Scope and Introduction Scope This Performance Work Statement (PWS) defines the technical requirements for a single-channel, vehicular-mounted, software-defined radio for use by the Brigade Combat Teams (BCT). Throughout this document, this radio will be referred to as the SRW Appliqué Radio System. Radio support services necessary to enable fielding and continued field operations will also be procured.
Objective The intent of this acquisition is to buy non-developmental radio systems, and required support services, for our Warfighters as well as Federal, state and local agencies, and authorized foreign militaries. The Government will make the Government-owned Soldier Radio Waveform (SRW) available to the Contractor. The Contractor shall take the SRW and integrate it onto their hardware solution. The Contractor shall then offer to the Government Radio Systems that meet or exceed the Performance Work Statement (PWS) requirements contained herein.
Contracting Officer Representative (COR) The Contracting Officer will designate a Contracting Officer Representative COR(s) in writing and provide a copy of that letter to the Contractors. The COR letter will state the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates, or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the contract award or delivery order.
Non-personnel Service This is a non-personnel services contract to provide Soldier Radio Waveform (SRW) Radios. The contractor, as an independent contractor and not as an agent of the Government, shall provide the necessary resources (except those furnished by the Government) to accomplish tasks of the type set forth below.
Contractor employees performing services under this contract shall be controlled, directed and supervised at all times by management personnel of the contractor. The contractor's management shall ensure that employees properly comply with the performance standards outlined in this Performance Work Statement and as required by the contracting officer or the contracting officer's representative (COR). Contractor employees shall perform independent of and without the supervision of any Government official. Actions of contractor employees may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the U.S. Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government shall control access to the facility and shall perform the inspection and acceptance of completed work and tasks.
Organizational Conflict of Interest Contractor and subcontractor personnel performing work under this contract may receive, have access to, or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.
Identification of Contractor Employee All contract personnel attending meetings, answering Government telephones, emailing and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.
Type of Contract This will be a Multiple Award Indefinite Delivery-Indefinite Quantity (ID/IQ) type contract, for both supplies and services. This contract will support the issuance of firm fixed price (FFP) type and cost plus fixed fee (CPFF) type, and cost type delivery and task orders.
On Ramps/Off Ramps The Government reserves the right to review all contracts under SRW Appliqué Radio System Multiple Award IDIQ Contract suite annually to determine whether it would be appropriate to reissue the solicitation for the purposes of allowing for technology insertion, revising Government requirements, adding additional IDIQ holders, and/or whether or not it would be appropriate to remove existing IDIQ Contract holders. This will be done via the use of an “on and off ramp” concept.
ON RAMP
Consistent with FAR 16.504(c)(1)(ii)(A), the Contracting Officer has determined that it is in the Government's best interest that at all times during the term of the Basic Contract, there remain an adequate amount of competition under the SRW Appliqué Radio Multiple Award IDIQ Contract suite. As a result, periodically, the Contracting Officer will assess the Government’s requirements, technology available in open market, quality of the performance by each IDIQ holder, the number, value and complexity of work assigned to each holder, and the amount of competition achieved. Based on these criteria, if it is in the best interest of the Government, the Contracting Officer may conduct an “on ramp” to add additional Contract holders to this Contract provided that:
(i) Notice of an “on ramp,” containing a solicitation for Contractors to respond to, is publicized on the Army Single Face to Industry (ASFI) website;
(ii) The solicitation identifies the total approximate number of new awards that the Contracting Officer intends to make. The Contracting Officer may decide to award more or fewer Contracts than the number anticipated in the solicitation depending upon the overall quality of the offers received;
(iii) The award decision under any solicitation is based upon substantially the same evaluation factors/sub-factors as the original solicitation;
(iv) The terms and conditions of any resulting awards from a new solicitation are materially identical to the existing version of the Basic Contract;
(v) The term for any such new awards from a solicitation is co-terminus with the existing ordering period for all other Contractors;
(vi) If awarded a Contract, any new Contractor is eligible to submit a proposal in response to any RFP and receive Order awards with the same rights and obligations as any other Contractor; and
(vii) The award of any new Contract(s) does not increase the overall ceiling of the Basic Contract.
