Phase I Environmental Site Assessment and Interior Demolition & Abatement Project
This Phase I Environmental Site Assessment, prepared by Terracon Consultants, Inc. in October 2024 for the City of Waxahachie, Texas, evaluates the property at 401 South Rogers Street (a 1.34-acre tract improved with a 14,456-square-foot, two-story vacant City Hall building) in accordance with ASTM E1527-21 standards. The assessment identified four Recognized Environmental Conditions (RECs) requiring additional subsurface investigation: a former 1,400-gallon diesel underground storage tank (UST) installed in 1976 and removed in 1995 (lacking documentation of tank hold location and remediation reports); former on-site automotive repair operations spanning 36 years (1959-1995) at 407 and 415 South Rogers Street with potential chlorinated solvent use; former on-site automotive paint and body works operations spanning 38 years (1959-1995) at 408 and 504 Washington Street and 408 South College Street with potential chlorinated solvent use; and a former service station with car wash located approximately 50 feet west of the site (1942-1964) operating for 22 years with potential chlorinated solvent use. The assessment's historical review examined Sanborn Maps from 1890 through 1964, aerial photographs spanning 1942-2023, and city directories from 1922-2023 to document historical land use patterns and identify potential environmental concerns.
The related Interior Demolition & Abatement Project solicitation (ITB-2026-3-1) issued by the City of Waxahachie requires qualified contractors to perform complete interior demolition and comprehensive hazardous materials abatement on the same property. A mandatory pre-bid meeting and site visit is scheduled for April 7, 2026, at 1:30 p.m., with written questions due by April 17, 2026, at 10:00 a.m. and sealed bids due by April 22, 2026, at 10:00 a.m. Central Time via electronic bidding portal at https://procurement.opengov.com/portal/waxahachie-tx. Bid opening will occur on April 22, 2026, at 10:15 a.m. via Microsoft Teams, with anticipated work commencement in May 2026. Contractors must hold a valid Texas Asbestos Abatement Contractor License, maintain a minimum of three years of documented commercial demolition experience, and provide commercial general liability insurance of $1,000,000 per occurrence ($2,000,000 aggregate), business auto liability of $1,000,000, and workers' compensation at statutory limits. Performance and payment bonds equal to 100% of the total awarded contract price are required. The scope includes removal of interior finishes, mechanical/electrical/plumbing systems, and designated architectural elements (crown molding, coffered ceiling molding, exterior window casings) with careful documentation and salvage. A July 2024 asbestos survey identified regulated asbestos in floor tile and black mastic on the second floor; a November 2024 lead-based paint inspection documented lead concentrations exceeding EPA thresholds in both the 1914 North Building and 1950 Center Building. The contract will be awarded to the lowest responsive and responsible bidder at the City's sole discretion, with no set-aside restrictions identified; the procurement is conditioned upon availability of appropriated funds.

Executive Summary
This Phase I Environmental Site Assessment (ESA) was performed in accordance with Terracon Proposal P94247B37 dated September 24, 2024, and was conducted consistent with the procedures included in ASTM E1527-21, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process. The purpose of this ESA was to assist the client in developing information to identify RECs in connection with the site as reflected by the scope of this report. The ESA was conducted under the supervision or responsible charge of Meghan N. Espinoza, Environmental Professional.
Madison M. Fields performed the site reconnaissance on October 3, 2024.
Findings and Opinions
A summary of findings is provided below. It should be recognized that details were not included or fully developed in this section, and the report must be read in its entirety for a comprehensive understanding of the items contained herein.
Site Description and Use
The site consists of an approximate 1.34-acre tract of land located at 401 South Rogers Street in Waxahachie, Ellis County, Texas. The site is improved with an approximate two-story 14,456-square foot (sf) vacant city hall building. It should be noted that the northern portion of the building sits at a lower elevation than the central and southern portions of the building. The northern portion of the building had two loft areas that formerly operated as office space. Additional improvements include a concrete paved parking lot, landscaped grounds and utilities.
