About this file

This is a Questions and Responses document (Amendment 0004) for federal contract SPE603-26-R-0522 in Davao, Philippines, addressing technical and contracting matters related to a storage facility project.

Technical Requirements: The Government has no preference regarding minimum or maximum individual tank sizes, the use of more than two tanks per product, or tank configuration. Additional storage capacity beyond the specified amount in PWS Paragraph 1.3 is not required. The Government requested clarification on whether full awarded fill capacity for both products must be simultaneously available at all times.

Schedule and Performance Period: The 18-month delivery deadline is firm, with the contract performance period beginning only after facility inspection and acceptance by DLA. Should the contractor fail to deliver within 18 months, penalties may include loss of revenue and negative CPARS ratings. If delivery is delayed by six months, the contract period and performance duration will be proportionally reduced, resulting in reduced revenue (for example, three years of revenue instead of 3.5 years). Contract period reductions or extensions beyond the standard terms will be determined on a case-by-case basis.

Pricing: Standard price revisions occur through final proposal revision requests. The Government may consider price adjustments if award extends beyond the 180-day award period and negotiations have been concluded, allowing contractors to account for market condition changes due to extended delays.

CONTRACTING

SCHEDULE, READINESS, AND DELAYS

1. If we cannot deliver the storage facility within 18 months and the operation start date is delayed for say 6 months, would that reduce our contract period by 6 months? Or are we allowed to compress our contract value to account for the 6 months lost due to delay? Or are we going to get an extension of 6 months?

Answer: The contract period could be reduced, and payment would reflect the delay. An extension may be considered; however, both the reduction or the extension will be determined on a case-by-case basis.

2. Assuming the contractor is delayed by six months, will the delay reduce the performance period (i.e., the contractor earns revenue for only three years instead of 3.5 years)?

Answer: Yes, the contract period would be reduced, and payment would reflect the delay.

3. Will the contractor be penalized if it fails to deliver within 18 months? If so, what are the possible penalties?

Davao, Philippines

Answer: Should the contractor fail to deliver the operational facility within 18 months, the penalties may include but are not limited to the loss of revenue and negative CPARS ratings.

Period of performance will begin once the facility has been inspected and accepted by DLA.

SOLICITATION AMENDMENTS AND SITE LOCATIONS

4. If the award date is further extended, are we allowed to revise our price as market conditions would change with such delays?

Answer: Price revisions occur with the request of final proposal revisions. We may consider revisions if we go beyond the 180 day award period and have already concluded negotiations.