(viii) Existing Contractors shall not hold more than one Basic Contract at any time;
OFF RAMP
To ensure success of the SRW Appliqué Radio Multiple Award IDIQ Contract suite, each prime Contractor is expected to participate in the ordering process by submitting proposals, that are found to be acceptable in accordance with the requirements of the request for proposal (RFP), for which the Government determines that the Contractor has a reasonable chance for award, and to successfully perform the terms of their Orders. If a Contractor does not meet these expectations, it is the Government's intent to "off-ramp" the Contractor by:
(i) Executing a no-cost settlement in accordance with FAR 49.101(b), if applicable; or
(ii) Implementing a termination for convenience, if applicable and only if such action is in the Government's best interest; or
(iii) Implementing a termination for default, if applicable Travel Travel throughout the continental US (CONUS) and outside continental US (OCONUS), to include hazardous and isolated locations, will be required during the performance of this contract.
Period of Performance This contract shall have a five year ordering period with five one-year ordering period options.
Information Security Requirements Contractor personnel performing work under this contract must have a security clearance up to secret level at time of the proposal submission, and must maintain the level of security required for the life of the contract (to include throughout the warranty period). The security requirements are in accordance with the DD-254 associated with this contract.
In performing this contract, the contractor will have access to classified information, will receive and generate classified material and fabricate, modify and store classified hardware and software. The work performed by the Contractor will require access to unclassified, For Official Use Only (FOUO), and Secret data, information, and spaces.
The Contractor will require access to various Security or Program Classification Guide(s) (SCG), the Secret Internet Protocol Router Network (SIPRNET), and Tactical Networks. The Contractor will require a Communications Security (COMSEC) account and a Defense Technical Information Center (DTIC) account.
Operational Security (OPSEC) requirements will be provided by the Government IAW AR 530-1.
Contractor personnel performing Information Technology sensitive duties are subject to investigative and assignment requirements in accordance with AR 25-2 (Information Assurance), AR 380-67 (Personnel Security Program), and affiliated regulations.
Foreign subcontractor participation will be handled in accordance with AR 380-10 (Foreign Disclosure and Contacts with Foreign Representatives), CECOM Regulation 380-16 (Industrial Security), National Disclosure Policy, and affiliated regulations and supplements to include Directive-Type Memorandum (DTM) 09-019 - Policy Guidance for Foreign Ownership, Control, or Influence (FOCI) , September 2, 2009.
The SRW Radio System has a TEMPEST requirement.
Physical Security The Contractor shall be responsible for safeguarding all government equipment, information, and property provided for contractor use.
Threshold (t) and Objective (o) Capabilities The PWS requirements are defined as either Threshold or Objective requirements. The Threshold requirements are indicated by a “(t)” and the Objective requirements are indicated by an “(o)” in the PWS. A threshold is defined as the Government’s minimum requirement. An objective is defined as a desired performance characteristic that exceeds the minimum requirement. When an objective value is listed in conjunction with a threshold value it must be understood that the threshold value represents the minimum requirement that must be met while the objective value represents the desired performance characteristic. Objective requirements need not be met for initial contract award. The Government reserves the right to convert objectives to thresholds at the Delivery Order level.
In some cases, the Threshold (t) requirement and Objective (o) requirement are included with the intent of achieving one performance capability. For example, the Threshold requirement may be a data completion rate of 92% or better while the Objective data completion rate is 97% or better. When there is a Threshold and Objective requirement within the same performance arena, and the Contractor’s solution meets the Objective requirement, there is no requirement to also meet the Threshold requirement.
To ensure Objective requirements provide enhanced capability, there are minimum standards within the Objective requirements that the Offeror shall meet if you offer against an Objective Requirement. For example, Dismounted Radio is an Objective (o) requirement; you do not have to offer a Dismounted Radio. However, it you do offer a Dismounted Radio you shall also offer the Threshold (t) battery power source for the Dismounted Radio.
The intent of this contract is for the successful Offerors to continuously improve their SRW Radio Systems. Thus, in future fair opportunity competitions, the Contractor may choose to offer additional capabilities not currently required by this Performance Work Statement (PWS). Contractors are encouraged to offer these additional capabilities for Government consideration. However, the Government, depending upon the evaluation criteria set forth in the delivery order, may or may not elect to assign additional value to the offered capabilities.
Reference Material The following specifications and standards form a part of this document to the extent specified herein. The specifications and standards in effect at contract award shall be the revision listed in the Department of Defense Index of Specifications and Standards (DODISS) at the time of contract award. Many documents not called out herein also apply IAW the Contractor’s best practices.
