Questions and Answers_002:
Part 2 (Section A through K) of RFP: W15QKN-15-R-0017
(Mortar Weapon systems)
Question 1: In regards to Q&A part 2 question 32, the contractor is requesting additional clarification as follows: The contractor assumes that if the USG issues multiple orders within a ordering period (assuming they are at least 30 days apart) the contractor is not obligated to honor the total combined order quantity price range. For example in month 1 the USG orders CLIN 1 for 10 units, then in month 2, 31 days after the order for 10, the USG orders an additional CLIN 1 for 140 units, is it correct that the USG would could not adjust the unit price of both orders for the 150 units range, but would receive order # 1 at the 10-49 range and order #2 at the 50-149 range?
RESPONSE: This will be addressed in the release of Part 3, which will be the formal RFP release. If concerns still exist, please submit questions at that time.
Question 2: We ask the Government to please reconsider our request to include the Progress Payment clause (FAR 52.232-16) in the resultant solicitation/contract for the following reasons:
* FAR 32.113(d) allows the financing of contracts for supplies or services awarded under the competitive negotiation method of procurement in accordance with Part 15 <https://www.acquisition.gov/sites/default/files/current/far/html/FARTOCP15.html#wp246607> , through either progress payments based on costs in accordance with Subpart 32.5 <https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2032_5.html#wp1047463> , or performance-based payments in accordance with Subpart 32.10 <https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%2032_10.html#wp1028960 > (but not both).
* According to the FAR, prudent contract financing can be a useful working tool in Government acquisitions by expediting the performance of essential contracts. Contracting Officers must consider the criteria in this part in determining whether to include contract financing in solicitations and contracts. FAR recommends Contracting Officers resolve reasonable doubts by including contract financing in the solicitation.
* Progress payments are typically included when the contract requirement includes significant time between award and delivery. Market research is a key factor in the Contracting Officer’s determination if progress payments are common and appropriate for the subject requirement.
* Progress payments may be in the Government’s best interest when the benefits include lower prices, or non-price contract terms and conditions which would be less favorable in the absence of Government contract financing.
RESPONSE: Progress Payments will be included in Part 3, which will be the formal RFP release. If concerns still exist, please submit questions at that time.
