The solicitation is hereby amended to incorporate the following:

1. Section I, FAR 52.212-5(b)(12)(i), Notice of Price Evaluation Preference for HUBZone Small Business Concerns (OCT 2014):

“(a) Definition. See 13 CFR 125.6(e) for definitions of terms used in paragraph (d).

(b) Evaluation preference.

(1) Offers will be evaluated by adding a factor of 10 percent to the price of all offers, except—

(i) Offers from HUBZone small business concerns that have not waived the evaluation preference; and

(ii) Otherwise successful offers from small business concerns.

(2) The factor of 10 percent shall be applied on a line item basis or to any group of items on which award may be made. Other evaluation factors described in the solicitation shall be applied before application of the factor.

(3) When the two highest rated offerors are a HUBZone small business concern and a large business, and the evaluated offer of the HUBZone small business concern is equal to the evaluated offer of the large business after considering the price evaluation preference, award will be made to the HUBZone small business concern.

(c) Waiver of evaluation preference. A HUBZone small business concern may elect to waive the evaluation preference, in which case the factor will be added to its offer for evaluation purposes. The agreements in paragraphs(d) and (e) of this clause do not apply if the offeror has waived the evaluation preference.

__ Offer elects to waive the evaluation preference.

(d) Agreement. A HUBZone small business concern agrees that in the performance of the contract, in the case of a contract for

(1) Services (except construction), at least 50 percent of the cost of personnel for contract performance will be spent for employees of the concern or employees of other HUBZone small business concerns;

(2) Supplies (other than procurement from a nonmanufacturer of such supplies), at least 50 percent of the cost of manufacturing, excluding the cost of materials, will be performed by the concern or other HUBZone small business concerns;

(3) General construction.

(i) At least 15 percent of the cost of contract performance to be incurred for personnel will be spent on the prime contractor’s employees;

(ii) At least 50 percent of the cost of the contract performance to be incurred for personnel will be spent on the prime contractor’s employees or on a combination of the prime contractor’s employees and employees of HUBZone small business concern subcontractors;

(iii) No more than 50 percent of the cost of contract performance to be incurred for personnel will be subcontracted to concerns that are not HUBZone small business concerns; or

(4) Construction by special trade contractors.

(i) At least 25 percent of the cost of contract performance to be incurred for personnel will be spent on the prime contractor’s employees;

(ii) At least 50 percent of the cost of the contract performance to be incurred for personnel will be spent on the prime contractor’s employees or on a combination of the prime contractor’s employees and employees of HUBZone small business concern subcontractors;

(iii) No more than 50 percent of the cost of contract performance to be incurred for personnel will be subcontracted to concerns that are not HUBZone small business concerns.

(e) A HUBZone joint venture agrees that the aggregate of the HUBZone small business concerns to the joint venture, not each concern separately, will perform the applicable percentage of work requirements.

(f)

(1) When the total value of the contract exceeds $25,000, a HUBZone small business concern nonmanufacturer agrees to furnish in performing this contract only end items manufactured or produced by HUBZone small business concern manufacturers.

(2) When the total value of the contract is equal to or less than $25,000, a HUBZone small business concern nonmanufacturer may provide end items manufactured by other than a HUBZone small business concern manufacturer provided the end items are produced or manufactured in the United States.

(3) Paragraphs (f)(1) and (f)(2) of this section do not apply in connection with construction or service contracts.

(g) Notice. The HUBZone small business offeror acknowledges that a prospective HUBZone awardee must be a HUBZone small business concern at the time of award f this contract. The HUBzone offeror shall provide the Contracting Officer a copy of the notice required by 13 CFR 126.501 if material changes occur before contract award that could affect its HUBZone eligibility. If the apparently successful HUBZone offeror is not a HUBzone small business concern at the time of award of this contract, the Contracting Officer will proceed to award to the next otherwise successful HUBZone small business concern or other offeror.”