Historical Information
The historical information for the site was divided into three portions (Northern, Central and Southern) and are described below:
Northern Portion of the site
Historically, the northern portion of the site was improved with a hotel (Dillon Hotel and Southern Hotel) and a drug store from at least 1890. By 1893, the drug store was converted into a dwelling until it was converted once more into the Oriental Hotel by 1904. By 1898, the Southern Hotel was redeveloped into a wagon yard until it was removed by 1904. Additionally, a small-scale warehouse building, and black smith building were developed by 1890 and 1909. The existing post office building (present day City Hall) was constructed by 1914. By 1925, two stores were present on the northern portion of the site, and by 1959, a feed store was constructed before it was removed by the early 1980s. The northern portion of the site has remained relatively unchanged since the early 1980s.
October 15, 2024 | Terracon Project No. 94247B37
Facilities | Environmental | Geotechnical | Materials v
Central Portion of the site
The central portion of the site was improved with a dual black smith and wagon shop since at least 1893 until it was removed by the late 1890s. By 1904, a stable and a woodshed were constructed until the stable was removed by 1914. By 1959, a used auto sales dealership and auto repair building (historically addressed at 407 and 415 South Rogers Street) were constructed, until the buildings were removed by 1995.
Additionally, a store was constructed by 1959, until the building was removed by the early 1960s.
The used auto sales dealership with an associated automotive repair building (historically addressed at 407 and 415 South Rogers Street) were occupied by Feaster & Company Used Car, C R Feaster & Company, J P Hodges Used Cars, and J B Cowan Motor Company from 1961 through 1991. Based on a review of the Sanborn Maps and aerial photographs, the automotive repair building was present from at least 1959 until 1995.
The facility was not identified in the regulatory database report. Based on the absence of regulatory status, potential use of chlorinated solvents, and duration of operations (36 years), the former automotive repair operations constitute a recognized environmental condition (REC) to the site.
Southern Portion of the site
The southern portion of the site was improved with a drug store from at least 1890. By 1893, the drug store was converted into a residence until it was removed by 1898. By 1925, a grain and fuel warehouse was present. Additionally, by 1925 a candy store was present on the southeastern portion of the site until it was converted into an auto paint and body works (historically addressed at 408 and 504 Washington Street and 408 South College Street) by 1959. By 1995, the auto paint and body works facility was removed. By 1979, a small-scale commercial building was developed until it was removed by 1990.
Based on a review of city directories, the auto paint and body works (historically addressed at 408 and 504 Washington Street and 408 South College Street) was occupied by Johns Paint & Body Shop, Woolleys Paint & Body Shop and Doug's Body Shop from 1961 through 1997; however, according to the Sanborn Maps, the facility operated an automotive repair facility since at least 1959. The facility was not identified in the regulatory database report. Based on the absence of regulatory status, potential use of chlorinated solvents, and duration of operations (38 years), the former automotive paint and body works constitutes a REC to the site.
By 2004, the remaining central and southern additions to the city hall building were constructed onto the northern former post office building. The site has remained relatively unchanged since 2004.

Surrounding Properties
Historically, the surrounding properties consisted of West Madison Street to the north, South College Street (formerly Washington Street) to the east, and South Rogers Street to the west with urban development from at least 1890.
North Adjacent
The northern adjacent property consisted of urban development with a wagon yard to the northeast from at least 1890. By 1904, the northeast adjacent property was redeveloped with a feed store and later an auto storage facility by 1925. By the early 1950s and late 1950s, the northeastern adjoining property had then been further developed with a used auto sales and auto garage until the existing county jail was constructed by 1990 and expanded by 2004.
The auto storage, used auto sales and an auto garage to the adjacent northeast were not identified in the regulatory database report. Based on a review of the Sanborn Maps, the auto repair operation occurred approximately 215 northeast of the site in a topographic cross-gradient position relative to the site. Based on the distance and gradient, the automotive operations to the northeast do not constitute a REC to the site.
The northern adjoining property has remained relatively unchanged since 2004.
East Adjacent
The eastern adjacent property consisted of urban development since at least 1890 with a rail freight warehouse by 1909. The warehouse building was later converted into the existing brewery by 1959. Urban development continued until the existing county jail was constructed by 2010.
South Adjacent
The southern adjoining property consisted of a partial vacant lot with a structure from at least 1890. By 1893, the southern adjoining property operated as a lumber yard until the associated structures were removed by 1904. By 1909, the existing train station (current Nay Company) was developed. By 1925, a grain and fuel warehouse partially extended onto the southern adjoining property (primarily on-site). A dwelling was constructed to the south by the late 1950s, until the residence was removed by the early 1960s. The southern adjoining property has remained relatively unchanged since 1964.
