Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: 143d Airlift Wing, Base Contracting Office/USPFO-RI Purchasing & Contracting Division

2. Description of Action: The action being procured is a new contract for the construction of a fitness center and storage area. This will be a pre-fabricated metal building built on an existing slab. The project will be awarded through an invitation for bid and funded with Air Force Sustainment, Restoration, and Maintenance (SRM) Funds. The contract calls for Tyvek (or approved equal) suits for personal protective gear.

3. Description of Supplies/Services: The Tyvek suit is an industry standard for personal protective equipment. The specifications do not require that the contractor use Tyvek. If the contractor can find a product that meets the same specifications as Tyvek then it will be approved for use in the project. The total value of the suits is $300.00 ($15/suit with 20 suits required).

4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C.

Section 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1(c), the property or services needed by the agency are available only from one responsible source or only from a limited number of responsible sources.

5. Reason for Authority Cited: Personal Protective Equipment follows extremely stringent criteria to ensure the health and protection of personnel. It is critical that the contractor use well established and known brand names in order to comply with all Federal Rules and Regulations. If the contractor can find an equal product it will be permitted for use by the engineer.

6. Efforts to Obtain Competition: The contract will be put out for solicitation and any qualified contractor can bid on the project. If an acceptable product that meets the specifications for the Tyvek model is found it will be accepted.

a. Effective competition. There is an expectation of adequate competition for this project. The notices required by FAR 5.201 shall be or have been published, and that any bids or proposals received shall be considered.

7. Actions to Increase Competition: Actions taken to increase competition are to allow any model that meets the specifications based on the Tyvek Suit.

8. Market Research: A quick internet search was completed and there are multiple vendors for this type of protection suit.
