About this file
This document contains a justification for a brand name sole source procurement and a related solicitation amendment for a base-wide fire alarm system repair and upgrade project at Camp Murray, Washington. The 194th Mission Support Squadron seeks to award a firm-fixed price contract to Monaco Enterprises for fire alarm panels and a sole source option to American Signal Corporation for integration into the existing mass notification system. The project completion is based on a previously approved 100% design and will provide a modernized addressable fire alarm system integrated with the American Signal Corporation Compulert NexGen mass notification system. The estimated value is between $1 million to $5 million. Interested contractors must register in SAM and direct any questions in writing to the 194th Contracting Office by the specified due date in the amended solicitation.

FAR Part 6 Justification and Approval for Other than
Full and Open Competition
1. Contracting Activity: 194th MSG/MSC
2. Description of Action: 194th CE requests a Brand name only requirement with American Signal Corp. The Government projects award for 2022 and fiscal year 2022, SRM funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: American Signal Corporation Compulert NexGen system integration equipment panel.
Total Value (Option): $144,450.00
4. Authority Cited:
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited:
a. The Washington Air National Guard at Camp Murray has an existing and fully functional Mass Notification and Warning System located on Camp Murray which is American Signal Corp. brand.
i. As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
ii. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.
b. ANG ETL 15-01-03 specifies standardization of components within the Air
National Guard for Mass Notification Systems.
i. Para 6.4 states “Retrofit installations shall use system equipment that is listed by a nationally recognized testing laboratory, and is compatible with
Program/Equipment:
CUI
Version – June 2021 CUI the existing equipment to include the central base transmitting and receiving system.”
c. American Signal Corporation has confirmed through email correspondence that they do not have any restrictions, special licenses, or permits required for purchasing and installing their products. This provides all potential vendors an equal opportunity to acquire the required products.
d. At this time, no other system or brand is being considered to replace the MWNS.
Use of any other brand integration equipment would result in vital systems failure, and zero capability to integrate properly with agency mandated systems.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any proposals received shall be considered.
a. Effective Competition: The Government will achieve effective competition by posting a synopsis of the requirement to SAM.gov, detailing the upcoming solicitation.
b. The Government will post a solicitation for bids on SAM.gov for 30 days, allowing all small businesses with the appropriate reps and certs to submit proposals.
7. Actions to Increase Competition: Correspondence as detailed above was conducted with American Signal Corp. to ensure that no other limiting factors or stipulations would prevent an interested party from acquiring supplies and associated prices in order to submit a proposal. Because the installation of this system is based on a previously completed 100% design, a general construction NAICS will be used to maximize the ability for a qualified small business to submit proposals.
8. Market Research: Currently no replacement or modification is being done or considered in regards to the base MWNS, and requires only integrative capability with the new base-wide fire alarm being solicited. No other changes are necessary and will not be conducted under this project.
9. Interested Sources: To date, no other small businesses with the appropriate NAICS code has expressed interest in the requirement.