West Adjacent
The western adjacent property consisted of a primarily vacant lot from at least 1890 with a furniture store, located beyond South Rogers Street. By 1909, the furniture store was converted into lumber operation until the lumber associated buildings were removed

Facilities | Environmental | Geotechnical | Materials vii by 1981. By 1909, a machine shop was present. By 1925, a parking garage building with a filling station (historically addressed at 406, 404 and 410 South Rogers Street) was present. The parking garage building was converted into a tractor sales and service building with a gas tank by 1959, until the structure was removed by 2020.
The filling station (historically addressed at 406, 404 and 410 South Rogers Street) to the adjacent west, was identified in the 1925 Sanborn Map. The station was not identified in the regulatory database report. The former filling station was located approximately 50 feet west of the site in a topographic up to cross-gradient position relative to the site. Based on the distance and duration since operations ceased (99 years), the filling station does not constitute a REC to the site.
Based on a review of the Sanborn Maps, the tractor sales and service building to the adjacent west had a gasoline tank located in front of the building situated within South Rogers Street. The facility was not identified in the regulatory database report. The gasoline tank was located approximately 30 feet west of the site in a topographic up to cross-gradient position relative to the site. South Rogers Street appears to have been improved by the late 1980s. The western adjacent property was later redeveloped with a city building by 2023. Based on the absence of regulatory status and redevelopment to the adjoining/adjacent west, the gas tank does not constitute a REC to the site.
An additional filling station with a car wash (historically addressed at 400, 408, 409 South Rogers Street, and 101-105 (odd) and 111 Madison Street) was present to the northwest from at least 1942, until the structures were removed by 1964. According to the city directories, the occupant, Tittle Service Station 2 was in operation in 1961.
Based on a review of Sanborn Maps and aerial photographs, the service station was removed by 1961. The facility was not identified in the regulatory database report. The facility building was located approximately 50 feet northwest of the site in a topographic up to cross-gradient position relative to the site. Based on the proximity to the site, potential use of chlorinated solvents, and duration of operations (at least 22 years), the western adjacent former service station/filling station constitutes a REC to the site.
Furthermore, a used auto sales and auto radiator and glass repair were present to the west from at least 1942 until 1964. Based on a review of historical information, the used auto sales and auto radiator and glass repair was located approximately 95 feet northwest of the site in a topographic up to cross-gradient position relative to the site.
The facility was not identified in the regulatory database report. Based on the absence of regulatory status, distance and gradient, the used auto sales and auto radiator and glass repair do not constitute a REC to the site.
The western adjacent property was redeveloped with the existing city building by 2023.

Records Review
Selected federal and state environmental regulatory databases, as well as responses from state and local regulatory agencies were reviewed. The site was identified in the Environmental Protection Agency (EPA) Facility Registry Service (FINDS/FRS) and Integrated Compliance Information System (ICIS) and Texas Commission on Environmental Quality (TCEQ) Petroleum Storage Tank (PST) databases. The FINDs listings appear to be associated storm water construction in 2020. According to the database report, one steel single-wall constructed 1,400-gallon diesel underground storage tank (UST) was installed on-site in 1976 and was removed from the ground in 1995. Terracon requested additional files from the TCEQ regarding the tank hold location and soil/groundwater investigation reports; however, the TCEQ did not have files available. Based on the absence of information pertaining to the tank hold location and investigation / remediation reports, the former tank hold constitutes a REC to the site.
The facility listings are further discussed in Section 4.1.
Numerous off-site facilities were identified in the regulatory database report. Based on the regulatory status, distance and gradient, the listed facilities do not constitute a REC to the site.
Site Reconnaissance
During the site reconnaissance, the following features were observed: an emergency generator, one hydraulic elevator and associated equipment, heating and/or cooling system, floor drains, a sump, two pole-mounted transformers, one pad-mounted transformer, and a dumpster.
The hydraulic elevator was observed within the central portion of the building. The equipment for the hydraulic elevator is located within an elevator equipment room adjacent to the elevator. According to Mr. Sigler, the elevator was installed in 2000 and was serviced by Overland & Associates Inc. in 2023. No issues had been reported associated with the elevator. Evidence of staining or leaking was not observed in the vicinity of the hydraulic equipment. Terracon was unable to view the elevator pit at the time of the site reconnaissance. Based on the information above, the hydraulic elevator does not constitute a REC to the site.