2. Section J is updated to add Attachment VIII – Fueling Evolutions FY2016.

4. Section M is updated to add the following notes:

a. Amendment 0006 (posted to FBO 1/3/2017), Addendum to 52.212-2 Evaluation – Commercial Items, Factor 1:

Technical/Management is revised to add:

“Proposals submitted in response to this solicitation should be prepared in accordance with the ADDENDUM TO FAR 52.212-1 provision, and will be evaluated by a board of one or more Government personnel. The Source Selection Authority shall make a final selection based on each offeror’s ability to satisfy the requirements of the solicitation.

Basis for Award. The Government will award a firm fixed price contracts (NAS Whitbey Island) resulting from this solicitation to the responsible offeror(s) whose offer(s) conform to the solicitation will be most advantageous to the Government, price and other factors considered. Formal source selection procedures will be used for this procurement. As such this is a best value acquisition, employing a Tradeoff Process in which award may be made to other than the lowest priced offeror or other than the highest technically rated offeror, in accordance with FAR 15.101-1.

There are four evaluations factors for this acquisition: Factor 1 –Technical/Management (Sub-Factor #1:

Operations, Sub-Factor #2: Maintenance, Sub-Factor #3: Personnel/Training, Sub-Factor #4:

Safety/Environmental), Factor 2 – Past Performance, Factor 3 – Socioeconomic Proposal, and Factor 4 – Price.

The Technical/Management factor is significantly more important than Past Performance. Past performance is equal in importance to the Socioeconomic Proposal. Socioeconomic Proposal and Past Performance are more important than price. When combined, the non-price factors (Technical/Management, Past Performance, and Socioeconomic Proposal) are significantly more important than Price.

Each proposal will be evaluated for compliance with solicitation terms and conditions, the Performance Work Statement, FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014), and applicable DLA Energy Contract Provisions, established evaluation criteria and standards, as well as evaluation of any exceptions/deviations in accordance with DLA ENERGY M-0003 M72 – EVALUATION OF OFFERS (EXCEPTIONS/DEVIATIONS) (DLA ENERGY APR 1997) to determine if the offered exceptions/deviations are acceptable or material enough to make the offer completely or partially unacceptable.

Factor 1: Technical/Management

The Government will evaluate each offeror’s technical/management proposal based upon the offeror’s understanding of and capability to accomplish the work as stated in the solicitation. The technical/management evaluation will include an evaluation of risk. The offeror must demonstrate in its proposal a complete understanding of the Performance Work Statement provided in the solicitation.

The Technical/Management factor will be rated Outstanding, Good, Acceptable, Marginal or Unacceptable. The four subfactors, which are of equal importance will be rated Outstanding, Good, Acceptable, Marginal or Unacceptable. The subfactors will be evaluated separately and then combined to come up with an overall Technical/Management factor rating.

The subfactors are as follows:

Subfactor 1: Operations - Technical, managerial, and operational details of supporting normal and contingency operations, accounting, and fuel quality assurance/surveillance on multiple fuel systems capable of meeting all of DLA Energy’s service requirements.

Subfactor 2: Maintenance - Technical, managerial, and operational details of planning and conducting preventive and recurring maintenance and identifying and resolving corrective maintenance items and repairs.

Subfactor 3: Personnel/Training - Technical, managerial, and operational details to ensure contractor personnel have requisite skills and associated training to accomplish all government requirements.

Subfactor 4: Safety/Environmental – Technical, managerial, and operational details of planning and conducting operations in compliance with environmental laws and regulations and safety policies and procedures.

Overall technical/management evaluation ratings will be Outstanding, Good, Acceptable, Marginal or Unacceptable.

Note: Any offeror who receives a rating of Unacceptable or Marginal in this factor after final proposal revisions will not be eligible for award.

‘Any proposal that does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. The proposal is unawardable.

Any offeror that receives a rating of marginal or unacceptable in any subfactor in their proposal will be rated overall as marginal or unacceptable respectively.’

Factor 2: Past Performance.

The Government shall review the offeror's recent and relevant past performance and determine its quality and usefulness as it applies to this procurement. Additionally, the Government may use other data available to its evaluators, including but not limited to, the Past Performance Information Retrieval System (PPIRS), and the

Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, past and present customers and their employees, other subcontractors, and any others who may have useful and relevant information.

