RFP 19-R-0049 Question and Answers – 25 April 2019
Question 1:
As the Buy American act has been added to the requirement, do we need to list only the countries of the manufacturers called out in the RFP (Bulgaria- Arsenal, Romania-ROMARM, Serbia- Zastava) or do we list any and all potential sources that may be used for future purchases under the base IDIQ. For Old Stock/Surplus items do we need to list countries of the OEM or is it based on the storage/current ownership of the weapons?
Response: No longer applicable. Clause 52.225-1 Buy American – Supplies will be removed from the solicitation.
Question 2:
Due to the inclusion of clauses 52.225-5 Trade Agreements and 52.225-1 Buy American--Supplies in Amendment 0001, issued April 16th, we respectfully request that the government consider an extension of the proposal deadline until May 7th to allow us sufficient time to verify Supplier compliance with these terms. The Western Easter and Orthodox Easter Holiday is strictly observed by preferred overseas partners who have closed their offices in observance for an extended period of time beginning April 21st until the second week of May.
Response: At this time an extension will not be granted. Furthermore, Clause 52.225-5 Trade Agreements will no longer be applicable and will be removed from the solicitation.
Question 3:
For CLINs 0002-0026, will the government accept and consider compliant, quotes for products meeting or exceeding the same specifications but from different manufacturers than listed on the solicitation?
Response: No.
Question 4:
Will the government please define “new production”, “old stock”, and “surplus” per Section L.4.2.1?
Response: As referenced in Section L.4.2.1, the following is provided to help identify the definitions, however the intent of this section is to include all possible conditions of available items. New Production: Items that are produced during contract performance. New Old Stock: Items that have already been produced but have not been issued or used. Surplus: All other conditions of items not meeting criteria of New Production or New Old Stock: for example previously issued or used items; including refurbished.
Question 5:
Does the “Disclosure for Lobbying” form need to be filled in of Attachment 7?
Response: If applicable to your proposal.
Question 6:
L.4.5 Volume V Solicitation, Offer and Award Documents, and Certifications/Representations Page 21-22 of Amendment 002: Section J Contract Data Requirements List (DD1423) with blocks 17 & 18 completed. It is stated in the solicitation to fill out Section J, blocks 17 and 18, IF required. Please clarify if it is actually required or not.
Response: This RFP will result in a Firm Fixed Priced contract which shall include the costs of providing any DD1423s (CDRLs). As such, the cost for CDRLS, blocks 17 and 18 are Not Separately Priced (NSP) as indicated in the attached CDRLs. If your intention is to keep these NSP, then blocks 17 and 18 are not required.
Question 7:
We would like to clarify that Suppliers and OEMs are not considered Subcontractors and will not be rated as a risk. Section M.3.2.1.2 – Is where our question is derived from.
Response: In accordance with Section L.4.1.2, Offerors are instructed to define and substantiate business relationships with suppliers in order to evaluate capability per M.3.2.1.2 of the RFP. If the Offeror is relying on the capability of a member of any teaming arrangement that needs to be identified per the instructions in L.4.1.2 of the RFP. Section M.3.2.1.2 states that relationships maintained by the Offeror may be evaluated as lower risk than relationships maintained by a separate business entity. Relationships can be with suppliers, OEMs, subcontractors, or any other identified relationship per the Offerors’ proposal.
*Note: The last date and time to submit questions or clarifications shall be 5:00 PM EST on 26 April 2019 to allow sufficient time to respond prior to the RFP closing date of 3:00 PM EST on 30 April 2019.*