The observed features are further discussed in Section 5.4.
Prior Report
Vantage Environmental Services, LP (Vantage) was requested by the City of Waxahachie to conduct an asbestos survey of the Waxahachie City Hall building on-site in 2024.
According to the report, 117 samples of suspect asbestos containing materials (ACM) were collected throughout the building. Of the samples collected, two were confirmed to

Facilities | Environmental | Geotechnical | Materials ix contain regulated amounts of asbestos. The samples containing asbestos were collected on the second floor (identified as the third floor in the Vantage report) and were obtained from the floor tile and black mastic. Vantage stated that if renovation or demolition activities affect or disturb other suspect asbestos containing materials not sampled as part of the survey, then these materials must be analyzed for asbestos content or presumed to contain asbestos and abated.
Additionally, Vantage recommended the following:
It is recommended that the employees be made aware of the presence of the ACM in their work area. The survey report should be adequate documentation for achieving this purpose.
During renovation of the building, if the discussed ACMs are to be disturbed by construction activities, their removal must be undertaken by a licensed asbestos contractor.
An Operations and Maintenance (O&M) Program should be instituted as an interim control measure to maintain the ACMs are in good condition. This program should remain in effect until major renovations or demolition require removal, or until the materials change in condition. The program includes a one-time training class for your personnel who work adjacent to ACMs.
OSHA Hazard Communication Standards require notification and training of employees about asbestos, as well as other hazardous materials. An annual re-surveillance, which includes periodic air monitoring and a visual re-inspection assessment of the AMCs. The purpose of which is to maintain your workplace in an asbestos hazard free manor.
Adjoining Properties
Based on area observations, the adjoining properties consist of West Madison Street to the north, followed by three multi-tenant retail strips (first retail building: occupied by Atelier), (second retail building: occupied by Jordan E’s Popcorn and Candy Company, Blume Boutique, Velvet Angel Boutique, DeDon’s Re-Creations), and (third retail building: occupied by Gingerbread Antiques and Farmhouse / The Dove Nest); South College Street to the east, followed by Ellis County Jail; The Nay Company to the south;
and South Rogers Street to the west, followed by a partial parking lot and Charles Beatty Municipal Services Building. RECs were not identified with the current surrounding properties.
Significant Data Gaps
No significant data gaps (SDGs) were identified during the course of the assessment.

This purpose was undertaken through user-provided information, a regulatory database review, historical and physical records review, interviews (including local government inquiries, as applicable), and a visual noninvasive reconnaissance of the site and adjoining properties. Limitations, ASTM deviations, and significant data gaps (if identified) are noted in the applicable sections of the report.
PFAS are a family of compounds which are considered emerging contaminants of concern due to their mobility and longevity in the environment. PFAS has been used in many products, including but not limited to fire-fighting foam, anti-stick coatings, stain and water-repellent coatings, electroplating, and paper products, among others. On July 8, 2024, US EPA designated two PFAS compounds, perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), including their salts and structural isomers, as hazardous substances under CERCLA; accordingly, PFOA and PFOS will be evaluated within the scope of E1527-21. Please note that PFAS compounds are ubiquitous in the environment and this limited review is not to be construed as confirmation that PFAS compounds are not present in, at or under the site.
1.3 Standard of Care
This ESA was performed in accordance with generally accepted practices of this profession, undertaken in similar studies at the same time and in the same geographical area. We have endeavored to meet this standard of care, but may be limited by conditions encountered during performance, a client-driven scope of work, or inability to review information not received by the report date. Where appropriate, these limitations are discussed in the text of the report, and an evaluation of their significance with respect to our findings has been conducted.
