1. The purpose of this Amendment is to incorporate the below questions and answers:
Questions and Answers:
Question 1: The attached Davis Bacon wage determination is for highway construction and does not include the corresponding classifications in the solicitation and Attachment 5, i.e. plumber, hvac mechanic, etc. Can you please confirm this is the correct determination we are to use?
Government Response to Question 1: The correct Davis-Bacon Wage Determination has been attached to this amendment and supersedes the previous version included in the solicitation.
Question 2: What is the significance of the Collective Bargaining Agreement to prospective bidders? The Agreement sets forth wage rates and fringe benefits, which may or may not conflict with those of Davis Bacon Rates for the corresponding trades. Please advise?
Government Response to Question 2: The Collective Bargaining Agreement (CBA) referenced in the solicitation establishes wage rates, fringe benefits, and working conditions applicable to employees covered by the CBA. However, the Davis-Bacon wage determination included in this solicitation establishes the minimum wage and fringe benefit rates that must be paid to all laborers and mechanics performing work under the contract.
If the bidder is a signatory to a CBA, that contractor must comply with the terms of the CBA. In cases where the wage rates and fringe benefits prescribed by the CBA differ from those in the Davis-Bacon wage determination, the higher rate or benefit applies.
If the CBA rates are higher than the Davis-Bacon rates, the contractor must pay the higher CBA rates.
If the CBA rates are lower, the contractor must pay at least the Davis-Bacon minimum rates as required by law.
All bidders are responsible for ensuring compliance with the applicable Davis-Bacon requirements and for incorporating the appropriate labor cost into their proposals.
Question 3: Will a Virginia Class A contractor’s license in Plumbing and HVAC satisfy licensing requirements?
Government Response to Question 3: Yes, a Virginia Class A contractor’s license in Plumbing and HVAC will satisfy the licensing requirements.
