About this file

This is a Storm Water and Erosion Control Certificate form for March Air Reserve Base, California. The certificate is a mandatory requirement for all construction, repair, renovation, and service contracts on the base that will disturb paved or unpaved areas, use base roadways to haul construction materials, or use paved surfaces for material storage. The form requires certification by a qualified person responsible for project planning and must be approved by the Chief Environmental Flight (452 MSG/CEV) before work can commence. The certificate must be attached to March ARB Form 103 Work/Dig Permit.

The form establishes a tiered compliance framework based on disturbance area size. Projects disturbing less than one acre require a Water Pollution Control Plan (WPCP) or Best Management Practices (BMP) plan; small linear utility projects between one and five acres must obtain a General Permit from either the Santa Ana Regional Water Quality Control Board (Tier I) or State Water Resources Control Board (Tier II) with a Storm Water Pollution Prevention Plan (SWPPP); projects exceeding one acre or part of common development plans exceeding one acre must obtain a California NPDES General Construction Permit and submit a Notice of Intent (NOI) with required fees to the State Water Resources Control Board. All contractors and subcontractors must comply with the Environmental Protection Guide Specification (EPGS), federal Clean Water Act requirements, California Porter Cologne Water Act, and Air Force Instruction AFI 32-7041. Penalties for noncompliance begin at $5,000 for permit violations and $1,000 per day for various requirements. The certificate requires documentation of disturbed area calculations, site plans showing drainage infrastructure and BMPs, and signed certification by responsible officials or qualified storm water professionals, along with supporting attachments including project drawings and relevant permits.

STORM WATER AND EROSION CONTROL CERTIFICATE

March Air Reserve Base, California

Form Ver 4 JAN 19 1 of 3

Yes No (Go to Step 6) 4. Is the Area disturbed over 1 acre?

5. Is an ESCP or WPCP Attached? Yes No

a. The ESCP, WPCP, or SWPPP if required identifies the type and location of erosion and sediment controls/Best Management Practices (BMPs) to be provided to manage and control storm water runoff while the construction activity is taking place. Guidance on the preparation of the ESCP is found in the Environmental Protection Guide Specification.

Purpose and Need for Certificate:

March Air Reserve Base (ARB) Environmental Management Flight (452 MSG/CEV) requires all construction on March ARB that will disturb the paved or unpaved areas of March ARB to include use of March ARB roadways to haul dirt or other construction materials or paved surfaces to store materials to have a Storm Water and Erosion Control Certificate signed by a person responsible for the preparation of the certificate.

Depending upon the area disturbed, this may need to be a certified person, as stated below. The Certificate must be approved by the Chief Environmental Flight or designated person and attached to a March ARB form 103 Work/Dig Permit.

All repair, renovation, construction and service contracts must have the local March ARB, Environmental Protection Guide Specification (EPGS), modified for that project and approved by 452 MSG/CEV, contained within the contract Statement of Work or Performance Work Statement and all contractors and sub-contractors must be required to meet the specification. Self-help or military performed projects must also meet the requirements of the EPGS. These specifications require the contractor to adhere to the requirements of Federal, State, local and March rules and regulations.

This mandatory requirement is an effort to prevent violations of the Federal Clean Water Act, as amended, the California Porter Cologne Water Act as amended 2018, the California Storm Water Enforcement Act of 1998 contained within the Portage Cologne Water Act, local ordinances, and US Department of Defense and US Air Force Instructions to include AFI 32-7041, WATER QUALITY COMPLIANCE. Tenants and non-452 AMW units are responsible for any and all fines and penalties for noncompliance with environmental regulations.

Penalties, as established in the California law, begin at $5,000 for violations of not having a permit and $1,000 for various requirements such as not filing an annual report, per day or deficiency. By completing this certificate and ensuring compliance with the above laws, the likelihood of a violation is reduced. This Certificate will accompany the March form 103, Base Work/Dig Permit Application and be approved and signed before 452 MSG/CEV will concur on the form 103.

A site plan [contained in the Erosion and Sediment Control Plan (ESCP), Water Pollution Control Plan (WPCP) or Storm Water Pollution Prevention Plan (SWPPP)] of the proposed project must be attached to this application. The plan must show nearby storm sewers and drains to which any dirt or debris might flow if unimpeded, locations of any digging required, to include depth, width and length of each dig, limits of any lay-down areas and haul roads used to move dirt or debris, a description of Best Management Practices (BMP) (e.g. gravel bag location at storm drains.) to be used during the dig to prevent the flow of dirt and debris in the event of a rain from reaching the storm sewer system, and means of preventing dust from entering the air (e.g.

wetting or covering the dirt piles, or vehicles, cleaning of wheels, etc.).

The Proponent must also attach a calculation of the each area and total area to be disturbed to include any lay-down areas, roadways or access ways to be created, etc. The calculation must show the area of each separate dig area.

Instructions for Completion of Certificate:Please follow below instructions, answer questions and complete the appropriate information based on those answers. Any questions should be directed to Ms. Dung (Yung) Nguyen at 951-655-5065.

1. Enter the disturbed Area: The calculation must be made by a qualified person in accordance with the State Water Board criteria.

2. Is this a small linear utility project (>1 acre<5 acres)? Yes No (go to Page 2)

3. Is a General Permit from either the Santa Ana Regional Water Quality Control Board (SARWQCB) for a Tier I Project or from the State Water Resources Control Board (SWRCB) for a Tier II Project based on "Water Discharge Requirements For Discharges of Storm Water Runoff Associated with Small Linear Underground/Overhead Construction Projects" attached?

Yes No

STORM WATER CONTROL CERTIFICATE

Form Ver 4 JAN 19 2 of 3

Yes No 6. Is a SWPPP attached?

a. Guidance on the preparation of the SWPPP is found in the Environmental Protection Specification. The SWPPP must be approved by 452d MSG/CEV (if disturbance is > 1 acre) prior to the commencement of land disturbance. The Project Proponent/Subordinate Project Unit must submit a Notice of Intent (NOI) with the appropriate fee to the State Water Resources Control Board (SWRCB) for the current NPDES General Construction Permit at http:// www.waterboards.ca.gov/stormwtr/construction.html after approval by 452 MSG/CEV.

b. A qualified storm water professional must prepare and oversee the implementation of the SWPPP. Guidance on the preparation of the SWPPP can also be found in the most recent version of the California Storm Water Best Management Practice Handbook – Construction.

Assistance with the design of BMPs can be found in the most recent version of the Riverside County Storm Water Quality Best Management Practice Design Handbook.

Regardless of the size of the construction project and the amount of land disturbance, if there is a potential for discharge of polluting substances to the March ARB storm water drainage system, actions must be taken to prevent these substances from entering the drainage system. Spills or sediment that enters the March ARB storm water drainage system can cause violations of the Base’s permits and create problems in drainage channels, Canyon Lake, and Lake Elsinore downstream of the Base, making the Base and the activity at fault, liable for fines and penalties.

7. The attached certificate must be signed by the responsible official of the entity that funded the work or a person certified to sign an ESCP or SWPPP based on California law.