Phase I ESAs, such as the one performed at this site, are of limited scope, are noninvasive, and cannot eliminate the potential that hazardous, toxic, or petroleum substances are present or have been released at the site beyond what is identified by the limited scope of this ESA. In conducting the limited scope of services described herein, certain sources of information and public records were not reviewed. It should be recognized that environmental concerns may be documented in public records that were not reviewed. No ESA can wholly eliminate uncertainty regarding the potential for RECs in connection with a property. Performance of this practice is intended to reduce, but not eliminate, uncertainty regarding the potential for RECs. No warranties, express or implied, are intended or made. The limitations herein must be considered when the user of this report formulates opinions as to risks associated with the site or otherwise uses the report for any other purpose. These risks may be further evaluated – but not eliminated – through additional research or assessment. We will, upon request, advise

1.4 Additional Scope Limitations, ASTM Deviations, and Data Gaps
Based upon the agreed-on scope of services, this ESA did not include subsurface or other invasive assessments, vapor intrusion assessments or indoor air quality assessments (i.e., evaluation of the presence of vapors within a building structure), business environmental risk evaluations, or other services not particularly identified and discussed herein. Credentials of the company (Statement of Qualifications) have not been included in this report but are available upon request. Pertinent documents are referred to in the text of this report, and a separate reference section has not been included. Reasonable attempts were made to obtain information within the scope and time constraints set forth by the client; however, in some instances, information requested is not, or was not, received by the issuance date of the report. Information obtained for this ESA was received from several sources that we believe to be reliable;
nonetheless, the authenticity or reliability of these sources cannot and is not warranted hereunder.
An evaluation of the significance of limitations and missing information with respect to our findings has been conducted, and where appropriate, significant data gaps are identified and discussed in the text of the report. However, it should be recognized that an evaluation of significant data gaps is based on the information available at the time of report issuance, and an evaluation of information received after the report issuance date may result in an alteration of our conclusions, recommendations, or opinions. We have no obligation to provide information obtained or discovered by us after the issuance date of the report, or to perform any additional services, regardless of whether the information would affect any conclusions, recommendations, or opinions in the report. This disclaimer specifically applies to any information that has not been provided by the client.
This report represents our service to you as of the report date and constitutes our final document; its text may not be altered after final issuance. Findings in this report are based upon the site’s current utilization, information derived from the most recent reconnaissance and from other activities described herein; such information is subject to change. Physical Setting Information Source
Formation Austin Chalk
Bureau of Economic Geology, The University of Texas at Austin, Geologic Atlas of Texas
Dallas Sheet, 1972 Revised 1987
Description
The site is underlain by the Austin Chalk Limestone which is up to 500 feet thick in the site area. The Austin Chalk consists of resistant, massive, chalky limestone members separated by occasional thin shale, bentonitic beds and a middle marl member. At the surface, the Austin Chalk is typically weathered and consists of a yellowish-gray fractured limestone. Groundwater is typically present in the weathered portion of the Austin Chalk and usually occurs as a perched water table on top of the unweathered Austin Chalk.
Estimated Depth to First Occurrence of Groundwater
Approximately 30 feet below ground surface (bgs)
Based on Terracon’s experience with the site vicinity
*Hydrogeologic Gradient
Not known - may be inferred to be parallel to topographic gradient (primarily to the south-southeast).
* The groundwater flow direction and the depth to shallow, unconfined groundwater, if present, would likely vary depending upon seasonal variations in rainfall and other hydrogeological features. Without the benefit of on-site groundwater monitoring wells surveyed to a datum, groundwater depth and flow direction beneath the site cannot be directly ascertained.
3.0 Historical Use Information

The western adjacent property was later redeveloped with a city building by 2023. Based on the absence of regulatory status and redevelopment to the adjoining/adjacent west, the gas tank does not constitute a REC to the site.
The filling station (historically addressed at 406, 404 and 410 South Rogers Street) to the adjacent west was identified in the 1925 Sanborn Map. The station was not identified in the regulatory database report. The former filling station was located approximately 50 feet west of the site in a topographic up to cross-gradient position relative to the site.
Based on the distance and duration since operations ceased (99 years), the filling station does not constitute a REC to the site.
The filling station with a car wash (historically addressed at 400, 408, 409 South Rogers Street, and 101-105 (odd) and 111 Madison Street) to the adjacent west was not identified in the regulatory database report and are further discussed in Section 3.2.
Based on a review of historical information, the used auto sales and auto radiator and glass repair were present from at least 1942 through 1964. The occupant was located approximately 95 feet northwest of the site in a topographic up to cross-gradient position relative to the site. The facility was not identified in the regulatory database report. Based on the absence of regulatory status, distance and gradient, the used auto sales and auto radiator and glass repair do not constitute a REC to the site.