The past performance will be rated Acceptable or Unacceptable. A record or poor performance may be considered an indication that the offeror has failed to conform to contract requirements and/or to standards of good workmanship, adhere to contract schedules, including the administrative aspects of performance, provide reasonable and cooperative behavior and commitment to customer satisfaction, and/or display a business-like concern for the interests of the customer.

Evaluation for Joint Ventures and Teaming Arrangements will be performed by evaluating the past performance of each partner in accordance with the procedures outlined above. The ratings for each partner will be combined and the Joint Venture or Teaming Arrangement will receive one rating.

Offerors are instructed to submit three Past Performance Questionnaires that may include the performance still in progress; however, it should have a minimum of one year of performance history and no more than three years old from the closing date of this solicitation. The past performance evaluation shall consider whether the offeror’s relevant present/past performance effort involved similar magnitude of effort and complexities this solicitation requires. The evaluation shall also evaluate the offeror’s past performance to determine how well the offeror performed on those efforts.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability, “Unknown” shall be considered Acceptable. A record of acceptable past performance will not result in a favorable assessment of an otherwise unacceptable proposal. As a Joint Venture, each partner’s experience and past performance may be evaluated and weighted against their respective roles identified in the Joint Venture agreement. This evaluation may be combined for a final past performance rating.

Note: A proposal receiving a rating of Unacceptable in this factor after final proposal revisions will be ineligible for award.

Factor 3: Socioeconomic/Subcontracting Proposal:

Small Business offerors will be evaluated on their submitted Socioeconomic/Subcontracting Proposal goals in accordance withDFARS 215.304(c)(1) and contract provision M-0001 M7 Socioeconomic Evaluation. For other than small businesses, offerors will be evaluated on their submitted Socioeconomic Proposal and its accurate reflection on Attachment 5 DLA Energy SMALL BUSINESS Subcontracting Plan in accordance with FAR 19.704. Upon consideration of the offeror’s proposed subcontracting to Small Business, HUBZone Small Businesses, Service-Disabled Veteran-Owned Small Businesses, Small Disadvantaged Businesses, and Women-Owned Small Businesses, and Historically Black Colleges and Universities or Minority Institutions and the offeror’s degree of commitment to implementing proposed opportunities, the Government will assign a rating of Acceptable or Unacceptable based on the overall percentage goal of subcontracting dollars to the aforementioned groups and the complexity level, variety of participation, and specifically identifying firms that will perform the subcontracted work. Small businesses submitting a Socioeconomic/Subcontracting Proposal will be assigned a rating of Acceptable.

Note: A proposal receiving a rating of Unacceptable in this factor after final proposal revisions will be ineligible for award.

Factor 4: Price

A Firm Fixed Price (FFP) contract will result from this solicitation. The Government will perform evaluation of the offered prices in accordance with the terms of the solicitation. Prices will always be evaluated for reasonableness.

The total price offered for CLIN 0001 will be multiplied by 48. The total price offered for CLIN 0002 (Option ) will be multiplied by 60.

Option (Extension Provision) price: In accordance with FAR 52.217-8 – Option to Extend Services, the Government has the unilateral right to extend any resulting contract upon the same terms and conditions for a total of no more than six months. To account for the option period(s) possible under 52.217-8 (maximum of six months), the Government will evaluate the option to extend by adding six months of the Offeror’s performance period price to the Offeror’s total price. In accordance with FAR 52.217-9 Option to Extend the term of the contract the Government may extend the term of this contract by written notice to the Contractor within 30 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. If the Government exercises this option, the extended contract shall be considered to include this option clause.

The sum of the aforementioned products will be the offeror’s evaluated price. This price will then be used for comparison to all offerors evaluated prices.

The Government reserves the right to conduct a price realism analysis to determine whether the offeror understands the requirements and to determine the firm’s responsibility IAW FAR 15.404-1(b)(2) – Proposal Analysis Techniques.

The Government may determine that an offer is unacceptable if the prices are significantly unbalanced.

The Government reserves the right to award to other than the lowest evaluated offer.

Competitive Range:

The Government reserves the right to limit the number of offers included in the competitive range for the purposes of efficiency in accordance with FAR 15.306(c)(2).”

b. Technical Rating Definitions IAW the DOD Source Selection Guide, Section 3.1.2.2 Methodology 2:
