About this file
This document is an Addendum to FAR 52.212-4 for Contract Terms and Conditions related to Commercial Products and Commercial Services, issued by DLA Energy in November 2023. The addendum provides specific guidelines for contract extension provisions, replacing a previously discontinued DLA Requirement Page Text.
The key extension terms allow the Government to extend the contract under the same conditions one or more times, with a total extension period not exceeding six months. The Government must provide written notice to the contractor at least 30 days before the contract expiration, though the contractor can still agree to an extension even if this notice is not timely provided. The contract extension becomes effective upon the DLA Energy Contracting Officer's written notification to the contractor.

ADDENDUM TO FAR 52.212-4
52.212-4Contract Terms and Conditions—Commercial Products and Commercial Services
(NOV 2023)
ADDENDUM to FAR 52.212-4: Contract Terms and Conditions – Commercial Products and Commercial Services
The following addendum is necessary due to the discontinuation of DLA Requirement Page Text I209.09 Extension Provisions (DLA Energy Jan 2012), previously referenced in solicitation SPE60125R0303, to govern the 6-month contract extension period and replace the language contained within that discontinued provision.
Add paragraph (w) Industry-Specific Extension:
(i) Option to Extend: The Government may extend this contract, under the same terms and conditions, one or more times for a total period not exceeding six (6) months. The Government will provide written notice of any contract extension to the Contractor at least thirty (30) days before the expiration of the contract ordering period or any extension thereof. This provision does not prevent the Contractor from agreeing to a contract extension even if the DLA Energy Contracting Officer fails to provide the required notice within the specified thirty (30) day timeframe.
(ii) Effective Date of Extension: Extension of this contract is effective upon the DLA Energy Contracting Officer's issuance of written notification to the Contractor.
(End of Addendum)
