6. Please clarify for me if the subject solicitation is going to be 1 award for all parts and all quantities.

Answer: This will be a single award 100% Small Business Set Aside contract.

7. Please provide the TDP or NSN for the Round Counter Kit which consists of 1290163 Round Counter and 12901628 Reader Cable.

Answer: All TDPL’s are DRAFT versions at this time. If there is a drawing missing it will be provided when Part 3 of the RFP is released.

8. Since this is an IDIQ contract, the amount of the bond (clause I-132 Performance and Payment Bonds (Page 304) is undefined due to a lack of knowledge of future requirements and Delivery Orders. Consequently, without additional information on future DO’s, we cannot accurately price this. Will additional information be made available in the solicitation?

Answer: At this time the RFP is in DRAFT form, all clauses will be final when the RFP is RELEASED.

9. Warranty issues:

It appears that proposers are expected to consider the sections that discuss warranty requirements in the final solicitation as the warranty for this contract rather than converting these requirements into a formal warranty that would include the many standard industry warranty conditions and clauses.

COMMENT: Only warranting specified items listed in SOW and applicable Section B Sub-CLINS. Contractor responsible for providing a competitive price for each of the Warranty CLINS in each of the Ordering Periods

1. Units can be returned by any means the customer chooses from anywhere in the world without regard to cost since shipping cost will be borne entirely by proposer whether it is a valid warranty claim or not. Also, there is no reference to a return address to be used to send the repaired or replacement parts. Suggest the language be changed to include a specific place that warranty items be shipped to and from (such as the Picatinny Arsenal) to reduce overall warranty costs to the government.

Answer: Defective item would be shipped back to the prime contractor. Replacement/repaired parts location is TBD until awards for both Component and Systems contract. The contractor is responsible for only valid warranty claims. In the event, the contractor can provide supportive data to show misuse or abuse by the user, the contractor shall submit same for reimbursement.

1. Draft SOW C.3.3 “Toll free number shall be accessible from CONUS and OCONUS locations…” No such single telephone line/service exists that is accessible worldwide from all locations. Can communication of warranty matters to be handled via web-based application.

Answer: Government will only accept communication of warranty item via toll free number.

1. Draft SOW C.3.3 Table 1 lists 6 parts subject to warranty while Draft Solicitation I-135(b)(1) states “all supplies furnished under this contract” are warranted. Please provided guidance on what is to be included in warrantied supplies.

Answer: Table 1 in SOW, Section 3.3 as well as the applicable Sub CLINS in Section B contain all items to be warrantied. I-105 applies to the specified items.

1. Draft Solicitation I-135(b)(1) contains a 365 day warranty term. There must be at least one quantifiable event that will cause the warranty to terminate in addition to the passage of time (such as a specific number of rounds fired). The absence of any use criteria as a terminating event will make the cost of the warranty prohibitive.

Answer: If a system has failed, a fault diagnosis will be performed by government personnel (see SOW paragraph C.3.3.3) to determine which component or assembly has failed. The warranty will not apply for items that are defective due to Misuses or Abuse (see SOW paragraph C.3.3.2).

1. Copies of User Manuals prepared by the customer are needed in order to provide assistance in determining the veracity of each warranty claim. Potential field use outside the scope of the User Manual cannot be covered under this warranty.

Answer: Investigation shall determine if improper use caused the defect. If improper use was found to be the cause, warranty will be null and void for that item.

1. The differences in notification and response times between the two documents needs to be reconciled. The Draft Solicitation discusses a 15-day notification requirement and a 30-day response. The Draft SOW discusses a time from of 72 hours from receipt of warranty part(s) to initiate shipping.

Answer: There is a difference between notification (15 days) timeframe and timeframe to ship replacement item to affected unit (72 hours). 30 days is the notification of corrective action.

10. Will performance based (52.232-32) or progress based payments (52.232-16) be available in the contract?

ANSWER: Contract finance options listed above, performance based (52.232-32) or progress based payments (52.232-16), will be considered by the PCO as applicable and finalized at the time of contract award.
