About this file

This document is a justification and approval for other than full and open competition for a federal construction contract awarded by the 143rd Airlift Wing Base Contracting Office. The contract is for the construction of a new fitness center and storage area at an Air National Guard base in Rhode Island. Key details include that the project involves demolishing an existing superstructure and building a new pre-fabricated metal gymnasium and additional storage space. Transformer warning labels meeting Panduit specifications are required for safety compliance. While Panduit labels are specified, equal products meeting specifications will be accepted. The solicitation will be publicly advertised on SAM.gov as a small business set-aside, with a NAICS code of 236220 and size standard of $39.5M average annual receipts. The construction project value is estimated between $1M-$5M. Funds are expected to become available by September 30, 2020 for award to the responsible bidder offering the most advantageous price.

Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: 143d Airlift Wing, Base Contracting Office/USPFO-RI Purchasing & Contracting Division

2. Description of Action: The action being procured is a new contract for the construction of a fitness center and storage area. This will be a pre-fabricated metal building built on an existing slab. The project will be awarded through an invitation for bid and funded with Air Force Sustainment, Restoration, and Maintenance (SRM) Funds. The contract calls for Panduit No. PPSO710D71 IEEE approved transformer warning signs.

3. Description of Supplies/Services: The Panduit labels are an industry standard for marking transformers. It is critical that the contractor follows all IEEE rules for marking of the transformer because handling a transformer without proper training or gear could lead to death. The specifications do not require that the contractor use Panduit. If the contractor can find a product that meets the same specifications as Panduit then it will be approved for use in the project. The value of the labels is $20.00 (4 labels costing $5.00 each).

4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C.

Section 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1(c), the property or services needed by the agency are available only from one responsible source or only from a limited number of responsible sources.

5. Reason for Authority Cited: Transformer labeling follows extremely stringent criteria to ensure the health and protection of personnel. It is critical that the contractor use well established and known brand names in order to comply with all Federal Rules and Regulations. If the contractor can find an equal product it will be permitted for use by the engineer.

6. Efforts to Obtain Competition: The contract will be put out for solicitation and any qualified contractor can bid on the project. If an acceptable product that meets the specifications for the Panduit model is found it will be accepted.

a. Effective competition. There is an expectation of adequate competition for this project. The notices required by FAR 5.201 shall be or have been published, and that any bids or proposals received shall be considered.

7. Actions to Increase Competition: Actions taken to increase competition are to allow any model that meets the specifications based on the Panduit No. PPSO710D71 IEEE approved transformer warning sign.

9. Interested Sources: N/A

10. Other Facts: Competition is not being limited by putting a basis of design product in the specifications, anyone qualified can bid on the project and a model that meets the specifications of the Panduit No. PPSO710D71 IEEE approved transformer warning signs but isn’t that model will also be accepted.
