About this file
This is a Department of Veterans Affairs (VA) memorandum announcing a class deviation to the VA Acquisition Regulation (VAAR) Parts 822 and 852, effective immediately as of April 1, 2025.
The deviation requires all VA contracting activities to include clause 852.222-71, "Compliance with Executive Order 13899," in solicitations and contracts that use appropriated funds and exceed the simplified acquisition threshold (SAT). Contracting officers must incorporate this clause into new solicitations going forward and amend existing contracts exceeding the SAT that are not physically complete or have more than six months remaining until expiration. The new clause mandates that contractors comply with Executive Order 13899 (Combating Anti-Semitism) pursuant to Title VI of the Civil Rights Act of 1964. Contractors must timely disclose in writing to the Contracting Officer any credible evidence that a principal, employee, agent, or subcontractor has committed a violation under the Executive Order in connection with contract award, performance, or closeout. Additionally, contractors must flow down these terms and conditions to all subcontractors and vendors. The deviation applies to all VA contracting activities with no exceptions, and it expires when incorporated into the VAAR or otherwise rescinded. Questions regarding implementation should be directed to va.procurement.policy@va.gov.
