About this file
This is a Vendor Preference Certificate form issued by the State of West Virginia, applicable to non-construction contracts under West Virginia Code 5A-3-37. The document serves as an application mechanism for qualifying vendors to request preference consideration based on their residency status at the time of bid submission. The preference, when applicable, is evaluated as a cost adjustment method and applied solely to the bid amount in accordance with state code.
The certificate outlines seven categories of vendor preference eligibility. Vendors may apply for 2.5% resident vendor preference if they are individual residents with four years of continuous West Virginia residency, partnerships or corporations with principal places of business in the state for four years, nonresident vendors with in-state affiliates or subsidiaries employing at least one hundred state residents, or resident vendors certifying that 75% of project employees are West Virginia residents with two years of continuous state residency. Additional 2.5% preference applies to nonresident vendors meeting equivalent employment thresholds. A 5% preference is available to bidders meeting both subdivision requirements simultaneously. Veteran-owned resident vendors qualify for 3.5% preference under specified residency and employment conditions. Non-resident small, women- and minority-owned businesses certified or expected to be approved by the Purchasing Division may also apply for preference. Bidders must certify truthfulness under penalty of law and agree to disclose requested information to the Purchasing Division and authorize the Department of Revenue to verify tax compliance. Penalties for misrepresentation may reach 5% of the bid amount, enforceable through bid rejection or deduction from contract balances. Bidders must notify the Purchasing Division immediately of any changes affecting preference eligibility during contract performance.
