About this file
This is a Purchasing Affidavit form mandated by the State of West Virginia under W. Va. Code 5A-3-10a. The form serves as a certification requirement for all vendors and prospective vendors seeking to enter into contracts or contract renewals with the state or its political subdivisions. The affidavit requires vendors to affirm under penalty of law that neither they nor any related parties owe debts exceeding one thousand dollars in aggregate to the state or its political subdivisions, and that neither the vendor nor related parties are in employer default status. Related parties are defined as individuals, corporations, partnerships, associations, limited liability companies, or other business entities with ownership or contractual relationships to the vendor that would result in receiving or controlling benefits, profits, or considerations equal to or exceeding five percent of the total contract amount.
The affidavit contains an exception to the debt prohibition for vendors that have contested taxes, workers' compensation premiums, permit fees, or environmental assessments and have not reached final judgment, or for vendors that have entered into payment plans or agreements and remain in compliance. Employer default is defined to include outstanding balances or liabilities to workers' compensation funds, policy defaults, failure to maintain mandatory workers' compensation coverage, or failure to meet obligations as a self-insured employer; however, employers with repayment agreements with the Insurance Commissioner who remain compliant are not considered in default. The form requires the vendor's authorized signer to execute the affidavit before a notary public, with the vendor's name, authorized signature, date, state, and county information completed and the notary seal affixed.
