About this file
This document is an Addendum to FAR 52.212-4 for Contract Terms and Conditions related to Commercial Products and Commercial Services, issued by DLA Energy in November 2023. The addendum replaces a discontinued provision (DLA Requirement Page Text I209.09 Extension Provisions) for solicitation SPE60125R0303 and adds a new paragraph governing contract extensions.
The key provision allows the government to extend the contract one or more times for a total period not exceeding six (6) months, with the contractor to be notified at least 30 days before the contract's expiration. The extension is effective upon the DLA Energy Contracting Officer's written notification, and the extension can proceed even if the required notice is not provided within the specified timeframe. The extension will maintain the same terms and conditions as the original contract.

ADDENDUM TO FAR 52.212-4
52.212-4Contract Terms and Conditions—Commercial Products and Commercial Services
(NOV 2023)
ADDENDUM to FAR 52.212-4: Contract Terms and Conditions – Commercial Products and Commercial Services
The following addendum is necessary due to the discontinuation of DLA Requirement Page Text I209.09 Extension Provisions (DLA Energy Jan 2012), previously referenced in solicitation SPE60125R0303, to govern the 6-month contract extension period and replace the language contained within that discontinued provision.
Add paragraph (w) Industry-Specific Extension:
(i) Option to Extend: The Government may extend this contract, under the same terms and conditions, one or more times for a total period not exceeding six (6) months. The Government will provide written notice of any contract extension to the Contractor at least thirty (30) days before the expiration of the contract ordering period or any extension thereof. This provision does not prevent the Contractor from agreeing to a contract extension even if the DLA Energy Contracting Officer fails to provide the required notice within the specified thirty (30) day timeframe.
(ii) Effective Date of Extension: Extension of this contract is effective upon the DLA Energy Contracting Officer's issuance of written notification to the Contractor.
(End of Addendum)
