that is listed by a nationally recognized testing laboratory, and is compatible with the existing equipment to include the central base transmitting and receiving system. All facility fire alarm systems must also transmit appropriate signals to the responding (host or other) fire department, which in most cases is the ANG fire station.”

c. ANG Civil Engineer has established a maintenance, training and technical trouble shooting program at the Civil Engineer Technical Services Center specifically to support Monaco Enterprises Detection components and systems installed in ANG facilities nationwide. Therefore in order to maintain the proper operational level of fire detection, Monaco Enterprises products, components and services are required.

d. Monaco has confirmed through email correspondence that they do not have any restrictions, special licenses, or permits required for purchasing and installing their products. This provides all potential vendors an equal opportunity to acquire the required products.

e. At this time, no other brand can integrate acceptably or provide the fire detection/reporting and intrusion detection systems, components or the specialized accessories sufficiently for existing components. Use of any other brand of fire detection equipment, or integration equipment would result in a system failure, and zero capability to integrate properly with agency mandated systems.

6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any proposals received shall be considered.

a. Effective Competition: The Government will achieve effective competition by posting a synopsis of the requirement to SAM.gov, detailing the upcoming solicitation.

b. The Government will post a solicitation for bids on SAM.gov for 30 days, allowing all small businesses with the appropriate reps and certs to submit proposals.

7. Actions to Increase Competition: Correspondence as detailed above was conducted with Monaco Enterprises Inc. to ensure that no other limiting factors or stipulations would prevent an interested party from acquiring supplies and associated prices in order to submit a proposal. Because the installation of this system is based on a previously completed 100% design, a general construction NAICS will be used to maximize the ability for a qualified small business to submit proposals.

8. Market Research: HDR Inc. completed market research and system design 29 Oct 2020. After researching for any alternative brands that could be integrated with the

Version – June 2021 CUI exiting MNWS and fire alarm, the design firm found no other possible substitutions that could successfully meet integration requirements.

Additionally, other Air National Guard bases have contracted for upgrading their base-wide fire alarm systems while specifying the brand name or equal requirements to Monaco, without receiving any response from industry other than using these brands of components.

In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a request for sources sought was posted to SAM.gov on 21 July 2021 for 30 days and the results were 8 small business responses claiming they could support the fire alarm installation requirements according to the completed design.

9. Interested Sources: To date, no other small businesses with the appropriate NAICS code has expressed interest in the requirement.

10. Other Facts:

A. Procurement History:

(1) As a new requirement for Camp Murray, the base-wide fire alarm system is required to integrate to JBLM as the responding emergency service station.

(2) The base-wide fire alarm system is required to confirm to ANG standards of using Monaco brand systems in all new and retrofit systems for compatibility and sustainment as detailed in ANG ETL 15-01-03

(3) The base-wide fire alarm must integrate into the existing MNWS on Camp Murray which is American Signal Corp. brand.

Monaco Inc. and American Signal Corp are active in the civilian marketplace with accessible price data readily available for comparison to received bids. Both manufacturers have no restrictions from purchasing equipment, and allow for any vendor to install their products. No additional licensing is required specific to acquiring these specific brands of equipment.
